SECTION B – SUPPLIES AND SERVICES

B.1. SUPPLIES OR SERVICES

B.1.1. The U.S. Department of State, Bureau of Overseas Building Operations, Project Development, Support, and Coordination, Office of Design and Engineering, Electrical Engineering Division, OBO/PDCS/DE/EE, (hereafter referred to as DE/EE), require the services of a Telecommunications Cabling Firm to test the Structured Telecommunications Cabling Systems (STCS) in U.S. Diplomatic Mission buildings located overseas. It is anticipated that testing will provide the vast majority (up to 99%) of the requirement. However, DE/EE requires the option to issue tasks for design and/or installation.

B.1.2. The Contractor shall provide overseas professional and technical services, labor and materials on a Firm Fixed-Price Task Order basis. In establishing the fixed price for individual Task Orders, the hourly rates for the required services shall be in accordance with the fixed fully burdened hourly labor rates listed below. The fixed hourly rates below include wages, overhead, G&A, profit and all employee fringe benefits, such as retirement, withholding for FICA and taxes, unemployment, workman's compensation and union dues.

B.1.3. The Contractor shall provide all expertise and services at various locations worldwide, as directed by the Contracting Officer and as specifically described in individual Task Orders.

See Section B.8.3.1. for labor categories.

B.2. CONTRACT TYPE

B.2.1. This contract is an Indefinite Delivery, Indefinite Quantity contract containing fixed hourly rates payable entirely in U.S. currency. The term of the contract is one year, with four one-year options to renew, under the same terms and conditions as the base year. No additional sums will be payable on account of any escalation in the cost of materials, equipment or labor, or because of the Contractor's failure to properly estimate or accurately predict the cost or difficulty of achieving the results required by this contract. Nor will the contract price be adjusted on account of fluctuations in currency exchange rates. Changes in the contract price or time to complete will be made only due to changes made by the Government in the work to be performed, or by delays caused by the Government.

B.2.2. Payments based on quantities and unit prices will be made only to the extent specifically provided in the contract Task Order.

B.2.3. This contract contains fixed hourly rates for labor disciplines. All remaining costs, including construction services and additional labor rates not listed and priced in this contract shall be negotiated in accordance with the Scope of Work for each individual Task Order. The actual amount of work to be performed, the time of such performance, the deliverables, and the location of the work will be determined by the Contracting Officer, who will issue formally executed Task Orders to the Contractor. The only work authorized under this contract is that which is performed after receipt of such Task Orders or after a written/verbal Notice to Proceed (NTP) from the Contracting Officer, which is followed by a formally executed Task Order. A written NTP may be transmitted by facsimile.

B.3. MINIMUM AND MAXIMUM CONTRACT QUANTITIES – INDEFINITE QUANTITIY CONTRACT

(a) In accordance with the FAR 52.216-22, “Indefinite Quantity”, the minimum for this quantity contract shall be as set forth below. If this contract contains options, the minimum for each option shall apply separately and independently to that option.

Base Year $5,000

(b) The maximum for this indefinite quantity-contract (including options) shall be any quantity or combination of supplies and services equal TBD.

B.4 CONTRACTOR PERFORMANCE

See Section F for deliveries and performance.

B.5 OTHER DIRECT COSTS

The Government anticipates other direct expenses such as travel, passports, visas, immunizations, per diem, DBA Insurance, rental vehicles (when authorized in advance by the COR), excess baggage fees, and taxi (to and from airport). These are fixed costs as direct expenses against each Task Order issued by the Contracting Officer unless other specific items are indicated. No medical examinations and medical clearances shall be required under this contract. These and other administrative support services for the contract must be included in the overhead and G&A burdens to hourly rates for the Labor Categories, as listed in Section B.8, Prices/Costs, and will not otherwise be reimbursed under any circumstances.

B.6 TRAVEL COSTS

The contractor’s invoice for travel and travel-related expenses shall be unburdened. Any management and administrative costs of the contractor are considered to be included in G&A which is included in the fully burdened rates in section B.8.

B.6.1 OVERSEAS TRAVEL

B.6.1.1 Travel costs (transportation, lodging, meals, and incidental expenses) shall be fixed prices as stipulated in the individual task orders. The Contractor shall not be reimbursed for any additional expenses such as rental cars, unless these items have been authorized in advance by the Contracting Officer’s Representative (COR) and in writing to the Contracting Officer. Invoiced travel costs must be supported by ticket stubs and/or receipts. The cost principle in FAR 31.205-46 shall apply.

B.6.2 TRANSPORTATION

B.6.2.1 Air travel shall be at the lowest customary standard fare, economy, or equivalent airfare, including excursion fares.

B.6.2.2 Personal or Contractor-owned vehicle use shall be in accordance with the Federal Travel Regulations.

B.6.2.3 Rental cars for use when traveling to and from an airport require approval in advance from the Contracting Officer Representative (COR). Written notification to the Contracting Officer will be authorized only when consistent with the needs of the Government and generally at a cost not to exceed actual cost of renting a compact automobile.

B.6.2.4 Per Diem (Lodging, meals, and incidentals): Information about Domestic and Overseas Per Diem rates and the Federal Travel Regulations can be obtained from the General Services Administration, www.GSA.gov. Specific limits on reimbursements for subsistence expenses will be established in Task Order proposal requests consistent with local conditions. Housing is to be obtained in accordance with Section H, paragraph H.16.5.

B.7. COST OF MATERIALS/EQUIPMENT/SHIPMENT/PACKAGING/CRATING

The cost of any materials or equipment and shipment/packaging/crating required in conjunction with the services rendered herein, shall be included in the firm fixed-price Task Order, unless otherwise noted in the Task Order.

B.8. PRICES/COSTS

B.8.1. The fully burdened hourly labor rates listed below have been established for this contract. These rates are the maximum rates allowable under the contract for United States based personnel performing services in the listed disciplines. During Task Order proposal submission, the Contractor may propose at a rate less than the following rates. These rates will be used for any professional construction and engineering services that may be required by the individual Task Orders, except where local labor is acceptable and available at reduced rates. Rates for local labor shall be established while conducting the survey and included in the execution proposal.

B.8.2. The Contractor and or its subcontractors shall provide these CLINS, as described in Section B.8.3.1. All other costs and level of effort will be negotiated in accordance with the Scope of Work for each individual Task Order.

B.8.3 The following Labor categories shall include all costs including Labor hours, other direct costs, G& A and profit. Quantities are estimates only. The Contractor shall be paid for actual quantities as indicated by Task Order for each CLIN.

SECTION C: PERFORMANCE WORK STATEMENT (PWS)

1.0 Introduction

The US Department of State, Bureau of Overseas Building Operations, Project Development, Support, and Coordination, Office of Design and Engineering, Electrical Engineering Division, OBO/PDCS/DE/EE, (hereafter referred to as DE/EE),require the services of a telecommunications cabling firm to test the structured telecommunications cabling systems (STCS) in US diplomatic mission buildings located overseas. It is anticipated that testing will provide the vast majority of the requirements. However, DE/EE requires the option to issue tasks for design and/or installation.

C.1.1 Storage and Safeguarding Sensitive and Classified Information: Contractor shall become familiar with the Security Classification Guide for Design and Construction of Overseas Facilities, dated July 2018 to insure proper classification and handling of documentation domestically and overseas. When the location is associated with the classified computer systems and the telephone system cable distribution and equipment’s located in the controlled access areas (CAA) of the building, the documentation becomes classified.

C.1.2 Contract Office Point of Contact: Administrative point of contact shall be the Contracting Officer (CO). Unless specified otherwise in the site-specific task order or in some other manner by the CO, the point of contact for all proposal information shall be the CO.

C.1.3 Project Office Points of Contact(s): Point of contact for Test Plans, Test Reports, Design/Installation submittals and all other technical information and coordination shall be the Contracting Officer’s Representative (COR). COR may specify in site-specific task order(s) other Telecommunications Engineering personnel as point of contact for any or all of the above. Point of contact for travel and security information and coordination shall be the Program Analyst. The names and telephone numbers of the COR, Program Analyst and Telecommunications Engineer shall be provided in the task order.

C.2.0 General

C.2.1 Scheduling: The task order start date may be changed up to three (3) times during the task order with five (5) calendar days of notice before the actual start date without cost to the Government.

C.2.1.1 Contractor must be able to mobilize within ten (10) calendar days after task order award.

C.2.2 Communications: Standard requirements for web-based communication are identified in Section E. The contractor shall document, and submit in writing, a record of all conferences and meetings that relate to the contract. Electronic copies shall be submitted to OBO within five calendar days of the meeting.

C.2.3 Document Security Manager: The contractor shall provide a Document Security Manager (DSM) with extensive knowledge of national security policies and regulations such as the National Industrial Security Program Operating Manual, as they pertain to the safeguarding, storage and transmission of U.S. classified information. The DSM shall also have experience with Department of State directives and guidelines such as the 12 FAM 500 and the Security Classification Guide for Design and Construction of Overseas Facilities. Duties include management of a library of classified project information to include access control and document receipt, supervision of document review for proper classification, marking and packaging, and coordination with the Facility Security Officer on other matters pertaining to information security.

C.2.4 Qualifications: The contractor shall provide personnel to carry out the requirements of the task with the following minimum qualifications:

C.2.4.1 Clearance: Provide personnel possessing a FINAL Top-Secret security clearance to perform work in the Post Communications Center (PCC), PBX Equipment room, Controlled access areas, and Telecommunications rooms (TR)in office buildings. Provide personnel possessing a minimum Interim Secret clearance to perform work for all other areas.

C.2.4.2 OEM Certifications: All test personnel must complete current original equipment manufacture’s (OEM) training certification on the proposed test equipment for all test personnel. The certificate must be within the last 3 years. Expired certificates are not acceptable.

C.2.4.3 Registered Communications Distribution Designer (RCDD): Provide an RCDD architect/engineer with a minimum of five (5) years, within the past seven (7) years, of relative experience developing telecommunications cabling test plans and certified test reports for copper (Category 3, 5e, 6, 6A, 7, and 8) unshielded and shielded twisted pair (UTP, STP) , coax, multimode and singlemode optical fiber cable plants.

C.2.4.3.1 For design and installation projects, the RCDD must have a minimum of five (5) years, within the past seven (7) years, of relative experience managing cable plant design and installation projects for copper (Category 3, 5e, 6, 6A, 7, and 8) UTP, STP , coaxial RG-6/11, HDMI, multimode and singlemode optical fiber cabling.

C.2.4.3.2 For design and/or installation, the RCDD may be required to conduct a survey on-site or review construction documents to develop a plan for the installation. The RCDD shall prepare design documents, test plans, test reports, and manage the test, design and installation projects. See Program Manager below for additional project management requirements.

C.2.4.4 Senior Technician: Provide a senior technician with a minimum of five (5) years, within the past seven (7) years, of relative experience, installing and testing copper UTP, STP (media rating as described above) , multimode, and singlemode optical fiber, and coaxial cable plants for voice, data, and video cable plants and have certification at the BICSI technician level. He/she shall utilize the test procedures and test equipment similar to those in this SOW. He/she shall be capable of assessing deficiencies in the telecommunications cable plant and recommend solutions for bringing the STCS up to specification. He/she shall supervise and conduct testing on site. For installation, he/she shall be the site supervisor. See additional requirements for site supervisor.

C.2.4.5 Technician: Provide a technician with a minimum of two ( 3) years within the past five (5) years of experience installing and testing voice, data, and video cable plants (and) certified as a BICSI Technician. He/she shall have relative experience installing and testing Category 3, 5e and 6, coaxial, multimode, and singlemode optical fiber cable plants. For installations, no less than half of the installer-personnel shall meet the aforementioned qualifications of technician.

C.2.4.6 Junior Technician: Provide a junior test technician with a minimum of two ( 2) year of relative experience installing and testing voice, data, and video cable plants, certification by manufacturer for cable plant, or certification as a BICSI Installer 1. Junior technicians shall have relative experience testing Category 3, 5e and 6 copper, Multimode optical fiber, and Singlemode optical fiber cable utilizing test procedures and equipment similar to those required to conducted testing in accordance with this SOW. The junior technician may accompany the senior technician on site for installation and/or testing. A junior technician must be supervised at all times.

C.2.4.7 Program Manager (Design/Installation): Provide an RCDD architect/engineer with experience as stated in this SOW. Program managers must also be experienced with project scheduling and familiar with industry standards as required by the task order documents.

C.2.4.8 Site Supervisor (Testing /Installation): Provide an individual with minimum qualifications of a senior technician as stated in this SOW. The site supervisor must be experienced in the oversight of cable plant testing/installation and test/installation personnel, capable of assessing deficiencies in the telecommunications cable plant and recommend solutions for bringing the STCS up to specification, certified and familiar with safety practices as stated in the construction documents.

C.2.4.9 CADD Technician (Design/Installation): Individual with experience using Autodesk AutoCAD Architecture 2017, or later, within the past four years. Experience using Autodesk Revit Architecture and Navisworks is also required. Must have experience in the architectural/engineering industry drafting diagrams and floor plans specifically for telecommunications cabling and equipment.

C.2.5 Performance evaluations – At the end of each task, contractor shall be evaluated for acceptable performance. Performance shall be evaluated using a Standard Performance Report and Rating Guidelines (see Attachment J-10). The government will use the Ratings Guidelines (Attachment J-10)

C.2.5.1 Repeated poor or unsatisfactory evaluations shall result in restrictions to submit proposals for task orders under this contract.

C.3.0 TESTING

C.3.1 Cabling: The majority of what follows is direct quotes or paraphrase from latest ANSI/TIA, hereafter referred to as TIA Wiring Standards. TIA Wiring Standards include but are not limited to 526-14C, Method B for Multimode optical fiber, 526-7-A, Method A.1 for Single mode optical fiber, latest editions of 568-, 569, 570, 758, 606, J-STD–607, and their addendum. This is done for expediency and to emphasize certain portions of the aforementioned standards and to establish common terms and definitions.

C.3.2 Attachments: Each task order requests for pricing will include project construction documents (drawings and specifications), along with a pricing format as attachments to the task order scope of work. Testing methods shall be in compliance with the project specific construction documents.

C.3.3 A STCS has been designed for flexibility to allow equipment to be moved and reinstalled with minimal disruption. The goal was a certified, structured, integrated, shared media system to the extent allowed by security and life safety codes. The systems accommodate present and future telecommunications needs. All cabling practices shall be in accordance with construction documents, and TIA Wiring Standards as mentioned in the introduction.

C.3.4 The cabling systems have been designed for a 15 to 20 year life cycle. The cable pathway has been designed and constructed for a minimum of 50% future expansion of the backbone cabling.

C.3.5 STCS includes, but is not limited to Category (CAT) 3, 5e and 6 copper UTP, STP, Series 6 and Series 11, .500 coaxial cables, OM1 to OM5 Multimode and Singlemode optical fiber cables. The testing contractor shall verify and test all new cabling installed for compliance with latest edition of ANSI/TIA Wiring Standards to assure the overall quality and performance of the STCS.

Marginal passing test results are considered a failed test and must be re-tested. All test results must have the plot data recorded.

C.3.6 Copper UTP/STP: Test all copper cable in accordance with latest TIA Standards. Each link shall be tested end to end. Horizontal cabling shall be tested in accordance with permanent link and modular plug terminator link criteria. Backbone cabling shall be measured and recorded for continuity, crossed and reversed pairs, open and split pairs, and shorts.

C.3.7 Fiber: Test all optical fiber cables in accordance with the TIA Wiring Standards and as specified herein. Testing for all optical fiber cable (horizontal and backbone) shall be bi-directional. Test each link end-to-end. Optical fiber shall be tested for termination, compliance to insertion loss values and acceptable db loss.

Test backbone cables at 850 nm and 1300-nm wavelength. Test horizontal cable at the 850-nm wavelength. The test procedure for fiber shall be in accordance with latest edition of TIA 526-14, Method B for multimode optical fiber and TIA 526-7, Method A.1 for singlemode optical fiber. OTDR testing may be requested for troubleshooting in accordance with awarded task orders.

Fiber testers shall use the one cord method to set the reference. Test Reference Cords (TRC) shall be used to test all fiber strands.

C.3.8 Audio Visual Testing: Audio visual systems will use a combination of cable types supporting video and sound. The TIA Wiring standards will be the basis of performance and testing for systems using copper UTP/STP and fiber. Systems supporting video may have additional testing requiring a signal generator. Testing shall measure and record performance of components according to project specific requirements that will be provided in task orders.

C.3.9 Test Equipment:

Provide all required test equipment. Test equipment must have removable memory. Cables tested with expired calibration stickers shall be re-tested with a tester that has valid and up to date calibration at no additional cost to the Govt. Contractor shall provide a usage cost to the government for the equipment.

C.3.9.1 The preferred testing equipment for premise cabling is Fluke DSX-5000/8000 Digital Cable Analyzer along with fiber test adapter. Other Level V (or newer) and fiber cable testers may be used with COR approval.

The test equipment must comply with ANSI/TIA-1152-A, Level 2G accuracy requirements. All test equipment is required to have been calibrated within 12 months prior to test start date. Provide calibration certificates from an authorized testing center/lab or with dated stickers on test equipment. Calibration certificates and stickers shall list the serial number of each piece of test equipment. The calibration expiration date shall extend through task order performance end date.

C.3.9.2 The preferred testing equipment for copper UTP/STP outside plant cabling less than 305 meters is Fluke DSX-5000/8000 (Level V tester). When using the DSX-5000/8000, place setting to T1. For lengths exceeding 305m, then other test equipment may be used with COR approval.

C.3.9.3 Testing audio visual, coaxial, and HDMI. The test equipment accuracy shall be better than the parameters to be tested. The test equipment shall have a calibration tag of a calibration date no more than 12 months prior to the test.

C.3.9.4 The preferred test equipment for video using HDMI are Teledyne Lecroy Quantum Data’s 280A Video Analyzer and 280G Video Generator. Other test equipment include, but not limited to Oscilloscope, Spectrum Analyzer, Signal level meter, Volt Ohm meter, SPL meter, SPL calibrator Sine wave and random noise generator. Alternative test equipment for video may be submitted for COR approval.

C.3.10 Power Testing – Applicable with a post with backup/standby or UPS.

C.3.10.1 Backup/Standby Power: Arrange with the OBO Project Director (on-site) a time to disconnect the site primary power and check that all active elements of the cabling system are powered from the backup/standby power.

C.3.10.2 UPS: Disconnect power to the telecommunications space where the UPS is located. Check that active equipment connected to the UPS is powered.

C.3.11 The contractor shall be prepared to work flexible hours and schedules that may include working night shifts. The typical number of workdays on site is six (6) days per week, ten (10) hours per day.

C.3.12 The contractor shall be prepared to re-terminate up to one (1) percent of the total connectors during testing. Quantity shall not exceed 1% of total gross of terminations.

C.3.13 The contractor shall be prepared to test up to 15% of additional terminations than the total listed in the provided documentation.

C.3.14 Review the attached drawings and determine the number of jacks and inside/outside riser pairs fiber optic multimode and singlemode strands to be tested. This information is to be submitted to the government as part of the test plan.

C.3.15 Test Plan: A test plan shall be prepared by an RCDD and submitted in accordance with paragraph 7 of this SOW.

C.3.16 Test Report: A test report shall be prepared by an RCDD and submitted in accordance with paragraph 7 of this SOW

C.3.17 Daily Report: Daily reports shall be prepared by and submitted by field personnel during the period of performance for testing. See Paragraph 7 of this SOW for submittal requirements.

C.4.0 Backbone Cabling

Backbone cabling provides the interconnections between the telecommunications rooms (TR), equipment rooms (ER), and entrance facilities (EF). Backbone cabling also includes cabling between buildings. Below is a list of typical backbone test requirements:

C.5.0 Horizontal Cabling

Horizontal cabling is as defined in the latest TIA Wiring standard. All cables, residing in or extending from the TR shall be tested. A typical outlet consists of a set of four (4) CAT 6 UTP cables and one pair Multimode optical fiber cable. All connecting hardware and patch cords (jumpers) shall be of the same performance category as the cable or higher.

C.5.1 Copper UTP: Most of the horizontal CAT 6 cables are terminated on the RJ45 patch panels in the TR and on the color-coded RJ45 module at the telecommunications outlet. Horizontal copper UPT cables shall be tested per TIA Permanent Link criteria, unless otherwise noted. Note: Copper UTP/STP horizontal cables are terminated using T568-A wiring scheme.

C.5.2 Optical Fiber: The horizontal optical fiber cables may be OM3 or OM4. They are terminated on SC or LC duplex connectors in the TR and at the telecommunications outlet respectively. Task orders will identify fiber cable types applicable to the site.

C.5.3 Coaxial: The horizontal coaxial cables are Series 6 (RG 6) cables. They are terminated using F connectors on each end. Termination fields may be located in the telecommunications rooms or the audio visual control rooms. Measure and record length and impedance for coaxial cables.

C.6.0 Inspection:

Inspect the overall cable plant before performing testing. Any changes and variances from the construction drawings and/or the telecommunications specifications shall be noted and details provided in daily reports and test reports as defined in paragraph 7.

Confirm correct installation practices were followed and are in accordance with construction documents. For example, inspect terminations and cross-connects to ensure installation in accordance with TIA, BICSI, and NEC.

Contractor will require access to telecommunications and equipment spaces. These spaces include but is not limited to the following:

Compound/telecommunications service entrance facility (C/TSEF), Main Terminal space (MTS), Unclassified and classified telecommunications equipment rooms Telecommunications rooms Control rooms and security closets (spaces where building management systems and security systems terminate)

C.6.1 Inspection Items:

The following items (where applicable, but is not limited to), shall be checked in each space:

C.7.0 Submittals

Vendors shall use ProjNet, and/or ProjNet C to submit electronic copy of required documentation. Typical submittals for testing include bidder responses, test plans, test reports, and daily reports.

C.7.1 Test Plan

Test plans shall be submitted with vendor’s response to the task order request for proposal (RFP). Do not deviate from the approved test plan without the written approval of the COR. Deviations include but are not limited to changes of test equipment, test personnel, test procedures, and performance requirements. Verbal permission may be given by the COR with written confirmation required within 24 hours after verbal permission. It is incumbent upon the contractor to obtain written confirmation. Test plans shall contain, but are not limited to:

C.7.2 Test Report

Provide one (1) copy of the certified acceptance test reports to the COR for approval. A complete and formal test report shall be submitted after completion of all required tests.

C.7.3 Daily Reports

Daily reports are uploaded to ProjNet during the testing period from the job site. Daily reports are due prior within one hour of the before work starts the next day. Rolling tabs/rows of data from other days are not acceptable submittal. Daily reports shall include but is not limited to:

Date and time testing started and finished Summary of areas tested Challenges/issues identified Raw test data for ALL failed test results from the previous day Areas to be tested the following day

C.8.0 DESIGN/INSTALLATION

C.8.1 Design of the STCS shall be required in accordance with OBO design criteria and requirements. Specific design criteria shall be provided on individual task orders. Contractor shall be able to provide personnel described in paragraph 2.4 as required by task order.

C.8.2 Installation of the STCS shall be required in accordance with construction documents provided to the telecommunications cabling firm by the government or installation drawings developed by the installation contractor and approved by the government. All materials as required with the construction documents shall be procured, shipped, and installed by the contractor

C.8.3 Submittals

C.8.3.1 Submittals for design and or installation task orders may include but is not limited to daily reports, bill of materials, shop drawings, construction documents (drawings and specifications), project schedules. Submittals shall be provided using CD-R or DVD-R, ProjNet, ProjNetC. Additional submittal requirements shall be included in task order scopes of work (SOW).

Contractor shall submit design drawings (where applicable), cut sheets and/or shop drawings for equipment and materials prior to procurement to COR for approval. The particular delivery method for each project will be described in the project task order, to include deliverables to be submitted via ProjNet.

Data Versions: Issued for construction (IFC) submittals include both drawings and specifications. Contractor shall provide files in the following software and data versions:

C.8.3.2 Design Drawings: Design drawings shall be in digital format. OBO archives digital contract submissions. Therefore and accurate and complete record of each submission is necessary. Requirements for formatting drawings and their files will be provided with each design task order. OBO will provide BIM standards with each design task order.

C.8.3.3 AS-Built Drawings: Contractor shall submit updated construction drawings after installation. As-built drawings shall be based upon redline drawings used during installation. Requirements for format and organization of as-built drawing files will be provided with each design task order.

C.8.3.4 Bill of Materials: Bill of materials shall include all materials the contractor intends to procure for the project. The bill of materials shall include the following information: item description/title, quantity, number of units, and cost per unit.

C.8.3.5 Project Schedule: Contractor shall include a project schedule using Microsoft Project. The Project schedule shall include a complete timeline from notice to proceed to final commissioning of the cable plant. Provide labor/work items with duration for each item to be performed. Include items by government that directly impact procurement, installation, and commissioning of the cable plant.

SECTION D – PACKAGING AND MARKING

D.1 MATERIALS SHIPPING ADDRESS

D.1.1 All unclassified data shall be prepared for shipment in accordance with best commercial practices.

D.1.2 Classified reports, data, and documentation shall be prepared for shipment in accordance with the National Industrial Security Program Operating Manual, (DOD 5220.22-M)

D.2 DEPARTMENT OF STATE MAIL AND COURIER ADDRESSES

The Contractor shall include the substance of Provisions D.2 and D.3 in all cleared subcontracts. The substance of D.3 shall be reproduced in all subcontracts.

D.2.1 Classified packages shall NOT be sent via U.S. Postal Service. Contractors and subcontractors authorized to send classified packages to the Department shall provide delivery of packages, by appropriately cleared Contractor, via approved hand-carry methods in accordance with NISPOM 5-410 and 5-411. Alternatively, GSA Schedule 48 Commercial Delivery Carriers may be used in accordance with NISPOM 5-403e. Currently, the carriers on that list include:

D.3 Packaging Requirements for Mail and Courier Shipment of Documents and Drawings

D.3.1 Separate packaging of electronic media and hardcopy material.

The prime Contractor and any associated subcontractors will package all drawings and electronic media (classified, SBU and unclassified) in separate mailing packages. Specifically, electronic media will be transported in electronic media packages that contain no other drawings or hard copies of any kind, beyond that of transfer/receipt documentation. Hardcopy (paper) drawing and documents will be packaged separately.

D.3.2 Double wrapping and addressing of packages.

For all shipping methods, the prime Contractor and any associated subcontractors will ensure that all project documentation, regardless of classification and to include SBU, is double wrapped with both layers addressed properly and labeled with the sender’s address. No indication that the contents are SBU or classified should appear on the outer wrapper. Document tracking receipts should be packaged inside the inner wrapping with the materials the receipt describes.

D.3.3 Packaging heavy materials in appropriate containers. In applying the above double wrapping and addressing procedures, items sent via US mail or commercial carrier weighing more than one (1) pound shall have the inner package enclosed within an appropriately sized double-walled box or, for rolled drawings, a manufactured mailing tube. The cardboard box or mailing tube counts as the second layer of wrap.

D.4 DOCUMENTATION OF SHIPMENTS

The Contractor shall submit the documentation required by contract clauses 52.247-63, Preference for U.S.-Flag Air Carriers (Jan 1997), and 52.247-64, Preference For Privately Owned U.S.-Flag Commercial Vessels (June 2000) as follows: one legible copy of a rated on-board ocean bill of lading for each shipment to both (i) The COR and (ii) the Division of National Cargo, Office of Market Development, Maritime Administration, U.S. Department of Transportation, Washington, DC 20590. All subcontractor bills of lading shall be submitted through the Contractor

D.5 DISPATCH AGENTS

The Government encourages the Contractor to contact the appropriate U.S. Department of State Dispatch Agent, the names and telephone numbers of whom are available from the Contracting Officer, when obtaining shipping estimates. The Dispatch Agent may be able to assist both U.S. and foreign firms in obtaining the most competitive rates for ocean or air transportation. The Government shall not be responsible for any delays in transportation resulting from use of a carrier recommended by the Dispatch Agent.

SECTION E – INSPECTION AND ACCEPTANCE

E.1. 52.246-12 INSPECTION OF CONSTRUCTION (AUG 1996)

E.2. SUBSTANTIAL COMPLETION

E.2.1. Definitions.

E.2.1.1. "Substantial Completion" means the stage in the progress of the work as determined and certified by the Contracting Officer or Contracting Officer's Representative in writing to the Contractor, on which the work or a portion thereof designated by the Government is sufficiently complete and satisfactory, in accordance with the requirements of the Contract Documents, that it may be occupied or utilized for the purpose for which it is intended, and only minor items such as touch-up, adjustments, and minor replacements or installations remain to be completed or corrected which (1) do not interfere with the intended occupancy or utilization of the work, and (2) can be completed or corrected within the time period required for final completion.

E.2.1.2. The "date of substantial completion" means the dated determined by the Contracting Officer or Contracting Officer's Representative on which substantial completion of the work has been achieved.

E.2.2. Use and Possession upon Substantial Completion The Government shall have the right to take possession of and use the work upon substantial completion thereof. Upon notice by the Contractor that the work is substantially complete and verification thereof on the basis of an inspection by the Contracting Officer (CO) or Contracting Officer's Representative (COR) and any required tests, the CO or COR shall furnish the Contractor a Certificate of Substantial Completion, accompanied by the Schedule of Defects enumerating items of work remaining to be performed, completed or corrected before final completion and acceptance. However, failure of the CO or COR to list any item of work shall not relieve the Contractor of responsibility for complying with the terms of the contract. The Government's possession or use upon substantial completion shall not be deemed as acceptance of any work under the contract.

E.3. FINAL COMPLETION AND ACCEPTANCE

E.3.1. Definitions.

E.3.1.1. "Final completion and acceptance" means the stage in the progress of the work as determined by the CO or COR and confirmed in writing to the Contractor, on which all work required under the contract has been completed in a satisfactory manner in accordance with the requirements thereof, subject to the discovery of defects after final completion, and except for items specifically excluded in the notice of final acceptance.

E.3.1.2. The "date of final completion and acceptance" means the date determined by the Contracting Officer as of which final completion of the work has been achieved, as indicated by written notice to the Contractor.

E.3.2. Final Inspection and Tests The Contractor shall give the CO or COR at least five (5) calendar days advance written notice of the date the work will be fully completed and ready for final inspection and tests. Final inspection and tests will be started not later than the date specified in the aforesaid notice unless the CO or COR determines that the work is not ready for final inspection and so informs the Contractor.

E.3.3. Final Acceptance Upon: (a) satisfactory completion of all required tests, (b) verification by the CO or COR on the basis of a final inspection that all items listed in the Schedule of Defects have been completed or corrected and that the work is finally complete, subject to the discovery of defects after final completion, and (c) submittal by the Contractor of all documents and other items required upon completion of the work, including a final request for payment, and the CO or COR is satisfied that the work under the contract is complete and the contract has been fully performed, with the exception of continuing obligations thereunder, the CO or COR shall issue to the Contractor a notice of final acceptance and make final payment as required by the contract.

E.4. SITE DATA PROVIDED BY THE GOVERNMENT

E.4.1. Contractor may rely on the accuracy of site surveys, subsurface or physical site data and similar information provided by the Government concerning the location of existing utilities or structures, to the extent of the information shown or indicated therein. However, the Government does not warrant that such information is complete, or that such surveys or data reveal all of the conditions that may be encountered on the site. Contractor shall not rely upon any interpretation or opinion provided by the Government concerning such data or information unless such data is specifically incorporated into the Solicitation Documents or the proposed Contract Documents. Issuance of such information indicated as being "for information only" or identified with words of similar effect shall not be construed as incorporation into the Solicitation Documents or the proposed Contract Documents. It is the responsibility of the Contractor to determine whether any additional site investigation is required, and to make such investigations.

E.4.2. Information Concerning Host Country Bidders shall not rely on any information provided by the Government concerning the host country, such as climatologically data at the site, local laws and customs, currency restrictions, taxes, or the availability of local labor, materials and transportation. It is the responsibility of the Contractor to determine whether any additional site investigation is required, and to make such investigations at the Contractor's expense.

E.4.3. Information Obtained by Contractor. Before submitting a proposal, the Contractor shall, at its own expense, make or obtain any additional examinations, investigations, explorations, tests and studies, and obtain any additional information which the Contractor requires.

E.4.4. Notice of Errors or Discrepancies Contractor shall promptly notify the issuing office of any apparent ambiguity, inconsistency or error in or among the Solicitation Documents, the proposed Contract Documents, site data provided by the Government, and the requirements of applicable laws, regulations or customs, which they discover as a result of their examination of such documents or upon examination of the project site and review of local conditions affecting the performance of the contract. If necessary, the Government will issue Amendments to supplement the documents or correct any ambiguity, inconsistency or error found.

E.5. QUALITY CONTROL

E.5.1. The Contractor shall institute an appropriate inspection system including checklists of duties to be carried out, ensuring these duties are carried out by the supervisory staff and senior employees, and carrying out weekly inspections to determine whether the various services are being performed according to the contract requirements. Copies of the weekly inspection reports shall be provided to the COR. The Contractor shall develop a Quality Control Plan that describes the methods/procedures/schedules for successful implementation of their inspection system at the planning office and construction site locations.

E.5.2. Any shortcomings and/or substandard conditions noted in such inspections shall be promptly corrected and improved; any conditions beyond the responsibility of the Contractor shall be brought to the attention of the Contracting Officer or COR, for disposition.

E.5.3. Monthly Report: The Contractor shall render a monthly progress report, summing up observations resulting from the inspections, progress, difficulties or irregularities encountered, resolution of problems, measures taken to improve conditions, recommendations, and other matters related to this contract.
