About this file

This document is a Justification for Other Than Full and Open Competition (J&A) for the Defense Logistics Agency (DLA) Energy. The document seeks to extend a contract with Crowley Government Services Inc. for Contractor-Owned Contractor-Operated (COCO) fuel storage services at Defense Fuel Support Point (DFSP) Darwin, Australia. The extension includes a six-month base period (September 13, 2025 - March 12, 2026) with a six-month option (March 13, 2026 - September 12, 2026), and includes one additional five-year option period from September 13, 2026 to September 12, 2031.

The total contract value will increase from $179,550,001.60 to $241,152,990.40, with the six-month extension funded by FY 2025 Defense-Wide Working Capital Funds at $30,801,494.40. Crowley will continue to provide fuel management services, including receiving, storing, accounting for, and issuing DLA Energy-owned petroleum products. The J&A notes that a Sources Sought Notice was posted, and five potential sources were contacted, but none submitted capability statements demonstrating they could perform the required services, thus justifying the sole-source extension to the current contract.

Justification for Other than Full and Open Competition

1. Summary/Introduction:

The Defense Logistics Agency (DLA) Energy is the contracting activity for petroleum products and services for the Department of Defense (DoD). This Justification & Approval (J&A) is for the addition of a six-month extension to the base period of performance (September 13, 2025 - March 12, 2026) and with a six-month option (March 13, 2026 September 12, 2026. The contract has one five-year option period (September 13, 2026 - September 12, 2031). This modification will require Crowley Government Services Inc. (Crowley) to continue providing Contractor-Owned Contractor-Operated (COCO) fuel services at Defense Fuel Support Point (DFSP) Darwin, Australia as only one responsible source will satisfy the agency requirements under the authority of the Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii). The value of the action being approved, to include options, is $61,602,988.80. This modification to contract SPE603-21-C-5019 will increase the contracts value from $179,550,001.60 to $241,152,990.40.

The six-month extension to the base period will be funded with FY 2025 Defense-Wide Working Capital Funds (DWWCF) in the amount of $30,801,494.40. The remaining options will be funded upon exercise of the option period.

Crowley will provide COCO fuel storage services using best commercial standards. Crowley operates, maintains, manages, and provides bulk fuel services while receiving, storing, accounting for, and issuing of DLA Energy-owned petroleum products. The mission at DFSP Darwin is supported by the fuel management services provided by Crowley. The current contract expires on September 12, 2025.

2. Nature and/or description of the action being approved (FAR 6.303-2(b)(2)):

Services under contract SPE603-21-C-5019 will be extended for a one-year period (one six-month extension with one six-month option) via a bilateral modification. The total contract period, after exercising all available options, will not exceed the maximum 30 years as authorized under 10 U.S.C. §2922, as amended.

This is a performance-based requirement. Successful performance will be measured by compliance with the Performance Work Statement. The contractor is responsible for management, operation, maintenance, product quality surveillance, inventory control and accounting, security, safety, and environmental protection of the COCO fuel facilities at DFSP Darwin. To prevent potential service disruptions, cost overruns, and possible contract termination, this contract requires an one six-month extension and a six-month option to contract SPE603-21-C-5019. Without this action, the Government is at significant risk of experiencing delays, incurring additional costs, and potentially facing the termination of this critical contract.

This extension is crucial for Crowley to support mission requirements and avoid adverse impacts to Government operations.
