About this file
This is a Brand Name Specification Determination document issued by the Oregon Department of Corrections on November 10, 2021, for the procurement of PVI hot water heaters at the Two Rivers Correctional Institution (TRCI). The specification covers a five-year contract period from November 10, 2021, through November 1, 2026, with a not-to-exceed total estimated cost of $140,000. The agency seeks to acquire PVI brand hot water heaters and related products to support the facility's existing heating infrastructure, which currently operates four boilers and over ten hot water heaters of various PVI brand units.
The determination approves the brand name specification based on multiple justifications, including that PVI products are sold exclusively through territorial distributors, with Proctor Sales serving as the sole authorized distributor for Oregon, Washington, Alaska, and Northern Idaho. The specification satisfies regulatory requirements under ORS 279B.215 and OAR 125-247-0691 by demonstrating that purchasing compatible PVI equipment is necessary for efficient utilization of existing goods, enables staff familiarity with maintenance and repairs, reduces spare parts inventory requirements, and minimizes infrastructure modifications during equipment replacement. The Designated Procurement Officer, Toni Payseno of the Oregon Department of Corrections, approved the brand name specification based on findings that it would not encourage favoritism or substantially diminish competition due to the exclusive territorial distribution arrangement.

DETERMINATION OF BRAND NAME SPECIFICATION
PART A. Introduction, Background, and Findings.
1. Agency Name: Oregon Department of Corrections
2. Date: 11/10/2021 – 11/01/2026 3. Agency 5-digit Number: 29100
4. Agency Contact Name: Jeff Darcy 5. Phone: 541-922-2184
6. Total Estimated Cost: $ NTE - $140,000 (5 years)
7. Title; Brand Name to be Acquired - PVI
8. Background: Agency shall provide the background for this brand name determination.
TRCI has four (4) boilers and over ten (10) hot water heaters of various sizes that are all PVI brand. By purchasing PVI products we can maintain a smaller inventory of spare parts. Plus, we are usually even able to replace products without change or minimal changes to the building infrastructure when replacing equipment.
9. Findings to Satisfy the Required Standards: Agency determines that:
__X_____ (a) Use of a brand name Specification is unlikely to encourage favoritism in the awarding of Public
Contracts or substantially diminish competition for Public Contracts because:
PVI products are sold by territorial rights and only sold by Proctor Sales for the State of Oregon
__N/A_____ (b) Use of a brand name Specification would result in substantial cost savings to the Agency; (i) will result in substantial cost savings to the contracting agency or to the public because:
___X____(c) There is only one manufacturer or seller of the product of the quality, performance or functionality required:
PVI Goods have exclusive regional territorial distributors. Proctor Sales is the Oregon/Washington/Alaska and Northern Idaho sole distributor. Letter dated 9/21/2017 from Proctor Sales supports this decision.
___X____ (d) Efficient utilization of existing Goods requires the acquisition of compatible Goods or Services.
because:
TRCI already has in place multiple hot water heaters that are PVI brand. Purchasing the same brand of hot water heater will allow for use of existing parts, and staff are familiar with this brand of hot water heaters.
This will allow savings in parts as they maybe interchangeable, but also in repairs that the staff may have to deal with in the event of an emergency.
