About this file

This document is a Bid Amendment for Bid Solicitation #22DPP00767 T1715 Canteen Commissary for the Department of Corrections through Distribution and Support Services, issued by the New Jersey Department of the Treasury Division of Purchase and Property. The bid solicitation has been amended to revise the Quote Submission Due Date to December 21, 2022, provide answers to vendor questions, and release revised bid documents and pricing sheets. The solicitation is for providing canteen commissary products to the New Jersey Department of Corrections across multiple jurisdictions, including Mercer County. Vendors may be required to submit product samples for evaluation, and the Department reserves the right to redact any products deemed unsuitable for a correctional setting.

The bid solicitation includes individual price lines as well as grouped price lines that must be bid on in their entirety. Pricing must be provided in accordance with the specified unit of measure, and any products that do not meet the technical and packaging specifications will be deemed non-responsive. The State will evaluate bids based on the lowest total cost per group and individual price lines, but will not provide a detailed point system or disclose favorable and unfavorable evaluation factors. Historical sales data is available for the current contract, but the structure of the solicitation has been revised, so detailed usage and discount information is limited.

Bid Solicitation

Section Reference Question (Bolded) and Answer

Where applicable, each question references the appropriate Bid Solicitation section.

1
3.20
How will the Department determine if the quality of a product meets the standards of the Department for items sold so that vendors are not offering low quality products? Will there be a quality check by the Department? Will there be taste tests?

Answer: Bidders may be required to submit product samples following a request by the Department of Corrections (DOC).

Per Bid Solicitation Section 3.20, Samples and Testing, “The Bidder must, within five (5) business days following a request from the State, submit samples. The samples submitted must meet the specification requirements set forth in the Bid Solicitation and must be representative of the product bid. Quote samples for evaluation and testing purposes are to be made available at no charge and delivered to name of agency at the Bidder’s expense. Samples will not be returned. The State may conduct laboratory tests to assure that the samples submitted conform to this Bid Solicitation. The State reserves the right to perform any tests necessary to assure that the samples conform to this Bid Solicitation. If the sample(s) of the brand/model/product offered by the Bidder in its Quote fails, the State shall reject the Quote for the affected line item(s). The testing results of the State are final.”

Additionally, as per Bid Solicitation Section 4.0, the DOC “will review all products to determine if awarded products are suitable for use in a correctional setting and/or facility. Any awarded products found to be unsuitable for use in a correctional setting and/or facility will be redacted. All redactions are at the discretion of the State.”

2
4.13
The bid is asking for vendor to submit a catalog with the bid. Is the Department going to increase their item offerings for this bid as they currently have a limit?

Answer: The Department of Corrections (DOC) may choose to offer additional products available through a Contractor’s price list or catalog. The purpose of the Price List/Catalog submission is to allow the DOC to purchase additional items that are not previously identified as price lines (Group 1: Price Lines 1 through 6 8; Group 1A: Price Lines 1A through 6A; Group 1B: Price Lines 1B through 6B; Group 2: Price Lines 9 through 66 102), and individual price lines (Price Lines 67 through 138). The selection of items offered on a Bidders price list or catalog is at the discretion of DOC.

Bid Solicitation Section 4.13 states, “A Contractor must only provide the products approved by the DOC for commissary sale. The DOC will review all price lists to determine if awarded products are suitable for use in a correctional setting and/or facility. Any awarded products found to be unsuitable for use in a correctional setting and/or facility or previously awarded in Price Lines 1 through 5 (Group 1), Price Lines 1A through 5A (Group 1A) Price Lines 1B through 5B (Group 1B), Price Lines 9 through 65 (Group 2) and Price Lines 67 through 138 in Price Lines 1 through-7 and Price Lines 9 through 65-101 will be redacted.”

1.1, 3.26, 4.1
There are items bid that have been discontinued by the manufacturers. When will those items be removed from the product listing? Bid line 11 Chick O Stick Ounce Size was discontinued and replaced with the updated item months ago. Bid line 95 was discontinued three years ago. Bid Line 40 Octopus in Olive Oil was replaced years ago with Octopus in Soybean Oil. Is the Departments asking for a new item than they currently sell?

Answer: Please be advised that Price Line 95, “Cup of Noodles “Maruchan” Vegetable, Low Sodium, minimum 12/2 to 3 oz. Cups per Case- No Substitutes” and Price Line 113, “Chick-O-Stick, minimum 200 count/0.5 to 1 oz. Sticks per Case- No Substitutes” have been removed from the Bid Solicitation and Price Sheet.

Price Line 51, “Sharp Cheddar Cheese Spread, Non-refrigerated, Generic Brand, minimum 24 count/3 to 4 oz. Plastic Tubes per case” has also been removed from the Bid Solicitation and Price Sheet.

The item description for Price Line 40, “Pouched Cooked Octopus In Olive Oil, Generic Brand, minimum 24 count /3 to 4 oz. Pouches per case” has been revised to “Pouched Cooked Octopus In Olive Oil or Vegetable Oil, Generic Brand, minimum 24 count /3 to 4 oz. Pouches per case.”

Please see attachments entitled “T1715 Revised Bid Solicitation 12.6.22.” and “T1715 Revised Price Sheet 12.6.22.”

8.9.2
The bid is requesting an ounce size breakdown when inputting the pricing, which will determine award. How will the DOC determine award if the ounce size bid by a vendor is larger than the Department will allow for security reasons?

Answer: All products bid must meet all specifications of the Bid Solicitation Section 4.1. If a product does not meet these technical and/or packaging specifications, the product will be deemed non-responsive and not eligible for award for that particular price line or group.

If the bid is requesting a 12 ounce and a vendor bids a 32 ounce and has a lower price per ounce but does not meet the bid specs, will that vendor be disqualified?

Answer: Yes. All products bid must meet all specifications of the Bid Solicitation Section 4.1. If a product does not meet these technical and/or packaging specifications, the product will be deemed non-responsive and not eligible for award for that particular price line or group.

5
N/A
Is there a variance difference that will be applied for all items on ounce sizes?

Answer: No. All products bid must meet all specifications of the Bid Solicitation Section 4.1. If a product does not meet these technical and/or packaging specifications, the product will be deemed non-responsive and not eligible for award for that particular price line or group.

6

In the past bids the Department had a variance requirement, will that be applied to this bid?

Answer: No. All products bid must meet all specifications of the Bid Solicitation Section 4.1. If a product does not meet these technical and/or packaging specifications, the product will be deemed non-responsive and not eligible for award for that particular price line or group.

14
3.26, State-Supplied Price Sheet
In reference to “T1715 Revised Price Sheet 10.20.22”: Cell E4 has a header that states it is for “Unit Price (Required)”. Is this section requesting the unit price per “each” selling unit or the unit price per ounce?

Answer: Unit price shall be provided in accordance with the Unit of Measure indicated for the specific price line on the State Supplied Price Sheet.

As per Bid Solicitation Section 3.26, Step 4, “The Bidder shall insert a firm, fixed price in U.S. currency in the “Unit Price” field on the Price Sheet Price Lines 1 through 5, Price Lines 1A through 5A, Price Lines 1B through 5B, Price Lines 9 through 65 and/or Price Lines 67 through 138. The “Unit Price” must be the price per the Unit of Measure as indicated on the State Supplied Price Sheet and must be submitted Freight On Board (F.O.B) Destination. If a Bidder leaves a “Unit Price” blank, it shall mean that the Bidder is not offering a Quote for that line item.”

Please refer to the Unit of Measure column, as some are different for various price lines. For example, the Bidder shall enter the price per Case for Price Lines that list “Case” as the Unit of Measure. The Bidder shall enter the price per Ounce for Price Lines that list “Ounce” as the Unit of Measure and the Bidder shall enter the price per Package for Price Lines that list “Package” as the Unit of Measure.

Please see revised Bid Solicitation entitled “T1715 Revised Bid Solicitation 12.6.22.”

15
1.1, 3.26
Are the Group 2, price lines 9-65 individual price line awards where Bidders may bid on all, some, or none of the items within this section? Or are all price lines in Group 2 required to be bid on all items?

Answer: As per Bid Solicitation Sections 1.1 and 3.26, Group 2 is designated as an “all or none” group, meaning the Bidder must bid on all lines within the group in order to be considered for award of that specific group. If a Bidder fails to bid on all lines within the group, their Quote shall be considered non-responsive for that group. If a brand/product bid on a price line within the group is deemed non-responsive, the entire group that price line item is part of will be deemed non-responsive, as these price lines were grouped to create a single award, with the intent that all price lines in the group will be awarded.

Additionally Bid Solicitation Section 3.26 states, in pertinent part: “Bidders must bid on all price lines contained within the group (Group 1, Group 1A, Group 1B and/or Group 2) in order to be considered a responsive Bidder for the group. If a Bidder does not bid on all price lines within the group, its Quote shall be considered non-responsive for the group.”

16
1.1, 3.26; 4.1; 8.9.2
To clarify the bid, both section 3.26.9, page 26 and section 3.26.4, page 27, state: “Bidders must bid on all price lines contained within the group (Group 1, Group 1A, Group 1B and/or Group 2) in order to be considered a responsive Bidder for the group. If a Bidder does not bid on all price lines within the group, its Quote shall be considered non-responsive for the group.”

This contradicts section 1.1 which states: “Price Lines 67 through 138 are individual price line awards and Bidders may bid on all, some, or none of the items within this section.”

The bid is unclear on if Group 2 consists of price lines 9-65 and 67-138, or if items 67-138 are a separate group of individual items altogether. Will price lines 67-138 in Group 2 be awarded by individual price line awards or awarded by all in Group 2 or some or none of the items within the section?

Answer: As indicated in the tables included in Bid Solicitation Sections 1.1, 3.26 and 4.1, Group 2 consists of Price Lines 9 through 66. Group 2 is designated as an “all or none” group, meaning the Bidder must bid on all lines within the group in order to be considered for award of that specific group.

Additionally, as indicated in the tables included in Bid Solicitation Sections 1.1, 3.26 and 4.1, Price Lines 67-138 are identified as “Individual Price Lines” and are not in a group. As such, a Bidder is not required to bid on all individual Price Lines in order to be considered for award.

Furthermore, as stated in Bid Solicitation Section 3.26, “The Bid Solicitation and State Price Sheet contains three sections two (2) Groups (Group 1: Price Lines 1 through 6; Group 1A: Price Lines 1A through 6A; Group 1B: Price Lines 1B through 6B; 8; Group 2: Price Lines 9 through 66) and individual price lines 67 through 138.”

17
1.1; 3.26; 4.1; 8.9.2
To clarify the bid, section 8.9.2, page 44, states: “For evaluation purposes, Bidders Quotes will be ranked from lowest to highest according to the sum of the Quote prices for Group 1 (Price Lines 1 through 5), the sum of the Quote prices for Group 1A (Price Lines 1A through 5A), the sum of the Quote prices for Group 1B (Price Lines 1B through 5B), and the sum of the Quote prices for Group 2 (Price Lines 9 through 65) located on the State Price Sheet accompanying this Bid Solicitation. The sum of each Group will exclude the percentage discount or markup Price Lines (Price Lines 6, 6A, 6B and 66.”

The bid is unclear on if Group 2 consists of price lines 9-65 and 67-138, or if items 67-138 is a separate group of individual items altogether. Are price lines 9-65 evaluated separately from price lines 67-138 and catalog discount line 66? Or, as the section states, will the price lines be evaluated according to the sum of all groups?

Furthermore, as stated in Bid Solicitation Section 3.26, “The Bid Solicitation and State Price Sheet contains three sections two (2) Groups (Group 1: Price Lines1 through 6; Group 1A: Price Lines 1A through 6A; Group 1B: Price Lines 1B through 6B; 8; Group 2: Price Lines 9 through 66) and individual price lines 67 through 138.”

As per Bid Solicitation Section 8.9.2, which states in pertinent part: “Quotes will be ranked from lowest to highest according to the sum of the Quote prices for Group 1 (Price Lines 1 through 5, the sum of the Quote prices for Group 1A (Price Lines 1A through 5A), the sum of the Quote prices for Group 1B (Price Lines 1B through 5B), and the sum of the Quote prices for Group 2 (Price Lines 9 through 65) located on the State Price Sheet accompanying this Bid Solicitation. The sum of each Group will exclude the percentage discount or markup Price Lines (Price Lines 6, 6A, 6B and 66).” and “ For evaluation purposes, Bidders Quotes will be ranked from lowest to highest for the individual price line items (Price Lines 67 through 138) according to the Quote prices located on the State Price Sheet accompanying this Bid Solicitation.”

18
8.16
Can a vendor be awarded all items in lines 9-65 and lines 67-138?

Answer: Yes. As per Bid Solicitation Section 8.16, the State intends to make one award for Group 2 (sum of Price Lines 9 through 65) and one award for each individual price line (Price Lines 67 through 138).The same Bidder may receive more than one award.

19
8.9.2
Will award be based solely on the lowest cost per item or lowest cost per case?

Answer: As per Bid Solicitation Section 8.9.2, which states in pertinent part: “For evaluation purposes, Bidders Quotes will be ranked from lowest to highest according to the sum of the Quote prices for Group 1 (Price Lines 1 through 5), the sum of the Quote prices for Group 1A (Price Lines 1A through 5A), the sum of the Quote prices for Group 1B (Price Lines 1B through 5B), and the sum of the Quote prices for Group 2 (Price Lines 9 through 65 located on the State Price Sheet accompanying this Bid Solicitation. The sum of each Group will exclude the percentage discount or markup Price Lines (Price Lines 6, 6A, 6B and 66).” and “For evaluation purposes, Bidders Quotes will be ranked from lowest to highest for the individual price line items (Price Lines 67 through 138) according to the Quote prices located on the State Price Sheet accompanying this Bid Solicitation.”

It is important to note that Quote prices shall be provided in accordance with the Unit of Measure indicated for the specific price line on the State Supplied Price Sheet.

20
N/A
How will the State evaluate award of the items? Will the evaluation be based on a point system or lowest cost?

Answer: Please refer to the answer to Question #19.

21
N/A
If the State is using a point system to evaluate bids, what are favorable evaluation points and what are unfavorable evaluation points for things such as delivery date, cost, package size, etc.?

Answer: Please refer to the answer to Question #19.
