2.0 SCOPE OF WORK

The Work consists of furnishing all labor, plant, power, equipment, supplies, and performing all operations necessary for the completion of the project. The Contractor shall perform all operations necessary for:

Mobilization and Demobilization Survey and Construction Layout Installation and Maintenance of Erosion and Sediment (E&S) Controls Temporary Access Road Construction Quality Control Site Preparation, including Clearing and Grubbing Unclassified Excavation / Regrading / Soil Drying Traffic Control, where required Installation of a Culvert under the County Route 27 Installation of Channels Installation of Modified Wet Mine Seal Slip Repair Conveyance Pipe Installations Gate Installation Repaving and Refinishing of Existing Paved Road, if damaged during the Work Gravel Road / Laydown Rehabilitation Revegetation Final Site Cleanup and Removal of E&S Controls

Specifically, the Contractor will be installing their E&S Controls, establishing their Work area and laydown area, clearing, and grading the site as needed to provide space to Work, installing a temporary access road, and any other applicable Site Preparation.

The Contractor will excavate and repair the slip area as shown on the plans. This will include toekey benches, bonding benches, chimney drains, and replacement of soil to meet the design finish grades.

Contractor to install one (1) modified wet mine seal in accordance with the Plans to drain Mine Portal #1.

Traffic Control will be implemented by the Contractor. Contractor is limited to only obstructing one lane of the road at a time – and in compliance with the Traffic Control Section of these Specifications. The expectation is for the Contractor to limit lane closures to the greatest extent practical. The expectation is also for the Contractor to not close lanes – whenever at all practical – during typical rush hour traffic periods.

During the Work, the Contractor is to exercise caution in not disturbing structures or trees to remain.

The Contractor is to repair or reconstruct (full depth) any pavement damaged during the Work by the Contractor to a quality consistent with these Specifications and to a quality at least what was present before the Work started, at the Contractor’s expense, except as otherwise specified or approved. The expectation is that, if the pavement is damaged, that the pavement would be, at a minimum, milled down at least 2” and resurface areas as deemed necessary by the engineer – patches are unacceptable. If damage protrudes into the base or aggregate layer of the existing asphalt, then a full depth repair will be necessary. This will be determined as directed by the Engineer. If nothing is damaged during the Work, then no replacements would be necessary.

Contractor to install farm gates consistent with the Plans.

Contractor is responsible for leaving the site and surrounding area in original condition or better. This includes refurbishing the existing access road to at least as good a condition as was present before the Work started – and additional stone is provided in the estimate for making it nicer than what was present originally. This also includes picking up and disposing of any trash or litter the Work generates in accordance with these Specifications.

Contractor will IMMEDIATELY clean any mud off roadways that the State reasonably believes to be project related.

Contractor is responsible for engaging in soil disturbance only within the Limits of Disturbance shown on the Plans.

The Contractor shall also be responsible for surveying, including establishing construction baseline, measuring, and developing all completed quantities on the job, and the ordering, purchase and delivery of any and all materials required for construction or required for development of support areas. The Contractor shall perform all other operations as incidental to the program as specified herein. The Contractor is responsible to verify all surveying, measurements, estimates, or any other information provided by the State for accuracy.

Any deviation from the Plans or Specifications, not approved in writing by the State Engineer or Contract Administrator, are at Contractor risk. State reserves the right to require Contractor to correct back to Plans – at Contractor cost – any unapproved condition at any time.

The replacement of Culvert #3 is within the FEMA floodplain boundaries. The approval of this work has been granted by Marion County under Permit # 93078172023.

3.0 BORROW (DISPOSAL) AREAS

All borrow (disposal) areas must be approved by the State. The Contractor shall be responsible to obtain from the property owner(s) of the borrow areas, all necessary rights of entry, including rights of entry for the State and OSMRE for inspection purposes. The said rights of entry agreement must state that the property owner(s) indemnify and hold harmless the State for Contractor’s action for any injury or damages whatsoever resulting from the use of the property.

The Contractor also shall submit a borrow / disposal area reclamation plan for prior approval by the State. The Contractor shall observe the following NEPA compliance schedule relative to selecting and utilizing any off site borrow areas and / or any waste disposal areas:

No borrow (disposal) site operations will affect a site listed in, eligible for, or proposed to be listed in the National Register of Historic Places.

No borrow (disposal) operations will be located within one-quarter mile of any Federally listed, established, or prospective component of the National Wild and Scenic River System under 16 USC 1274 and 1276.

Borrow (disposal) site operations will not cause a significant encroachment within the base floodplain (CE.O. 11988: Floodplain Management).

Borrow (disposal) site operations will not be located in or affect a critical habitat of a Federally listed endangered or threatened species under 16 USC 1531, et. seq.

No borrow (disposal) operations will occur in wetland areas which are designated by appropriate agencies.

Borrow (disposal) site operations will be consistent with any approved plans governing ambient air quality.

Adherence to these mitigation measures does not relieve the Contractor of the obligation or responsibility to obtain any other Federal, State, or Local approvals required to use borrow (disposal) areas and conduct such activities.

Documentation: Copies of borrow (disposal) site approvals and concurrences will be submitted to the State prior to the commencement of reclamation activities.

Site Monitoring: Borrow (disposal) activities will be monitored by the State to ensure compliance with contractual requirements, applicable Federal, State, and Local laws, and any permit conditions.

4.0 DISPOSAL OF UNSUITABLE MATERIAL

All waste areas shall be obtained in accordance with these Specifications. All unsuitable materials (wood, trash, debris, and garbage), as determined by the State, shall be wasted by the Contractor outside the limits of work conforming to the requirements of these Specifications at the Contractor’s expense. Wood may be burned, if in conformity with these Specifications and any applicable Federal, State, and Local laws, and any permit conditions. Uncontaminated wood may also be chipped with the chips either buried or broadcasted across the site.

The Contractor shall observe the NEPA compliance schedule relative to selecting and utilizing any off-site disposal areas in accordance with these Specifications.

The As-Builts shall be provided in two forms of electronic format in PDF and AutoCAD 2013-2017 on either CD-ROM, DVD, or USB memory stick and one paper copy of the plans with the same size and scale as contained on the original plans.

The As-Builts shall include the following:

Show all permanent Work in place, and any deviations from original plans.

The preferred coordinate system and elevation datum by the Contractor need to be specified. The State has a preference for the US State Plane Coordinates of 1983 West Virginia North Zone – SPCS83 Zone 4701 in feet, unless otherwise specified.

Show all horizontal and vertical dimensions (including invert elevations) of all installed components (i.e., pipes, drop inlets, mine seals, drainage channels, splash pads, manholes, etc.), as well as surveyed locations of the installed structures. Any other items deemed necessary (provided in the contract) by the State shall be included in the As-Builts.

Cut-fill sections shall have the area of the section marked by the section for easier calculation, if required.

Have the lines on the plans shown in either color or line type to distinguish between the original plan lines, the contractor’s original survey lines and the final grade lines. This will apply for all cross-sections on the project, if required.

All waste and borrow areas shall be shown and labeled.

Revegetation that is paid for by acreage, shall be per plan view acreage and shall be shown on a separate AutoCAD layer. The enclosed areas shall not include any graveled surfaces, paved surfaces, roads, ponds, treatment components, all non-vegetated channels, buildings, etc. (non-vegetated areas are not to be included in the revegetation acreage calculation or AutoCAD layer).

In AutoCAD, the zero (0) layer shall not be used to draw on other than to insert blocks for future insertion on appropriate layer.

As a standard, new baseline and final contours shall be provided with 2 feet minor contours and 10 feet major contours. Major contours shall have the elevation labeled. Contour Labels shall not break the contour line (setting in AutoCAD).

Any control points shall be shown with coordinates and elevations labeled. If the State has provided control points, the Contractor shall reference elevations and coordinates to them. If no control points were set, then new points shall be set and utilized.

Any seep collectors, curtain drains, or other structures inaccessible after covering, shall be surveyed for location, prior to covering.

Show total quantities for all items on the project. The format shall be in a tabular form (i.e., Bid Schedule or Summary of Quantities).

Changes (deviations) should be on separate “Change” layer, not on the original layers from the original plan.

In the event of a conflict between the above that is more fundamental, such as what material to use or what construction methods to employ, then the order of priority would be the MM-109 (for roads only), then the WVDOT Standard Specifications for Roads and Bridges, 2023 Edition (for roads or bridges only), and then these Specifications. Outside of work on, under, or near roads and bridges, these Specifications prevail entirely. Notwithstanding the above, a conflict in one requirement does not relieve the Contractor of abiding by all other requirements in these Specifications.

For ease of reference, the WVDOT Standard Specifications for Roads and Bridges, 2023 Edition can be found at the below:

These requirements apply to both pre-cast concrete and concrete that is cast in place.

Unacceptable concrete must be replaced at the Contractor’s expense. Custom concrete mixes outside of these tolerances can be approved by the Engineer on a case-by-case basis. The State reserves the right to reject concrete based on a visual inspection without waiting on testing results.

Test sampling and compressive strength testing of grout shall be in accordance with ASTM C1019. Slump testing of grout shall be in accordance with ASTM C143. Grout must have a compressive strength of at least 2,000psi within 28 days and a slump of 8- 11 inches to be acceptable, unless otherwise specified in the Plans or these Specifications.

Unacceptable grout must be replaced at the Contractor’s expense. Custom grout mixes outside of these tolerances can be approved by the Engineer on a case-by-case basis. The State reserves the right to reject grout based on a visual inspection without waiting on testing results.

Test sampling of Controlled Low Strength Material (CLSM) – also known as flowable fill – shall be in accordance with ASTM D5971 and ASTM D4832. CLSM compressive strength testing shall be in accordance with ASTM D4832. CLSM must have a compressive strength of at least 2000 psi within 28 days. CLSM used for road crossings must have a pH of 5.0-13.0 and must meet the requirements of Section 219 of the WVDOT Standard Specifications for Roads and Bridges, 2023 Edition and the MM-109, as applicable. In the event of a conflict between these Specifications, the WVDOT Standard Specifications for Roads and Bridges, 2023 Edition, or the MM-109, then the most stringent requirement shall prevail. In the event of a conflict between the above that is more fundamental, such as what material to use or what construction methods to employ, then the order of priority would be the MM-109 (for roads only) then the WVDOT Standard Specifications for Roads and Bridges, 2023 Edition (for roads or bridges only), and then these Specifications. Outside of work on, under, or near roads and bridges, these Specifications prevail entirely. Notwithstanding the above, a conflict in one provision does not relieve the Contractor of abiding by all other requirements in these Specifications. Unacceptable CLSM must be replaced at the Contractor’s expense.

Custom CLSM mixes outside of these tolerances can be approved by the Engineer on a case-by-case basis, subject to the above MM-109 and WVDOT Standards above. The State reserves the right to reject CLSM based on a visual inspection without waiting on testing results.

At a minimum, the pipe / fill compaction tests will include moisture content and density tests of the soil in accordance with the provisions of ASTM D698 (Standard Proctor) field density tests following compaction. A new Standard Proctor will be run when soil type changes occur on site and/or at the direction of the Engineer or State representative.

Soil tests shall determine the optimal additives required for areas of soil disturbance to be fully re-vegetated (3 tons per acre preferred minimum). Normally, this includes – at a minimum – soil pH test results as well as available nutrients within the soil, including, at a minimum: nitrogen (N), phosphorus (P), potassium (K), calcium (Ca), magnesium (MG), and Sulfur (S). At a minimum, the soil testing report will recommend what soil amendments in which concentrations are ideal for regrowth. If problems with re-vegetation occur, additional, more specialized tests may be required to be performed at the Engineer’s discretion and the Contractor’s expense.

Limestone and Sandstone shall be subjected to a Sodium Sulfate test in accordance with AASHTO T104. All stone shall have a maximum weighted loss of twelve (12) percent when subjected to five (5) cycles of the Sodium Sulfate Soundness Test – ASTM C88 (ASTM C88-05 Standard Test Method for Soundness of Aggregates by Use of Sodium Sulfate or Magnesium Sulfate), as modified by the American Association of State Highway and Transportation Officials (AASHTO) T-104. All Stone shall be commercially supplied and shall be tested for calcium carbonate.

Limestone shall be tested for calcium carbonate equivalency which must be 70% or greater and be certified as such.

Sandstone shall be certified to be non-acid producing. Sandstone to be sound, non-acid producing, durable, non-calcareous sandstone from a State approved source. Shale is not acceptable. The sandstone shall consist of particles of clean, hard, tough, durable rock, free from adherent coating. The State reserves the right to reject sandstone based on a visual inspection without waiting on testing results.

Note that the WVDOT Standard Specifications for Roads and Bridges, 2023 Edition and the MM-109 (if applicable) specify quality control and testing procedures that ARE REQUIRED for any applicable asphalt replacement repaving, shoulder stone, guardrail replacement, etc. The Contractor is to ensure these are implemented, that materials and installations permanently installed meet or exceed all required tests, and the Contractor shall provide the results to the State and the WVDOH for record.

Testing shall be performed as required by these Specifications and or as ordered by the Engineer or State representative in writing. The Engineer will determine the locations and time of any testing herein specified and the need and extent of any testing in addition to that which is herein specified.

The Contractor shall be responsible for performing laboratory tests of the coal, mine spoil, and any natural soil to identify the compaction requirements for their use as fill and cover material, respectively. In addition, field density tests shall be performed in accordance with these Specifications. All test results shall be submitted to the Engineer for approval of compaction criteria prior to finalizing compacting the fill material and after fill material is placed to verify that the required compaction is obtained.

Only new and first-class materials, which conform to the requirements of these Specifications, shall be used unless specified otherwise. When requested by the State, the Contractor shall furnish a written statement of the origin, composition, and manufacturer of any or all materials (manufactured or produced) that are to be used in the work. The sources of supply of each material used shall be approved by the Engineer before delivery is started. If, at any time, sources previously approved fail to produce materials acceptable to the State, the Contractor shall furnish materials from other approved sources.

3.4 Method of Measurement and Basis of Payment

There shall be no measurement of the “Quality Control” item as it is a lump sum. The quality control work done will be paid at the contract lump sum price bid for this item.

Said lump sum bid cannot be more than 3% of the TOTAL AMOUNT BID for the project. Nothing herein shall be construed to limit or preclude partial payments on this item up to 100% of the quality control bid amount. Neither deduction nor increase will be made in the lump sum “Quality Control” item amount regardless of decreases or increases in the final total contract amount or for any other cause.

3.5 Pay Item

Item 3.0, “Quality Control”, per lump sum cannot be more than 3% of the TOTAL AMOUNT BID for the project.

4.0 SITE PREPARATION

4.1 Description

Clearing and Grubbing - Work performed under this section shall include the removal and disposal of all trees, stumps, shrubs, and any other vegetation along with wood, debris, or garbage of any nature. This includes those areas specified below, shown on the Plans, and any other areas as approved by the State via Change Order. This work shall also include the preservation from damage for all vegetation, utilities, or any other object not being specifically removed according to the Specifications and Plans.

Additionally, this work shall include stripping and stockpiling topsoil from the construction area, keeping it separated from other stockpiled soil, and using the topsoil for soil cover and revegetation at the end of the construction.

Demolition of Structures - This Work shall consist of complete demolition and removal of such buildings, mining related structures, equipment and materials, existing ruins and foundation structures and existing AML structures and systems, as are specifically designated on the Plans for removal or encountered during construction, except as is otherwise specified. Demolished concrete and cinder block structures and foundation ruins may be disposed of off-site. Note that any steel or burned (if authorized) wood remnant must still be removed from the site. All on-site garbage (as well as all other debris of any type and quantity), mining equipment, and metal structures encountered shall be removed from the site to an off-site disposal area in accordance with these Specifications to a Landfill approved by the State to accept the applicable waste type.

Certified disposal weight tickets shall be provided to the WVDEP. The Contractor is advised to perform a thorough site reconnaissance to quantify all garbage designated for removal prior to submitting a bid.

Asbestos Material Identification and Removal (if present) - This Work shall consist of a Contractor-provided Competent Person – as defined by Title 29, Subtitle B, Chapter XVII, Part 1926 of the CFR Code – performing a thorough search of all existing structures on the project to ensure that there are no asbestos materials present. If any areas are suspected of containing asbestos, then an inspection would need to occur – at the Contractor’s expense – by a company possessing a valid, current Asbestos Contractor License in the State of West Virginia. Each on-site representative of the company performing the asbestos survey or mitigation would need to be a Licensed Asbestos Contractor in the State of West Virginia. If asbestos was found, an estimate for removal and proper disposal would need to be obtained by the Contractor and submitted for the Engineer’s approval.

At that point, the Contractor would be responsible to perform all notifications as required by all Federal and State law – particularly NESHAP as outlined in Title 40, Chapter I, Subchapter C, Part 61, Subpart M of the CFR Code. No work would be allowed at the location of the asbestos until the removal process was completed. No asbestos mitigation or removal is anticipated for this Work – if the Contractor determines asbestos is present and subsequently receives a positive test for asbestos, a Change Order would be negotiated with the State for the proper mitigation to occur through the Contractor. All mitigation by the Contractor (or their Sub-Contractor) would need to be in accordance with all Federal, State, and Local laws.

Materials and Equipment Storage - The Contractor shall obtain approval from the Engineer for proposed materials and equipment storage areas prior to use. Refueling or fuel storage should not occur within 100ft of a wetland, water body, stream, or ditch leading into the same – see additional requirements for fuel storage in the “Spill Containment Area” below. Areas utilized shall be restored to an “as good as” or “better” condition than existed prior to construction or shall otherwise be reclaimed as directed or approved by the Engineer.

Temporary Access Road Construction - Temporary access roads constructed to gain access to, travel between or otherwise required for equipment/vehicular site access shall be kept to a minimum and only constructed where necessary upon approval from the WVDEP, where applicable. If the Contractor constructs such travel routes, they shall be reclaimed and revegetated according to Section 6 upon completion of the construction activities, as deemed necessary by the WVDEP. Any additional access shall require the Contractor to obtain written permission from the respective landowner. The existing access roads shall be fine graded to provide positive drainage. Ditches and road crossing shall be installed as directed by the Engineer.

Any re-grading necessary for the construction of the Access Road will be incidental to the cost of the work described herein.

Final grading, stabilization, and providing final drainage control for existing access roads shall be performed after reclamation operations for the project have been completed.

Permanent Fencing – Any fencing required to be moved and replaced due to construction activities or newly proposed as shown on the plans. Permanent fencing shall be placed at the completion of construction.

Temporary Fencing –Temporary fencing shall be utilized to remove livestock access to the project site (typically wooden posts and T-posts with wire-mesh barriers in-between keeping livestock off the Work area). It is the Contractor’s responsibility to install, maintain, and remove this fencing on an as-needed basis – or as the State indicates – to remove hazards to the public, livestock, or damage to the project site over the course of the Work. Temporary fencing will be removed by the Contractor prior to Final Inspection, unless indicated otherwise by the State.

Spill Containment Area - Spill containment measures shall be used for fuel and lubricant storage areas. All containers, barrels, buckets, cans, etc., are to be legally disposed of offsite. Used lubricants are to be disposed of according to State law to minimize pollution to the local surface and ground water supplies. Spills are the responsibility of the Contractor and need immediate clean up and maintained at no expense to the State. Fuel tanks manufactured with secondary containment are desirable; the minimum secondary containment shall be 110 percent. Contractor required to have a spill kit, including sorbent pads, at the Spill Containment Area. Spill Containment Area should be at least

100ft from any wetland, water body, stream, or ditch leading into the same. In the event of a spill, the Contractor is required to call the emergency spill line (ph. 1-800-642-3074).

Farm Gate – Farm Gate shall be installed at the location(s) shown on the Plans, and / or as directed by the State. Farm Gate is to be placed and installed such that it adequately restricts traffic through the specified area on the Plans. Farm Gate shall be placed at the completion of the Work and shall comply with the details shown in the Plans.
