Justification for Other Than Full and Open Competition (J&A)
This document is a Justification for Other Than Full and Open Competition submitted by the Defense Logistics Agency (DLA) Energy for three spot buy purchase orders awarded to BP Products North America Inc. (BPPNA) under solicitation numbers SPE60226P0470, SPE60226P0471, and SPE60226P0472. The acquisitions were conducted through Western Pacific (WESTPAC) and approved after award on May 1, 2026, in accordance with FAR 6.103-2(d).
The contracts involve urgent spot purchases of petroleum products (specific types redacted) for delivery to multiple Defense Fuel Supply Points (DFSPs) via tanker. The three purchase orders have total estimated values of $93.6 million (SPE60226P0470), $74.3 million (SPE60226P0471), and $87.6 million (SPE60226P0472), totaling approximately $255.5 million. DLA Energy determined that unusual and compelling urgency precluded full and open competition and advance publication of a synopsis. An RFI was issued to multiple potential offerors with aviation fuel supply capabilities; however, only BPPNA confirmed the ability to deliver the required quantities via tanker within the tight delivery window on short notice. The contracting officer determined that BPPNA's prices were fair and reasonable based on comparison with Rocky Mountain West RFQ benchmarks and market price analysis. The reference price methodology used current market escalators, with final prices calculated using a four-day average from loading completion. Award was executed on May 1, 2026, utilizing Defense Working Capital Funds.
