If tailoring 52.212-4, which is inconsistent with customary commercial practice, we must request a waiver. Per DFARS 212.302, the head of the contracting activity is the approval authority within the DoD for waivers under FAR 12.302(c).
To the maximum extent practicable, solicitations for commercial products shall require offerors to offer the Government at least the same warranty terms, including offers of extended warranties, offered to the general public in customary commercial practice.
