INSTRUCTIONS TO OFFERORS
QUOTE PREPARATION AND SUBMISSION INSTRUCTIONS
1. All quotes must be received by Contract Specialist John Sproul electronically via email at john.sproul@dla.mil, by July 29, 2024 by 1:00 PM Eastern Standard Time. Facsimile and hard copy submissions of quotes will not be accepted.
Quoters are reminded of the provision set forth in FAR 52.212-1(f), Instructions to Offerors – Commercial Items - Late submissions, modifications, revisions, and withdrawals of offers, that provides that: Quoters are responsible for submitting offers, and any modifications, revisions, or withdrawals, to reach the Government office designated in the solicitation by the time specified in the solicitation.
2. Quotes shall include all required documentation as listed below. Submission of a quote that does not contain all items requested below may result in elimination from consideration for award. Instructions contained herein are to serve as a guide in preparation of quotes; however, they are not intended to be all inclusive. The instructions generally describe the type and extent of information which should be provided in the quote.
The Quoter is expected to completely examine and analyze all aspects of the technical, past performance, and price areas to be addressed, and to include information in the quote which will enable the evaluators to determine the Quoter’s understanding of the requirements in each of the above areas.
3. All contractor personnel certifications and other documents containing Personally Identifiable Information (PII) shall be marked “Personally Identifiable Information (PII) Safeguard IAW DoD Privacy Program and Privacy Act of 1974”.
4. Organization/Number of Copies/Page Limits. The Quoter shall prepare the quote as set forth in the table below. The titles and contents and number of copies required for each file are defined in this table and the Quoter shall submit the quote in the English language. Quotes shall be submitted as THREE (3) separate electronic files (E-FILES) as follows:
E-FILE TITLE PAGE LIMITATIONS
I TECHNICAL CAPABILITY None II PAST PERFORMANCE None III PRICING None
E-FILE I – Technical Capability. The quoter shall:
a. Give a description of the products and services that they will be providing.
E-FILE II – Past Performance mailto:john.sproul@dla.mil
The quoter will submit three (3) recent (within 3 years of solicitation issuance) and relevant (similar to size, scope, magnitude, and complexity) past performance references that include a point of contact, value of the contract, and summary of the effort.
In the case of a Quoter without a record of recent and relevant past performance, or for whom information on past performance is not available, or so sparse that no meaningful past performance rating can be reasonably assigned, the Quoter may not be evaluated favorably or unfavorably on past performance.
Therefore, the Quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”. Should the Government discover adverse past performance information to which the Quoter had not had a prior opportunity to respond, the Contracting Officer will conduct communications if deemed appropriate.
E-FILE III – Pricing
Quotations may be submitted in contractor format and shall include:
(1) Signed and dated quote/cover letter with the following information: Solicitation Number, Company name, address, Contractor point of contact, telephone number, e-mail address, Contractor DUNS Number, and Commercial and Government Entity (CAGE) Code.

ADDENDA TO FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)
1. The Government intends to award one (1) purchase order resulting from this solicitation to the responsive, responsible Quoter whose offer, conforming to this solicitation, will be the most advantageous to the Government, price and other factors considered, with the lowest overall price for ALL CLINs. To be considered for award, a quote must be provided for all CLINS.
Award will be made on all or none basis. Technical tradeoffs will not be made, and no additional credit will be given for exceeding acceptability. The Government intends to award without discussions; therefore, the initial offer should contain the Quoter’s best terms from a price and technical standpoint.
2. Request for Quote shall be evaluated for acceptability or unacceptability only and shall not be rated. Any Quoter who has submitted a technically acceptable quote and who has been found to have an acceptable past performance WILL THEN have the quote evaluated for lowest price.
3. This solicitation is not being conducted using FAR Part 15 procedures. The award decision process is being conducted under FAR Part 12.6 and FAR Part 13 IAW FAR Subpart 13.106-2(b)(3), the Government does not intend to conduct discussions but reserves the right to hold discussions if deemed necessary by the Contracting Officer.
The Government reserves the right to seek clarifications, i.e., "limited exchanges" between the Government and interested bidders that may allow quoters to clarify certain aspects of their quotes or to resolve minor or clerical errors.
4. If the Contracting Officer does determine it is in the Government’s best interest to conduct communications with Quoters, and a contractor is given an opportunity to correct any minor deficiencies or inconsistencies in a quote, such as obvious mathematical errors, and after correction the quote is still determined to be unacceptable, such determinations will be cause for rejection of the quote. No quoter will be given an unlimited number of opportunities for correction of a quote.
The Government reserves the right to make a final determination whether a quote is acceptable or unacceptable solely based on the information submitted and proceed without requesting additional information.
5. Non-Price factors shall be evaluated on an Acceptable/Unacceptable basis. To be considered acceptable and eligible for award, a Quoter must address separately all the factors set forth in accordance with the instructions of this solicitation.
A major item and/or gross omission which precludes meeting solicitation objectives that cannot be corrected prior to or during communications without major revision or complete resubmission of the quote will cause a quote to be found technically unacceptable.
http://www.sam.gov/
6. The following non-price factors shall be used to determine acceptability of a quote:
a. Factor 1: Technical Capability
b. Factor 2: Past Performance
FACTOR 1: TECHNICAL CAPABILITY
To be technically acceptable, the quote must:
• Provide products and services that meet or exceed all of the required specifications.
FACTOR 2: PAST PERFORMANCE
1. Evaluation of recent and relevant past performance will be a subjective assessment based on consideration of all relevant facts and circumstances. In addition to reviewing the submitted references and contacting provided POCs, the quoter will be evaluated on their past performance record and any other relevant information obtained from available sources which may include: Contractor Performance Assessment Reporting System (CPARS), Supplier Performance Rating System (SPRS), Electronic Subcontract Reporting System (eSRS), Federal Awardee Performance and Integrity Information System (FAPIIS),or other databases, as well as interviews with Program Managers/Customers, Contracting Officers, or Contracting Officer Representatives (CORs).
2. In the case of an Quoter without a record of recent and relevant past performance, or for whom information on past performance is not available, or so sparse that no meaningful past performance rating can be reasonably assigned, the Quoter may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv), Past Performance Evaluation).
FACTOR 3: PRICE
1. If a quote has been determined acceptable under each of the non-price factors listed above, the Government will then evaluate the quote for the lowest price.
2. The proposed lowest total price (the sum of the total amount for all CLINS) between offers that are determined to be technically acceptable will be the determining factor in the selection of a quote for award. Government will perform a price analysis to determine the reasonableness of proposed price in accordance with FAR 15.404-1(b). The Government will utilize a comparison of proposed prices received in response to the solicitation.
a. Award will be based on the overall lowest priced quote that meets or exceeds the acceptability standards for the non-cost factors.
b. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful Quoter within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the quoter’s specified expiration time, the Government may accept a quote (or part of an offer), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-3 Offeror Representations and Certifications-Commercial Products and Commercial Services (MAY 2024).
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov.
