Emergency Purchase Details BidBuy Reference #: B- 53062
Emergency Condition (select the appropriate option from the drop-down menu below):
Immediate expenditure is necessary for repairs to State property to protect against further loss or damage
Provide a description and reasons for needing this emergency purchase:
The affected towers at Metamora, Kingston, and Pontiac are equipped with obstruction lighting required by FAA and FCC regulations. The existing lighting has become nonfunctional, placing ISP in violation of FAA guidelines. ISP has received multiple notices regarding this violation and is currently required to warn aircraft of the towers' presence until the lighting is restored.
Continued nonfunctionality exposes ISP to escalating daily fines, which can exceed the cost of repair within weeks. In the event of an aviation incident involving an unmarked tower, ISP faces significant legal liability. Immediate expenditure is necessary to protect against further loss or damage to State property, both in terms of accruing financial penalties and the legal exposure created by maintaining a nonfunctional and non-compliant lighting system. The scope of work includes removal of the existing nonfunctional obstruction lights at the Metamora, Kingston, and Pontiac tower locations and installation of replacement LED obstruction lighting systems. The LED upgrade ensures continuous compliance with FAA and FCC regulations while enhancing local aviation safety and operational reliability.
Provide the conditions and circumstances that led to the need for this emergency purchase:
The towers at Metamora, Kingston, and Pontiac are State-owned communications infrastructure required to display FAA/FCC-mandated obstruction lighting. The existing lighting systems at these locations have failed and become nonfunctional. As a result, ISP is currently out of compliance with FAA regulations and has received multiple notices of violation requiring ISP to actively warn aircraft of the towers' presence in the interim. Each day the lighting remains nonfunctional, ISP is exposed to escalating regulatory fines and potential liability in the event of an aviation incident. Given the ongoing compliance violations and accumulating financial and legal risk, ISP determined that the urgency of restoring the lighting could not accommodate the time required for a new competitive procurement.
Reason for selection of this particular vendor:
Tri County Tower LLC was selected based on their submitted pricing and ability to complete the work within the required emergency timeframe. Of the five vendors contacted, Tri County Tower LLC provided the lowest price and was the only vendor to confirm availability to complete all three tower locations, Metamora, Kingston, and Pontiac, by June 30, 2026. The remaining vendors either could not meet the deadline due to crew and material constraints, declined to participate, or submitted pricing that exceeded Tri County Tower LLC's quote
Description of supplies or services to be provided:
Remove old nonfunctioning Light system top beacon, side marker light, control box, and old wiring and dispose of all old equipment. Provide and install new LED tower light kit meeting FAA specs and the avian flashing requirement, system will include daytime white flash LED/red night flash LED, top beacon and 2 midlevel beacons. Install new system appropriate cable for LED light system. System will operate on 120 volts ac and have an external photocell to switch between day and night operations. New LED lighting system will have alarm contacts and test modes with LED indicators on the light controller for diagnostics. ISP will hook up alarm wiring to the provided terminals on the light controller.

Describe the actions taken by the agency to make the emergency purchase with as much competition as is practicable under the circumstances:
In an effort to obtain as much competition as practicable, ISP reached out to five vendors with expertise in tower lighting work.
Each vendor was provided the full scope of work, asked to submit pricing, and requested to confirm their ability to complete the work by June 30, 2026.
Tri County Tower LLC provided the lowest responsive quote and confirmed availability to complete the work by June 30, 2026.
Based on their competitive pricing, demonstrated familiarity with the scope of work, and ability to meet the required timeline, Tri County Tower LLC was selected for award.
Meridian Blue Construction was contacted and did provide a quote; however, their pricing was higher than Tri County Tower LLC's. Additionally, Meridian Blue indicated that meeting the June 30, 2026 deadline was contingent on placing a material order immediately, introducing uncertainty into their ability to complete the work on time.
Allstate Tower Inc. was contacted but was unable to meet the June 30, 2026 deadline. They cited current crew capacity booked through mid-to-late August and material lead times of approximately three weeks from the date of order, making completion within the required emergency timeframe infeasible.
Tower Communications Expert, LLC, a BEP-certified vendor, was contacted but indicated their crews would not be able to complete the work by June 30, 2026. They further noted that due to their current workload, it would take several days just to develop a pricing proposal, making their participation in this emergency procurement impractical.

Van Mack Electric Co., a BEP-certified vendor, was contacted but declined to participate. They cited an existing high-volume workload with current IDOT projects and noted that the Metamora, Kingston, and Pontiac tower locations fall outside their normal service area, making timely completion not feasible.
ISP made best efforts to obtain BEP participation by contacting both BEP-certified vendors identified in the BEP database.
Neither vendor was able to perform the work within the required emergency timeframe due to capacity and geographic constraints. Tri County Tower LLC's quote is attached.
List the actions taken by the agency that constitute its best efforts to include contractors certified under the Business Enterprise Program in this emergency purchase:
ISP identified and contacted both BEP-certified vendors listed in the BEP database with the capability to perform tower lighting work: Tower Communications Expert, LLC and Van Mack Electric Co. Each vendor was provided the full scope of work and asked to confirm pricing and availability to complete the work by June 30, 2026. Tower Communications Expert, LLC responded but indicated their crews were unavailable to complete the work within the required timeframe and that it would take several days just to develop a pricing proposal, making their participation in this emergency procurement impractical.Van Mack Electric Co. responded but declined to participate, citing existing capacity constraints with current IDOT projects and noting that the affected tower locations fall outside their normal service area.
Despite ISP's best efforts to secure BEP participation, neither certified vendor was able to meet the requirements of this emergency procurement. ISP was therefore unable to include a BEP-certified contractor in this purchase.
