DFARs clause 252.247-7026 Pages 92 and 95 Clause should be deleted in both of the "Clauses Incorporated by Reference" and evaluation sections because this preference only applies to acquisitions that include carriage by vessel for DoD cargo in the coastwise or noncontiguous trade

23‐Jan‐19 Clause will be removed from the solicitation as this does not apply to the area of the requirement. Clause 52.212‐2, Paragraph F, will also be updated accordingly.

In this clause, "covered vessel" is defined as owned, operated, or controlled by the offeror; and qualified to engage in the carriage of cargo in the coastwise or noncontiguous trade under Section 27 of the Merchant Marine Act, 1920 (46 U.S.C. 12101, 12132, and 55102), commonly referred to as “Jones Act”; 46 U.S.C.

12102, 12112, and 12119; and Section 2 of the Shipping Act, 1916 (46 U.S.C. 50501).

However, the same price preference criteria will remain in clause 52.212‐2, Paragraph F. This is mandated per DFARS PGI 247.573(b)(2)(iii)(C).
