A-1 Amendment 0002

Question 1

The PDF file version of this solicitation that is posted on FedBizOps is imaged, thus it is not conducive for cut-ting and pasting necessary for preparing questions & answers, proposal responses and other preparatory steps.

Will you please provide the complete solicitation, or minimally the Description/Specifications/Work Statement, in an editable MSWord format via an updated file posting on FedBizOps ASAP?

Answer: See Amendment 1 posted on FedBizOps November 14, 2013.

Question 2 – 6 parts

We have several questions regarding the solicitation schedule:

When does the AOUSC anticipate distributing answers to questions?

Answer: All amendments are posted on FedBizOps as soon as possible.

The AOUSC’s responses to questions are essential, directly relate to our proposal preparation and thus, upon re-ceipt of the AOUSC’s answers, these require integration into proposer’s business cases and proposals. Please also note that leading vendors commonly ship proposals two days in advance to mitigate the potential for delays in shipment/delivery. These points made, will the AOUSC please provide any necessary extension of the pro-posal due date to allow at least two (2) weeks from the AOUSC’s distribution of answers to vendor questions?

Answer: The AOUSC will consider an extension when/if the necessity occurs.

When is the anticipated intent to award and/or award date?

Answer: The anticipated award date is May 1, 2014.

Will all proposers be simultaneously advised of the intent to award and, if so, by what method (email?, (posting on FedBizOps? Other?)

Answer: All offerors will be advised of contract award on the same date via email.

Award announcement will also be posted on FedBizOps.

Are price proposals evaluated by the same or different evaluation committee members?

Answer: Source selection information is not releasable.

Are evaluation committee members who score technical proposal elements apprised of pricing in advance of scoring technical proposal elements?

Answer: No.

Question 3 – 9 parts

Solicitation page 6, item C.3 calls out “Equipment Requirements…The contractor shall provide random alcohol testing methods via the use of electronic monitoring equipment that may occur in the defendant/offender's home, not to include transdermal alcohol testing methods. This system shall detect the presence of alcohol and shall have the capacity to transmit results remotely through a secured telephone connection or form of secured

USCA14R0001 /0002 - Page 2 of 9 wireless transmission. The equipment may be used as a stand- alone device or in conjunction with radio fre-quency monitoring.” We have several questions here:

With regard to the wording “may occur in the defendant/offender's home", leading traditional in-home Remote Alcohol Testing technology come in separate models with different costs for two approaches – One model cap-able of connecting and reporting all information via the participant’s home phone line and a second model cap-able of reporting all information via an internal cellular transceiver (for participants without home phone lines).

To our knowledge, federal districts use both.

Is the AOUSC interested in proposals for both Landline and Cellular models?

Answer: No, do not submit separate proposals. However, offerors wishing to propose both landline and cellu-lar should make it clear in the proposal and propose a single price which includes both. To assist in pricing, of-ferors should assume that of the total number of units utilized, 10% are cellular devices See Amendments to Solicitation below.

If so, to ensure proposals are obtained for both, enabling the AOUSC to evaluate/award both, will you please:

• Add a requirement to the solicitation scope such as the following, “Proposals shall include Remote Alcohol Testing technology in two (2) separate models: (a) A model capable of connecting and reporting all information via the participant’s home phone line plus, (b) A model capable of reporting all information via an internal cel-lular transceiver (for participants withOUT home phone lines)”

And

1. Amend Attachment A to identify two (2) separate columns with headings “In-Home Landline” and “In- Home Cellular” thereby enabling proposers to quote and the AOUSC to evaluate all such models?

Answer: N/A

The wording “may occur in the defendant/offender's home" and the general cumulative specifications in the so-licitation appear indicative to only encompass traditional in-home technology that is configured exclusively in/ at the home of the participant, not mobile, and unable to test the participant while mobile in the community (at work, school, treatment, counseling, etc.). Leading providers have developed mobile breath alcohol testing sys-tems capable of testing in-home as well as while mobile, thereby capable of testing the participant at any time and at virtually any location, thus increasing supervision of compliance with alcohol abstinence orders. It is im-portant to also note that mobile breath alcohol testing commonly from all leading vendors has different costs than in-home models.

Is the AOUSC interested in proposals for both in-home and mobile models?

Answer: No, only in-home models will be considered.

If NOT, may proposers include separate technical information and pricing under a separate “Optional” section of their proposals for post award consideration as an unspecified option for “mobile breath alcohol testing”?

Answer: No. Optional proposals will not be reviewed.

If so, to ensure proposals are obtained for both, enabling the AOUSC to evaluate/award both, will you please:

• Add a requirement to the solicitation scope such as the following, “Proposals shall include Remote Alcohol Testing technology in separate models: (a) An in-home model configured exclusively in/at the home of the parti-cipant, and (b) A model capable of mobile breath alcohol testing capable of testing the participant in-home as well as while mobile, thereby capable of testing the participant at any time and at virtually any location”?

USCA14R0001 /0002 - Page 3 of 9

And

• Amend Attachment A to identify three (3) separate columns with headings “In-Home Landline”, “In-Home Cellular” and “Mobile Cellular” thereby enabling proposers to quote and the AOUSC to evaluate all such mod-els?

Answer: N/A

Consistent with the AOUSC’s responses to items a & b immediately above, will you please amend (or may pro-posers amend) Attachment A

Answer: No. Offerors should not make any changes to Attachment A.

With regard to “not to include transdermal alcohol testing methods”, may proposers include separate technical information and pricing under a separate “Optional” section of their proposals for post award consideration as an unspecified option for “transdermal alcohol testing methods”?

Answer: No. Optional proposals will not be reviewed.

If NOT, does AOUSC anticipate a separate independent solicitation for “transdermal alcohol testing methods” and, if so, when is this anticipated to be released?

Answer: If the AOUSC plans to award a transdermal alcohol testing procurement, it will be advertised on Fed- BizOps.

If NOT, in general, why is AOUSC not interested in “transdermal alcohol testing methods”?

Answer: This question is not within the scope of this solicitation. Therefore, no response is provided.

Question 4 – 6 parts

Solicitation page 4, item B.2 calls out “B.2 Estimated Quantities…The quantities listed in the "Total # of Units Utilized Per Year/Average Days Per Year Per Unit" column in Attachment A are estimates of the number of participants expected to be electronically monitored and the average number of active units being monitored on a daily basis.”

Is Attachment A “Total # of Units Utilized Per Year/Average Days Per Year” for “Base Period 0001” of “166/210” indicative of the average daily population inclusive of all federal districts nationwide?

Answer: Yes.

If NOT, will you please provide the average daily population for all districts nationwide?

Answer: N/A

What is the national average length of stay per participant on Remote Alcohol Detection throughout the U.S Courts?

Answer: 210 days

As a general indicative footprint necessary for post-award deployment, training, support, etc., will you please provide how the “Total # of Units Utilized Per Year/Average Days Per Year” for “Base Period 0001” of “166/210” is anticipated to breakdown by federal district via a listing of federal district names and the associ-

USCA14R0001 /0002 - Page 4 of 9 ated volume for each model (In-Home Landline, In-Home Cellular, Mobile-Cellular)? (Please note: If the AOUSC PMD does not have this data, your incumbent contractors do and are required under contract to provide it to you upon request – If necessary to obtain it, will you please request it from your incumbent contactor(s) and provide it in response to this question so as to establish a level playing field/visibility to all prospective pro-posers?)

Answer: See answer 4.e. below.

If not, will you please provide a listing of federal districts who are present users of Remote Alcohol Testing and kindly indicate which models (In-Home Landline, In-Home Cellular, Mobile-Cellular) are of interest to each district?

Answer: No, because all Federal districts are included in the estimated total, of which all but 10% cellular are landline devices.

What percentage of the existing federal districts using the “Remote Alcohol Detection” that make up the “Total # of Units Utilized Per Year/Average Days Per Year” for “Base Period 0001” of “166/210” have confirmed a general indication to utilize the contract resulting from this solicitation versus contract for their own district level contract via independent purchase order?

Answer: We will not provide percentages. The totals provided are based on actual contract use.

Question - 2 parts

Pricing for Remote Alcohol Testing is commonly based on including an average number of tests per participant per day with a separate incremental per-test price for additional tests above that included volume (Example:

“$X.XX/participant per day including for up to four (4) tests per participant per day, additional tests above this included volume shall be $X.XX/test.”)

To establish consistent pricing from all proposers, what average number of tests per participant per day should be incorporated into the primary price line items on Attachment A?

Answer: Pricing should be based on up to 4 tests per day for each participant. Additional tests will not be au-thorized or funded. See Amendments to Solicitation below.

May proposers separately identify on Attachment A, a separate per-test price for tests above this included num-ber of tests?

Answer: No. Offerors should not make any changes to Attachment A.

Question 6

What percentage of the federal districts utilizing Remote Alcohol Detection observe a “zero tolerance” for par-ticipants consuming alcohol while under electronic supervision versus those who authorize participants to con-sume but only within the locally imposed legal limits of consumption?

Answer: All participants utilize the devices on the current contracts for purposes of monitoring a “no alcohol” condition.

Question 7

Solicitation, pages 5 & 6 of 38, Section C-1 Statement of Work call out “The full text of The Guide to Judiciary Policy, Volume 8 Probation and Pretrial Services, Parts C and E may be accessed electronically and the fol-lowing addresses:

USCA14R0001 /0002 - Page 5 of 9 http://jnet.ao.dcn/img/assets/6621/Part_C.pdf http://jnet.ao.dcn/img/assets/6617/Part_E.pdf”

These links/addresses appear to NOT be accessible – Will you please send these two documents via updated file postings on FedBizOps?

Answer: See Amendment 1 posted on FedBizOps November 14, 2013.

Question 8

Are there any pending federal initiatives that may significantly increase or decrease the use of Remote Alcohol Testing and, if so, will you please indicate each with an anticipated impact timeline and associated percentage of increase/decrease?

Answer: No

Question 9 – 4 parts

From our experience, most users of Remote Alcohol Detection use it simultaneously on the same participant and/or combination with a primary form of Location Based Monitoring (RF, GPS, etc.). We have several ques-tions here

May proposers include separate technical information and pricing under a separate “Optional” section of their proposals for post award consideration as an unspecified options for methods of Location Based Monitoring such as Radio Frequency/Curfew Monitoring and GPS tracking.

Answer: No. Optional proposals will not be reviewed.

If NOT, does AOUSC anticipate a separate independent solicitation for Location Based Monitoring such as Ra-dio Frequency/Curfew Monitoring and GPS tracking and, if so, when is this anticipated to be released?

Answer: If the AOUSC plans to award a location monitoring procurement, it will be advertised on FedBizOps

If NOT, in general, why is AOUSC not interested in Location Based Monitoring such as Radio Frequency/ Curfew Monitoring and GPS tracking?

Answer: This question is not within the scope of this solicitation. Therefore, no response is provided.

1. If NOT, when does the AOUSC anticipate releasing a solicitation for Location Based Monitoring such as Radio Frequency/Curfew Monitoring and GPS tracking?

Answer: If the AOUSC plans to award a location monitoring procurement, it will be advertised on FedBizO-ps.

Question 10

Solicitation, page 8 of 38, item C.7.3 calls out “The system shall allow for storing probation/pretrial office pre-defined zones that can be applied to any defendant/offender." As written, this requirement appears to be for GPS Location Based Monitoring – NOT “Remote Alcohol Detection.” Will the AOUSC please delete this re-quirement in its entirety, or change the “shall” to a “should” and/or define in detail how such “zones” apply to “Remote Alcohol Detection”?

USCA14R0001 /0002 - Page 6 of 9

Answer: Paragraph C.7.3 will be deleted as this solicitation does not apply to any GPS related requirements.

See Amendments to Solicitation below.

Question 11 – 3 parts

Solicitation, page 9 of 38, item C.8 calls out “Notification of Failed Tests and Noncompliance with Equip-ment…Upon the occurrence of any failed test and/or noncompliance with equipment (power loss, tampers and battery issues), the monitoring system shall notify the assigned officer within one (1)hour and as established by the probation/pretrial office protocol shall include email, telephone call, text and or any combination of the three. The contractor's system shall be capable of providing for multiple notifications to multiple persons/agen-cies by telephone, text message or email.” We have several questions here:

By “telephone” does the AOUSC mean a live monitoring center operator to call the telephone of the officer?

Answer: Notification must be by one and or any combination of the three of the following methods: 1) live telephone call; 2) text, or 3) email.

If NOT, will you please define in detail how this is intended to be completed?

Answer: See answer to 11a. above.

What percentage of the overall participants is anticipated to require notification via “telephone”?

Answer: All failed tests require notification.

Question 12 - 2 parts

Solicitation, page 12 of 38, item C.12.1 calls out “Data Imports I Platform Interface…The contractor's platform system shall have functionality that will allow data fields identified by the COTR to be imported into the nation-al case tracking system and management database which is currently Probation and Pretrial Services Automated Case tracking System (PACTS) and will be PACTS Gen3. The data shall be imported via an interface provided by the contractor that will push selected data fields and elements to the national system's chronological record.”

Will AOUSC accept evaluate, & score (NOT reject) proposals that do not meet this requirement on the date of proposal submittal rather, propose to implement this capability within a reasonable period following award?

Answer: Proposals that include a plan to achieve this functionality within 90 days of award will be accepted.

See Amendments to Solicitation below.

Will the AOUSC please change this “shall” to a “should”?

Answer: No.

Question 13 - 2 parts

Solicitation, page 17 of 38, item C.27 calls out “Lost/Stolen/Damaged Equipment…The contractor shall be re-sponsible for the replacement costs of all lost, stolen or damaged equipment. NOTE: To assist in pricing this unknown quantity, the average loss nationally for this equipment has averaged one per year.”

Is this indicative that, for the total units in use as indicated on Attachment A “Total # of Units Utilized Per Year/Average Days Per Year” for “Base Period 0001” of “166/210” there was only one unit lost, damaged or stolen?

Answer: Yes – correct.

USCA14R0001 /0002 - Page 7 of 9

If not, will you please define in greater detail?

Answer: N/A

Question 14 - 2 parts

Solicitation, page 30 of 38, item L.3.4 calls out “Part 4 - Contract Pricing/Completed Pricing Schedule - Attach-ment A… The judiciary intends to make a single award from this solicitation.” We have several questions here:

Acknowledging that the AOUSC has historically maintained a multi-contractor approach with the intent to provide the federal districts with “choice” of a broad menu of multiple contractor solutions and, acknowledging that Remote Alcohol Testing is one of the most rapidly diversifying segments of the offender monitoring market place, why is the AOUSC intent on limiting this to a single award?

Answer: The AOUSC has determined that one contract for Remote Alcohol Detection is sufficient.

Acknowledging the number of federal districts electing to contract independently through issuance of district-level purchase orders, as a means to bring greater continuity and wider district use of a national contract, will the AOUSC please consider amending this to solicitation to a multiple award?

Answer: No.

Question 15

Solicitation, page 36 of 38, item M.1.2 calls out “Award Using Best Value Determination Method” Approxim-ately what percentage of the overall award will be based on price?

Answer: As stated in the solicitation in Section M.2.4 – Price Evaluation, price is not a numerically weighted factor. The importance of price in the evaluation will increase with the degree of technical equality of the pro-posals or when the price is so significantly high as to diminish the value of the technical superiority to the gov-ernment.

Question 16 - 6 parts

We have several questions regarding the access to public records:

Will proposer names be available following the submission date?

Answer: The name of the awardee will be published in FedBizOps.

If not, when do proposer names become public record?

Answer: Other than the name of the awardee, this information is not made publicly available.

Will proposer pricing be available following the submission date?

Answer: The price of the awarded contract will be published in FedBizOps. .

If not, when does proposer pricing become public record?

Answer: Other than the price of the awarded contract, this information is not made publicly available.

Will technical solicitation responses be available for review following the award date?

USCA14R0001 /0002 - Page 8 of 9

Answer: No.

If not, when do technical solicitation responses become public record?

Answer: This information is not made publicly available.

Amendments to Solicitation

Solicitation USCA14R0001 is hereby amended as follows:

1. Section C.3, Equipment Requirements, is hereby amended to read as follows:

The contractor shall provide random alcohol testing methods via the use of electronic monitoring equipment, to include landline or cellular models that may occur in the defendant/offender’s home, not to include trans-dermal alcohol testing methods. This system shall detect the presence of alcohol and shall have the capacity to transmit results remotely through a secured telephone connection or form of secured wireless transmission. The equipment may be used as a stand-alone device or in conjunction with radio frequency monitoring and shall be capable of conducting up to 4 tests per day for each participant.

NOTE: Offerors wishing to propose both landline and cellular devices should make it clear in the pro-posal and propose a single price which includes both. To assist in pricing, offerors should assume that of the total number of units utilized, 10% are cellular devices

The contractor shall be solely responsible for all coordination and any and all failures and deficiencies resulting from equipment or services acquired by the government under this contract. The contractor shall provide re-placement equipment as needed. The probation/pretrial services staff will use government-furnished electronic communications transmission systems and protocols (e.g., File Transfer Protocol (FTP), Hyper Text Transport Protocol (HTTP, HTTPS, or email) to send and receive monitoring information to and from the contractor. The contractor is not responsible for providing the electronic communications transmission systems for transferring monitoring information with probation and pretrial services staff.

2. Section C.7, Remote Access to Monitoring System, subparagraph C.7.3 is hereby deleted in its entirety.

Therefore Paragraph Section C.7.3 is revised to read as follows: RESERVED.

3. Section C.12, User Access to Data, subparagraph C.12.1 Data Imports/Platform Interface is re-vised to read as follows:

The contractor’s platform system shall have functionality within 90 days of award that will allow data fields identified by the COTR to be imported into the national case tracking system and management database which is currently Probation and Pretrial Services Automated Case tracking System (PACTS) and will be PACTS Gen3. The data shall be imported via an interface provided by the contractor that will push selected data fields and elements to the national system’s chronological record.

All other terms and conditions remain unchanged.
