About this file

This is a Justification for Other Than Full and Open Competition (J&A) document for three spot buy purchase orders awarded to BP Products North America Inc. by the Defense Logistics Agency (DLA) Energy under the Western Pacific contract vehicle (WESTPAC).

The three spot buy solicitations (SPE60226P0470, SPE60226P0471, and SPE60226P0472) were for urgent petroleum product deliveries to support Department of War operations. The awards were made on May 1, 2026, with a total estimated value of approximately $255.5 million across the three orders: SPE60226P0470 valued at $93.6 million, SPE60226P0471 at $74.3 million, and SPE60226P0472 at $87.6 million. The justification cites 10 U.S.C. §3204(a)(2) and FAR 6.103-2(b) as the authority for other than full and open competition, based on unusual and compelling urgency that precluded full competition and would have delayed acquisition to the Government's detriment. A Request for Information was issued to multiple potential offerors with aviation fuel supply capabilities, but BP Products North America (BPPNA) was determined to be the only source capable of delivering the required quantities via tanker to the Defense Fuel Supply Points within the compressed delivery window. Price reasonableness was established through comparison with BPPNA's Rocky Mountain West bid pricing and reference market benchmarks. The contracting officer determined fair and reasonable pricing based on market factors affecting petroleum products and BPPNA's requirement to prioritize product availability for DLA.
