About this file

This document is a Terms and Conditions agreement for federal contract solicitation 70Z03826QB0000165, issued by the U.S. Coast Guard (USCG) under the Department of Homeland Security (DHS). The solicitation applies Service Contract Labor Standards to any purchase orders awarded, with wage determinations provided for identified performance locations; offerors may request additional wage determinations in writing by the deadline specified. Quotations must be submitted with a completed "Requirement" document containing highlighted sections, and prices must be held firm for 60 calendar days from the date specified for receipt of offers.

Technical acceptability and price are the primary evaluation criteria, with award made to the lowest-priced offeror rated technically acceptable. All offerors must demonstrate ability to meet delivery requirements, provide detailed explanations of any requirements they cannot accomplish, and submit relevant certifications including FAA 145 Repair Station Certificate, EASA, DOD, OEM, or industry standard certifications. Offerors not previously approved by USCG must provide detailed explanations of capability to repair Power Supply Assemblies, with simple capability statements deemed insufficient. The document incorporates extensive Federal Acquisition Regulation (FAR) clauses and Homeland Security Acquisition Regulation (HSAR) provisions addressing security prohibitions, covered telecommunications equipment restrictions, Sudan and Iran sanctions compliance, DEI discrimination prohibitions, sustainable products requirements, and convict labor restrictions. Inspection and acceptance occur at destination by local USCG personnel, with invoices submitted electronically to ALC-Fiscal@uscg.mil; all payments are made electronically, and invoices are not approved until all items have been receipted. Service Contract Labor Standards apply with identified wage rates for maintenance painter positions at $21.70 per hour.

In lieu of this provision, quotes will be evaluated in accordance with Federal Acquisition Regulation (FAR) 12 based on the criteria listed below. Award will be made to the lowest priced offeror rated technically acceptable.

Technical Acceptability:

Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. This will be determined by evaluating the ability of the offeror to provide a sound, compliant approach that meets all requirements listed in the Statement of Work (SOW) and demonstrates a thorough knowledge and understanding of the requirements. It is the contractor’s responsibility to ensure that their quotation clearly demonstrates their ability to perform these requirements.

All offerors must provide the following minimum information and documentation with their quotations:

Ability of the offeror to meet the Delivery requirements listed in the SOW.

Detailed explanation of any requirement listed in the SOW that cannot be successfully accomplished by the offeror.

If the offeror is an Original Equipment Manufacturer (OEM) authorized repair facility and has not previously been approved by the USCG to complete these repairs, they must provide proof with their quote (such as a letter from the OEM) stating that the offeror is approved to complete the repairs. If the offeror does not have proof, then they must provide the additional information listed below.

Offerors, other than the OEM, a proven OEM-authorized repair facility or a company that has previously been approved by the USCG to complete these repairs must also provide the following additional documentation. Failure to provide all of the documentation with the quotation may result in the quotation being eliminated from evaluation.

Detailed explanation of the offeror’s ability to repair the Power Supply Assembly. A simple statement of capabilities will not suffice. The offeror must address how they will accomplish the requirements of the SOW.

The offeror will be evaluated with the following description:

Acceptable Meets Technical Acceptability Requirements

Unacceptable Does not meet Technical Acceptability Requirements

Price:

The contractor shall provide pricing as requested in the attached spreadsheet titled “Requirements - 70Z03826QB0000165”. Any quantity price discounts and discounts for prompt payment should be included in this section. (B) Have □ have not □, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);

(D) Have □, have not □, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied. Federal taxes are considered delinquent if both of the following criteria apply:

(1) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if a pending administrative or judicial challenge remains. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(2) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) The Offeror has □ has not □, within a 3-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the Government will consider the certification in connection with a determination of the Offeror's responsibility.

Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) This provision does not require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a). The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If the Government later determines that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

(End of provision)
