I. Contracting Activity.
The contracting agency for this request is 10th Contracting Squadron located at the United States Air Force Academy (USAFA).
II. Nature and/or description of the action being processed.
The action being processed is a sole source contract to a Service Disabled Veteran Owned Small Business (SDVOSB) to provide full emergency patient transport (Ambulance Service) on the United States Air Force Academy, IAW FAR19.1406. The Government intends to procure this requirement through other than full and open competition IAW FAR 13.501(a)(1)(ii). FAR Parts 12 and 13 procedures will be used and a new firm fixed priced contract will be awarded with a one year base period and a one year option period.
III. Description of supplies/services required to meet agency needs.
The requirement is for full emergency patient transport non-personal services (EMT, paramedic, ambulance) at the United States Air Force Academy (USAFA), including the USAFA flight line, cadet area, community center, Jack's Valley, Pine Valley housing area, Douglass Valley housing area, and the I-25 Corridor bordering the base and shall include a minimum of three dedicated ambulances positioned on USAFA.
Services shall meet the professional standards of the Accreditation Association of Ambulatory Health Care (AAAHC) and the Colorado State Department of Public Health and Environment, Health Facilities and Emergency Medical Services Division and staffing/performance shall be performed in accordance with current and future State of Colorado regulations and protocols (see attached performance work statement).
IV. Statutory authority permitting other than full and open competition.
IAW FAR 6.302-5(b)(6), 15 U.S.C 657f, Veterans Benefits Act of 2003, as implemented by FAR 19.1406
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
IAW FAR 19.1406(a) a contracting officer shall consider a contract award to a SDVOSB concern on a sole source basis before considering a small business set-aside provided none of the exclusion of FAR 19.1404 apply and; 1. The contracting officer does not have a reasonable expectation that offers would be received from two or more service-disabled veteran owned small business concerns. 2. The anticipated award price of the contract including options will not exceed $4 million for a requirement with an other then manufacturing NAICS code. 3. The requirement is not currently being performed by an 8(a) participant. 4. The service disabled veteran owned small business concern has been determined to be a responsible contractor with respect to performance and 5. Award can be made at a fair and reasonable price.
Market research identified multiple small business sources but not multiple sources under any one socioeconomic contracting program. Hence, there is not a reasonable expectation that offers would be received from two or more SDVOSB concerns. The anticipated award price including options will not exceed $4 million. The requirement is not currently being performed by an 8(a) participant, the SDVOSB has been determined to be a responsible contractor and it is expected that award can be made at a fair and reasonable price.
IAW FAR 19.1404 mandatory Sources (Federal Prison Industries & AbilityOne) were researched and no source was identified that can provide this service. This requirement cannot be satisfied through an order under an indefinite-delivery contract or an order against a Federal Supply Schedule and this requirement is not currently being performed by an 8(a) program participant.
Market Research only identified one interested SDVOSB that can satisfy this requirement. Based on the same market research there is not a reasonable expectation that an offer would be received from two or more SDVOSB concerns.
This is based on the fact that Asteri EMS was the only SDVOSB to respond to the sources sought notice as well as the

In addition, the anticipated contract value, including options, will not exceed $4 Million. Moreover, Asteri is a SDVOSB small business concern that has been determined to be a responsible contractor with respect to performance, as seen by their past performance on the current Schriever contract.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
As a result of a Sources Sought Notice which posted on 17 Aug 2020, four of the five vendors that responded were small businesses. The results of this Sources Sought are detailed further in Section VIII of this document.
IAW FAR 19.203(c) for acquisitions above the simplified acquisition threshold the contracting officer shall first consider an acquisition for the small business socioeconomic contracting programs (i.e. 8(a), HUBZone, SDVOSB, or WOSB programs) before considering a small business set-aside. IAW FAR 19.203(a) there is no order of precedence among these socioeconomic contracting programs. IAW FAR 19.203(d) in determining which socioeconomic program to use for an acquisition, the contracting officer should consider, at a minimum; 1. Results of market research that was done to determine if there are socioeconomic firms capable of satisfying the agency's requirement and 2. Agency progress in fulfilling its small business goals.
IAW FAR 19.201(a) It is the policy of the Government to provide maximum practicable opportunities in its acquisitions to small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business, and women-owned small business concerns.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
This will be a negotiated, direct award to a SDVOSB service provider. A detailed statement of price reasonableness will be documented in the contract file, fair and reasonable price will be determined IAW FAR 15.404-1(b)(2) comparison of proposed prices with independent Government cost estimates, comparison with historical pricing, and comparison of proposed prices with prices obtained through market research for the same or similar items.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market Research began with a Sources Sought Notice, FA7000-21-S-0001, posted to Beta.Sam on 17 Aug 2020.
Responses to this vendor survey were due by 31 Aug 2020. Responses expressing interest in the acquisition were received from five different vendors which included Optimum Medicine, Western Star Hospital, 9 Line, American Medical Response, and Asteri EMS. Details for the competitive vendors are shown in the Process Information of the Market Research Report in KTFS file element 195. Following the closure of the Sources Sought Notice a review of the interested parties was conducted and it was determined that no single socioeconomic category would yield two or more offers as there was one Service Disable Veteran Owned Small Business and one Women Owned Small Business interested in the requirement. No other socioeconomic categories we represented. In addition, 10 CONS did not meet their SDVOSB goal for FY20 and has authority to consider this acquisition for a direct award to a SDVOSB, IAW FAR 19.1406. Based on guidance outlined in section VI of this document, it was determined that a sole-source direct award to a Service Disable Veteran Owned Small Business entity would be the most efficient strategy for meeting this requirement. A capabilities briefing was was held 14 Dec 2020, in attendance were 10 CONS personnel, 10th Medical Group Functional Service Manager, and the CEO of Asteri EMS. During the capabilities briefing, the CEO provided an overview of Asteri's ability to meet the requirements set forth in the Performance Work Statement. The requirement owner and 10 CONS personnel were also able to ask questions to ascertain Asteri's capability of meeting the requirement.

IX. Any other facts supporting the use of Other Than Full and Open Competition.
Asteri EMS currently holds contract number FA2550-21-P-0004 for similar ambulance service at Schriever AFB, and is performing successfully IAW the Performance Work Statement. A review of SAM.gov, FAPIIS.gov, and cpars.gov show no negative information attributed to Asteri EMS. It is the acquisition team's belief that, if awarded a sole-source direct award contract, Asteri EMS has the ability to provide ambulance service in accordance with the Performance Work Statement, as well as the experience to work in a military environment in order to ensure a smooth and efficient transition with no degradation in this critical service.
X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
As has been the case leading up to this acquisition, market research will continue to be accomplished and refined during the Period of Performance of the resultant contract to allow for a competitive reacquisition at the end of this contract.
