Bid Solicitation Section 3.13.8.1 - Small Business and/or Disabled Veterans’ Business Subcontracting Set-Aside Contract
We are interested in submitting a proposal for the Independent Health Care Appeals Program: Independent Utilization Review Organization, DOBI (Bid Solicitation No. 26DPP01227). However, we would appreciate clarification on the procurement's small-business set-aside requirements (see screenshot below). It is unclear from the Notice and the Solicitation whether this opportunity is designated as a small business set-aside procurement, in which case large businesses would not be eligible to submit a bid, or whether the small business set-aside provisions apply only to subcontractors that the bidder intends to use in the performance of the work. Specifically, can a large business submit a proposal as the prime contractor and perform the work without subcontractors, or is eligibility limited to qualified small businesses as subcontractors? Thank you for your guidance. We appreciate your clarification and look forward to your response.

A business can submit a proposal as the prime Contractor and perform the work without subcontractors.

This Revised Bid Solicitation is a Small Business and/or Disabled Veterans’ Business Subcontracting Set-Aside Contract as stated in Revised Bid Solicitation Sections 1.1, Purpose, and Intent and Background, and Section 3.13.8.1, Small Business and/or Disabled Veterans’ Business Subcontracting Set-Aside Contract.

Pursuant to Revised Bid Solicitation Section 3.13.8.1, Small Business and/or Disabled Veterans’ Business Subcontracting Set-Aside Contract, if a Bidder intends to utilize a Subcontractor, it must make a good faith effort to utilize a Small Business (SBE) and/or Disabled Veterans’ Business (DVOB) Subcontractor where possible.

If the Bidder finds no Small Business and/or Disabled Veterans’ Business Subcontractors that are interested, qualified, or capable of handling the work after conducting its good faith effort search, then it may select a non-Small Business and/or non-Disabled Veterans’ Business Subcontractor.

In accordance with Revised Bid Solicitation Section 9.2, Definitions, Subcontractor is defined as: “An entity having an arrangement with a Contractor, whereby the Contractor uses the products and/or services of that entity to fulfill some of its obligations under its State Contract, while retaining full responsibility for the performance of all Contractor's obligations under the Contract, including payment to the Subcontractor. The Subcontractor has no legal relationship with the State, only with the Contractor.

Please reference Revised Bid Solicitation Section 3.13.8, Subcontractor Utilization Plan, and Revised Bid Solicitation Section 3.13.8.1, Small Business and/or Disabled Veteran's Business Subcontracting Set-Aside Contract, for additional information.
