QUESTIONS AND ANSWERS

UNAWRD-18-Q-NY19

Question 1: Per the subject stated solicitation, it is noted as "Third Party quotes will NOT be accepted.""

Please advise your definition of "Third Party".

Answer: The FAR does not provide a definition per se of “Third Party;” however, the Google definition is sufficient. Google defines “third party” as a person or group besides the two primarily involved in a situation, especially a dispute. In this case, the two primary groups are the Government and the Hotel.

Additionally, in the 2017 NYC Lodging requirement, legal review was sought for a quoter who submitted a quote on behalf of a hotel and legal ruled that the quote was considered a third party quote due to the fact that the entity submitting the quote was a separate entity from the hotel, even though there was an agreement between the hotel and the entity, the entity possessed its own DUNS Code and CAGE Code and there was no DUNS and CAGE established for the hotel and the entity submitting the quote. Basically, the quote needs to be submitted directly by the hotel.

Question: We are a National Federal Contractor and would be interested in submitting a bid for this solicitation. Do you consider us a 3rd party? If so; if we provide a 3rd party agreement from the hotel would you allow us to bid on this requirement?

Answer: Please see above answer. In the previous year’s requirement, the entity who submitted the quote on behalf of the hotel also had an agreement with the hotel; however, there was no DUNS and CAGE code connecting the entity and the hotel which is interpreted to mean the hotel and the party submitting the quote were not the same business and therefore the company submitting the quote was considered a 3rd party.
