Answers to Questions
Where applicable, each question references the appropriate Bid Solicitation section.

Bid Solicitation
Section Reference Question (Bolded) and Answer
1
3.2 Arbitrators and Medical Director
We assume based upon previous solicitations, such as Addendum from the Division of Purchase and Property, dated June 29, 2009, in connection with RFP# 09-x-20626, that independent contractor/consultant arbitrators or medical directors would not be considered "Subcontractors" under the Bid Solicitation. Is this assumption correct?
If the Arbitrators or the Medical Directors are employees of the Vendor {Contractor} then they are not considered “Subcontractors”. However, if the Vendor {Contractor} engages a Subcontractor to provide these services, the Vendor {Bidder} must submit a Subcontractor Utilization Form. Please refer to the following Bid Solicitation Section for additional information:
· Section 2.3 Blanket P.O. Specific Definitions/Acronyms; and
· Section 4.4.1.3 Subcontractor Utilization Plan.
Additional information may also be found in Section 5.8 of the State’s Standard Terms and Conditions.

3.4.4: Arbitration Fees
How would the vendor determine the below statement? What criteria? "if the Arbitrator determines that payment made by the Carrier was not made in good faith, then the Carrier shall be responsible for the entire review fee and the entire Arbitration fee"
The Vendor {Contractor} should use its expertise in health care pricing to identify carrier payments that are so low as to constitute bad faith.
3
3.6.2 Cooperation with the Vendor {Contractor}
What would be an example of non-cooperative or noncompliant Party? "Bill a non-cooperative or noncompliant Party for its share of the review and arbitration fees."
An example of a non-cooperative or noncompliant party would be a party that does not respond to the Vendor’s {Contractor’s} request for information or documentation or that refuses to provide a copy of its filing to the other party or that otherwise fails to cooperate or comply with arbitration requirements.
4
3.6.2 Cooperation with the Vendor {Contractor}
What would be an example of unfair and abusive practices by initiating party? "Multiple instances of unfair and abusive practices by initiating parties may serve as a basis for restricting or denying access to the Arbitration process."
An example of unfair or abusive practice would be the submission of false information, altered documentation, etc.
5
3.7.4.a: Arbitration Decision Processing
What are the Vendor’s responsibilities with the following: "interest shall not accrue until 20 calendar days after the Arbitrator’s decision, but shall never exceed 150 calendar days from the date the Provider submitted the claim"
The responsibility of computing the interest lies with Carrier, not the Vendor {Contractor}.
6
3.8.1.1 Requirements and Qualifications
Must the Medical Director be in active practice?
No, the Medical Director is not required to be in active practice.
7
3.8.1.1 Requirements and Qualifications
How many continuing education hours are required each year?
The continuing education requirements are based on the professional license of the Arbitrator.
8
4.4.3.1 MANAGEMENT OVERVIEW
1) 4.4.3.1 MANAGEMENT OVERVIEW speaks of level of effort necessary to successfully complete this contract. In order to accurately respond to the request, can the Division provide the monthly breakdown of how many Commercial/Opt-In arbitrations and No Opt-In arbitrations were filed since the inception of the arbitration program required under the ONET Act, and what is the current pending number of Commercial/Opt-In arbitrations and No Opt-In arbitrations?
2) Is it expected that case filings will remain in this range during the term of the new contract?
1) During the period of January 1, to August 5, 2019, a total of 1,884 requests for C. 32 arbitration have been filed. However, none of the requests have been from persons covered by self-funded plans that did not opt in.
2) The State cannot predict how many arbitration requests will be submitted in the future. The State shall not be bound by any minimum or maximum number of arbitration requests.

Telephone support is not specified in the RFP, does this mean telephone support is undesired or simply not a requirement?
The Vendor {Contractor} is not expected to operate a call center; however, a means to allow parties to the arbitration a way of contacting the Vendor {Contractor} should be provided. Please refer to Section 3.2 of the revised Bid Solicitation entitled “T3107 Revised Bid Solicitation 091819”.
