PERFORMANCE WORK STATEMENT

FOR

Testing, Adjusting, Calibration, Sound/Noise measurement, Existing Building Commissioning

1.
DESCRIPTION OF SERVICES:

1.1. Scope: The contractor shall provide all labor, tools, transportation,travel, equipment, hoses, gauges, calibrated test equipment, materials, independent qualified Testing and Balancing (TAB) and independent commissioning services, Johnson Controls technician, manufacturer’s representatives, HVAC equipment technicians, insulation technician, sheetmetal mechanics and electrical technicians to fully test, adjust, calibrate, balance, and commission existing mechanical systems in accordance with the Appendices A, B, Attachments and in accordance with local, state and federal codes, and regulations. The contractor shall provide a systematic commissioning process for improving the current condition and operation of the HVAC system’s air distribution and water distribution and controls system in existing buildings. The contractor shall evaluate and verify the existing condition of each building’s HVAC system, air distribution system, water distribution system and controls and optimize the operation, performance, maintenance in accordance with Hanscom’s current building operational requirements, existing file mechanical system design drawings, HVAC controls’ sequence of operations, Johnson Controls manuals located in Building 1810, and manufacture’s operating and installation recommendations. The contractor shall reduce energy consumption, determine root causes of problems, optimize building systems’ control sequences for efficient and effective operation. Provide a commissioning work plan for each building within 20 calendar days of notice to proceed with narrative description of contractor’s technical approach and process with work schedule to identify building issues, test, adjust, calibrate, and balance each system in accordance with Appencies A, B, Attachments and PWS with technical description of step by step process to successful commissioning prior to the investigation and verification of existing conditions. The contractor’s commissioning plan shall include the submittal log and list all required submittals with anticipated dates. The contractor shall provide completed submittal logs and submittals within 20 Calendar days after notice to proceed as indicated in appendix B and its attachments or unless otherwise authorized by the contracting officer. The contractor shall comply with all other required submittals as indicated in the Appendices. The contractor shall provide red line drawings for each building every week to identify any changes and deficiencies. The contractor shall provide descriptive list of all deficiencies with recommended solutions with pictures, sketches, sizes, one-line diagram(s) and supporting technical documentation. The commissioning work plan shall include, but not be limited to; energy consumption reduction opportunities, comfort, indoor air quality, temperatures, humidity’s, critical temperature and humidity computer and electronic equipment cooling systems, building and system static pressures, location of static pressure sensors, noise, HVAC system, controls calibration, trending, design, service and maintenance issues, testing, adjusting and balancing. The contractor shall eliminate all elements that could impede the best energy efficient performance of the building HVAC system, air distribution system, water distribution system (cooling and heating). Mechanical system and associated subsystem deficiencies and services shall be performed under modification. The contractor shall be responsible for insuring all services and parts provided under this contract are in accordance with the terms and conditions outlined herein and conform to the manufacturer’s equipment operating, maintenance and installation recommendations, existing mechanical system drawings, and this Performance Work Statement (PWS) in accordance with local, state, federal standards, codes, and regulations.

1.2. Requested Service: The contractor shall provide all management, tools, supplies, testing, equipment, and labor necessary to fully provide Testing, Adjusting, Calibrating , Balancing and Existing Building Commissioning of the heating, ventilating, air conditioning, air distribution system , water distribution system for heating and cooling, building HVAC system and Johnson Controls direct digital controls for HVAC systems in each building. All services shall be provided by an independent Commissioning Agent and qualified TAB services contractor with current certification from a reputable professional organization in accordance with the specifications in “Attachment C.” Any work performed in the area where children are present the contractor's employees must pass a security check.

1.2.1. Weekly meeting and minutes of the meetings: The contractor shall meet every week in Building 1810 and provide oral and written briefing to the government key personnel of his progress. The contractor shall provide minutes of all meetings and attach a copy of his written progress report within 48 hours. The contractor shall provide the draft meeting minutes and allow all parties to review the meeting minutes and update and revise the minutes with final minutes to reflect government input within 72 hours.

1.2.2. Request for information: At any time the contractor has encountered a technical issue (question, clarification, substitution, deficiencies) during the performance of their effort the contractor shall provide a request for information (RFI) with the details of the question, documentation, references, impact, and proposed solutions and the date when the information is needed. Complete RFI should be sent to Contracting Administration and Contract Officer Representative (COR). The contractor shall allow 14 days for response.

1.3. Quality Assurance: According to the contract’s inspection clause, the government will evaluate the contractor’s performance under this contract. The COR is a representative of the Contracting Officer (CO) and will participate in the administration of this contract. Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the CO. All services to be performed by the contractor will be subject to review by the CO or COR. The contractor shall provide an answer to a submitted Corrective Action Report (CAR) and Customer Complaint Form from the COR within one (1) working day from receipt. The contractor shall provide written response addressing the root cause, corrective action and preventive actions (s).

1.4. Continuation of Essential Services during Crisis: This requirement has been determined not to be essential and does not require continued support during a crisis as define in DFARS Clause 252.237-7023.

1.5. Hours of Operation: The contractor shall perform work Monday thru Friday, under this contract during the following hours: 07:30 a.m. until 4:00 p.m., excluding Federal Holidays. Work required to be performed outside of these hours shall only be done after approval from the Contracting Officer.

1.5.1. HOLIDAYS. Hanscom AFB recognizes the following holidays:

1.6. Contractor Personnel: The contractor shall designate in writing the name of the Contract Manager (CM) and any alternate(s) who shall act for the contractor when the manager is absent with their telephone numbers where they may be contacted any time to the CO and the COR within five (5) calendar days after contract award. The CM or alternate shall have full authority to act for the contractor on all matters relating to operation of this contract at Hanscom AFB. The CM or alternate shall be available to meet on the installation with government personnel designated by the CO to discuss problem areas.

1.6.1. Listing of Contractor Employees: The contractor shall provide a CM who can read, write, speak, and understand English fluently. The contractor shall provide an initial listing of contractor employees’ names and position titles to CO and COR prior to contract start date. The contractor shall also provide an updated listing of personnel to the CO and COR within ten (10) work days when employees affecting the work of this contract have a status or position change.

1.6.2. The contractor shall not employ persons on this contract if such employee is identified to the contractor as a potential threat to the health, safety, security and general well being or operational mission of the installation and its population. The contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest, nor shall the contractor employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval according to the DoD 5500.7-R Joint Ethics Regulations (JER). In addition, the contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies contained in AFI 64-106, Air Force Industrial Labor Relations Activities. The contractor shall be prohibited from employing off-duty COR’s who are surveilling any contracts/subcontracts awarded to the Contractor. All contract employees depending on particular condition, occasion or place, or job assignment shall require professional, suitable attire. All contractor employees shall conduct themselves in a professional, courteous manner. The selection, assignment, reassignment, transfer, supervision, management, and control of contractor employees in performance of this PWS shall be the responsibility and prerogative of the contractor; however, the contractor shall comply with the requirements set forth in this PWS and Hanscom AFB regulations concerning conduct of employees as referenced herein. The contractor shall employ and maintain a technically trained and experienced work force.

1.7. Environmental Protection and Safety: The contractor shall be knowledgeable of and comply with all applicable federal, state and local laws, regulations and requirements regarding environmental protection and occupational safety and health. The contractor shall comply with any laws or regulation changes during the term of this contract. The contractor shall follow manufacturer’s guidelines and professional recommendations for control of humidity, temperature, cleanliness and materials handling (including hazardous materials).

1.8. Hazardous Material (HAZMAT): The contractor shall not store chemicals/HAZMAT on Hanscom AFB. All chemicals/HAZMAT shall be approved prior to being transported on base for use by any contractor. The contractor shall prepare and submit to the COR, ten (10) calendar days after contract award date, one (1) each, Chemical/Hazardous Material Request Authorization Form (Air Force Form 3952) and Material Safety Data Sheets (MSDS) for each chemical, material and substance proposed to be used in performance of this PWS. The Quality Assurance Engineer (QAE) will forward the completed AF Form 3952(s) and MSDS to 66 ABW/CEAN for approval. The contractor shall not transport or use any chemical, material or substance on Hanscom AFB before written approval is provided by 66 ABW/CEAN. Contractor shall maintain copies of MSDS(s) for all chemicals. The MSDS(s) shall correspond with the manufacturers of the chemicals on hand. Manufacturer, material, and MSDS shall match. NOTE: MSDS refers to manufacturer MSDS. Once material is approved for use, contractor shall contact base Environmental Management (EM) (66 ABW/CEAN) and provide a list of all material. 66 ABW/CEAN shall determine any additional material requirements based on the hazard code of the material.

1.9. Hazardous Waste: Contractor shall dispose of any spent/processed chemical solutions and used rags in waste drums located in the shop/area where the work is being performed.

1.10. Discharges: Any discharges into industrial waste treatment plant (IWTP) or sanitary sewer shall be done in accordance with Hanscom Industrial Waste Water Discharge Permit as instructed by 66 ABW/CEAN. The contractor shall maintain records of written authorization issued by 66 ABW/CEAN for discharges into IWTP and sanitary sewer.

1.11. The subject tanks are used in industrial applications with non-potable water and varying levels of heavy metals. For discharges outside of Hanscom AFB, the contractor shall ensure waste water discharges, that may contain Resource Conservation Recovery Act (RCRA) regulated metals resulting from any contracted service, go to a state/federal permitted treatment facility such as a municipal Publicly Owned Treatment Works (POTW).

1.12. Spills: Upon occurrence of any spills that could enter the storm system or cause any harmful environment effects, the contractor shall immediately call 911 to report the incident. When possible, the contractor shall use a base telephone to receive help from Hanscom AFB 911. If using a cell phone, request Hanscom AFB 911. The contractor shall report all environmental violations to the COR. The contractor shall submit a typed or written report about the incident within four (4) clock hours. The contractor shall provide five (5) copies of the written report. The contractor shall provide one copy to the CO, two copies to the COR, a copy for Unit Environment Coordinator (UEC) and a copy for record. The format of the report shall be left up to the contractor, but the report shall contain the following information.

1.13. Environmental and Safety Training: The contractor personnel shall have Resource Conservation Recovery Act (RCRA) environmental and safety training required by the state and federal government. The training shall be IAW the following regulations: Resource Conservation Recovery Act (RCRA) 40 Code of Federal Regulation (CFR) 265.16 “Personal Training”, Occupational Safety and Health Administration (OSHA) Hazardous Waste Operations and Emergency Response Standard Title 29, CFR Part 1910.120 “Hazardous Waste Operations and Emergency Reponses”, Hazardous Waste Management Instruction, Section 13, and Air Force Instruction (AFI) 32-7042, “Solid and Hazardous Waste Compliance”, Section 2, 76 MXW OI 32-7 “Hazardous Material Management Program” (In its entirety), 76 MXW OI 32-101 “Air Quality Record Keeping Procedure” (In its entirety) & 76 MXW OI 32-7004 “Hazardous Waste Management Program” (In its entirety) . The contractor shall provide the environmental and safety training certificate for all employees to the CO and COR, after contract award date.

1.14. Forms and Publications, TO, AFI and AFMCI: The contractor shall obtain the forms and publications expressly required to perform the work in this contract via internet at www.e-publishing.af.mil In the event that a form or publication is not available online, the COR will provide the form, instruction, or publication to the contractor upon written request (e-mail is acceptable) by the contractor. In the event that laws, regulations, Technical Orders (TO)s, Air Force Instructions (AFI)s or Air Force Materiel Command Instructions (AFMCI)s change during the term of this contract, the contractor is required to comply as such changes come into effect. Contractors delivering or handling official USAF records shall comply with the applicable records management regulations AFI 33-322, Air Force Manual (AFMAN) 33-363, and AFI 37-138 (in their entirety).

1.15. Housekeeping: The contractor shall keep the work areas clean and neat in accordance with Industry Standards, Occupational, Safety and Health Administration (OSHA), fire and safety standards and this PWS.

1.16. Tool Control and Accountability: The contractor or contractor’s personnel shall inventory the container or bag of tools at the beginning of each work day and at the end of each work day. Contractor personnel shall immediately notify the COR of any tools that are missing or lost from the work area or container (i.e. tool or job box or tool bag). The COR will report to appropriate government personnel of any missing contractor’s tool(s) not located within one hour after notification of lost or missing tools.

1.17. Privately Owned Motor Vehicles (POV): Contractor personnel shall comply with the directives pertaining to operation of POVs on Hanscom AFB per AFI 31-204 (in its entirety), Motor Vehicle Traffic supervision.

1.18. Visitor Pass: The contractor shall comply with requirements and procedures IAW FAR 5353.242-9000, Contractor Access to Air Force Installations. A list of names will be required to gain access to the installation Passes shall be distributed at the visitor’s center at the Vandenberg gate. Workers shall have proof of identification as well as a valid license, registration and insurance if bringing a vehicle onto base. Contractor employees must have identification readily identifies them as contractors. During the course of the contract, certain areas/sites may be restricted or closed to contractor personnel. The contractor shall comply with all requirements for entry. In addition, unscheduled gate closures may occur at any time and personnel entering or exiting the installation may experience delays

1.19. Foreign National(s): The contractor shall notify the COR before sending a Foreign National representative to perform services. Special rules apply for foreign national(s) visiting a US Government facility.

1.20. Health and Safety on Government Installation: In performing work under this contract on a Government installation, the contractor shall comply with federal, state and local regulations regarding occupational safety and health and the specific health and safety requirements established by this contract and Appendix C. The contractor shall notify the COR of any injuries that occur to contractor personnel while on the installation. The contractor shall notify the COR of damage to government property or equipment during the execution of the contract.

1.21. Emergency Procedures: Contractor employees shall follow the direction of Government employees in regards to emergency evacuation procedures, i.e. fire, tornado, active shooter and bomb threats. It is the contractors’ responsibility to account for their employees following an emergency evacuation. Contractor personnel shall participate with government personnel in all fire and tornado drills and at no additional cost to the government.

1.22. Partnering Agreement: The contracting officer may require a partnering agreement between the government and the contractor to ensure joint cooperation and a sound partnership of all parties involved in the execution of this contract. Partnering is the creation of a government-contractor relationship that promotes achievement of mutually beneficial goals. It involves an agreement in principle to share the risks involved in completing the project and to establish and promote a nurturing partnership environment. Representatives from each organization are encouraged to participate in developing the partnering agreement. Suggested representation is the civil engineer manager, the government inspector, the government contract administrator, the contractor’s manager and the contractor’s quality control person. All costs for the partnership agreement should be shared equally between the government and contractor. This group is responsible for developing a formal partnering agreement that should be signed by all parties involved. The agreement should contain as a minimum: specific goals to be reached and a list of objectives to reach the goals, a set of metrics to evaluate the objectives, a frequency for meetings to review the metrics, and a statement of cooperation to execute the terms of the agreement.

SECTION 2

Performance Assessment

The contractor shall be aware that any absence of any contract requirement from the Service Summary does not detract from its enforceability nor limit the rights or remedies of the government under any other provision of the contract. The contractor shall ensure the following service summary requirements are accomplished.

GOVERNMENT-FURNISHED PROPERTY AND SERVICES

3.1. Government Furnished Property (GFP): Government Furnished Property is not applicable to the performance of this contract.

3.2. Reserved.

3.3. Government Furnished Services: Government Furnished Services are applicable during the performance of this contract.

3.3.1. Security Police: The government will provide general on base Security Forces service. The Security Forces’ telephone number is 911 for emergencies, for crime in progress 781-225-5613 and 781-225-5613 for non-emergency calls.

3.3.2. Fire and Emergency Services: The government will provide general on-base fire protection services. The contractor shall comply with fire prevention rules and regulations enforced by the Hanscom AFB Fire Prevention Branch. Call 911 for emergencies. For routine fire prevention matters and/or calls to dispatch, call 781-225-3330.

3.3.3. Emergency Medical Service: The government will provide 24 hour on-base state certified paramedic level emergency response and patient transport services for contractor personnel who are injured or become seriously ill while on Hanscom AFB. The telephone number is 911 for emergencies.

Note: Calling 911 from a cell phone will be received by off base emergency 911 system, causing a delay in response time by emergency personnel. When possible use a base telephone to receive on base help.

3.3.4. Utilities: The government will furnish utility services. These utilities include natural gas, electricity, water and sewer for the sole purpose of accomplishing this contract. If the contractor requires additional utility services, it shall be the contractor’s responsibility to provide. Contractor shall use due care and diligence in efforts to conserve utilities to reduce utility costs.

3.3.5. Refuse Collection: The government will provide refuse collection services limited to the extent provided in the Base Refuse Collection Contract for government provided facilities. The government will only allow non-hazardous refuse to be emptied into the nearest authorized refuse dumpster for trash collection. Do not use the government dumpsters for collection of construction debris.

3.3.6. Workspace: The contractor shall note that work site is in the mechanical rooms, trenches, basements, on the roof, and crawl spaces.

4.0 APPENDICES

APPENDIX A

The following lists the building numbers, type, general building use, and approximate square footage that are part of this service contract. It is the Contractor’s responsibility to provide TAB and commissioning service for each building HVAC system and identify discrepancies, provide TAB, energy calculation and commissioning reports and recommended solutions to satisfy the scope of services as described in PWS.
