Justification for Other Than Full and Open Competition

This is a Justification and Approval for Other Than Full and Open Competition document for three spot buy purchase orders issued by the Defense Logistics Agency (DLA) Energy under Western Pacific (WESTPAC).

The three purchase orders—SPE60226P0470, SPE60226P0471, and SPE60226P0472—were awarded to BP Products North America Inc. (BPPNA) on May 1, 2026, for urgent petroleum product deliveries to support Department of War operations. The orders totaled approximately $255.5 million in estimated value (SPE60226P0470: $93.6 million; SPE60226P0471: $74.3 million; SPE60226P0472: $87.6 million). The contracting authority cited 10 U.S.C. §3204(a)(2) and FAR 6.103-2(b), invoking unusual and compelling urgency that precluded full and open competition and would have resulted in serious injury to the Government if delayed. DLA Energy issued a Request for Information to multiple potential aviation fuel suppliers; however, BPPNA was determined to be the only responsible source capable of meeting the requirement through tanker delivery capability and meeting the tight delivery window on short notice. Fair and reasonable pricing was established through comparison with Rocky Mountain/West market benchmarks, and prices were negotiated based on current market factors including reference price escalators and four-day average calculations from loading completion. The acquisition was approved and publicized post-award in accordance with FAR 6.103-2(d).
