About this file
This document is a Bid Amendment (Addendum #02) for a New Jersey state contract solicitation (RFP #17DPP00046) issued by the New Jersey Department of the Treasury, Division of Purchase and Property. The bid is specifically for the T0106 Law Enforcement Firearms Equipment and Supplies contract, involving multiple vendors, manufacturers, and distributors of law enforcement and public safety equipment. The document represents a formal modification to the original bid solicitation, providing clarifications, answers to vendor questions, and procedural guidance for potential bidders.
The contract covers multiple equipment categories including law enforcement firearms, non-lethal weapons, body armor, vehicle siren and light systems, search and rescue equipment, and personal protective equipment. The state intends to make multiple awards, with up to one primary and one secondary award for categories 1-11, and up to five awards for categories 12-16. The initial contract term is four years with potential extensions, and vendors are required to submit comprehensive documentation including manufacturer catalogs, price lists, and various state-mandated forms. Pricing is expected to remain firm for the initial term, with limited provisions for potential price adjustments under exceptional circumstances. The solicitation allows manufacturers to bid directly and name authorized distributors to handle orders, and includes provisions for equivalent brand offerings and specific requirements for insurance, warranties, and product specifications.

NJ State Standard Terms and Conditions, Section 4 Indemnification and Insurance
On pages 62-63 of the bid packet you have the insurance requirements described. It states the successful vendor will be required to meet these insurance requirements. These requirements would force us to add the State as an additionally insured if we are one of the successful bidders. It would cover our employees from injury during the fulfillment of this contract while on State property. My question is why do all of the insurance requirements listed, apply to this particular bidding opportunity, if the only items we are bidding on would be drop shipped directly from the manufacturer? Our employees would never have to be on State property. All of the products we would be offering, would be delivered via mail courier (UPS, FedEx, etc.) so none of our employees or company vehicles would need to be covered by an insurance policy that lists the State as an additionally insured. We understand why these requirements are in place for construction contracts when employees must come on to State property to perform work but since we would be offering the State goods and not services, it is not necessary for our employees to enter State property. We are asking for these insurance requirements to be stricken from the Terms and Conditions because by enforcing these requirements, the State will end up spending more money than is necessary.
The State will not alter the requirements listed in Section 4 of the State’s Standard Terms and Conditions.

4.4.5.2 Price Sheet Attachment Instructions
We currently hold a contract that is A81347 under T0106 and we are trying to fill out the paperwork for the new bid, but we do not see a spot to input the information in the document Price Sheet T0106 17DPP00046 02_06_17-2. Can someone let us know how to proceed?
Please review Section 4.4.5.2 for price sheet instructions.
Please be sure to click the “Enable Editing” button at the top of the Price Sheet before inserting information. For technical issues, please contact NJSTART Vendor Support at telephone number (609) 341-3500, email address njstart@treas.nj.gov.

4.4.3.2 Manufacturer’s Catalog and Price List
Does the vendor have to submit a catalog & price list for each manufacturer they bid on?
Yes. Please refer to Section 4.4.3.2 of the Bid Solicitation {RFP}.
If so how is this done?
Please refer to Section 1.3.3 of the Bid Solicitation {RFP}. Vendors {Bidders} should reference the “Attaching Files” section of the Vendor Quick Reference Guide located on the NJSTART Vendor Support Page for instructions on how to upload attachments/price lists. A Vendor {Bidder} can provide a hard copy Quote {Proposal}. Please refer to Section 4.3.2 of the Bid Solicitation {RFP}. If the Vendor {Bidder} is submitting its Quote {Proposal} electronically, the maximum file size shall not exceed 1 gigabyte. If the Vendor {Bidder} attempts to upload a large pdf file, for example, a catalog with pricing, it may be necessary to break the pdf file into smaller files to permit the document(s) to be uploaded.

3.1.8 Category 8 CBRNE Detection, Mitigation & Personal Protective Equipment, Parts & Accessories
Will this bid include protective clothing for homeland and or police such as NFPA 1951 type technical rescue (flame resistant and blood borne pathogen protective)garments or NFPA 1999 type blood borne pathogen protective garments?
Please review Section 3.1.8 for personal protective suit requirements.

1.1 Purpose and Intent
If the manufacturer is bidding the line item direct along with bidding the installation line direct, must the dealer also submit an installation bid if the Manufacturer is listing them as an approved vendor?
No. In the event a manufacturer bids on a brand price line with a related hourly rate price line, the dealer will not be required to submit a separate quote for the installation line. The dealer will provide service at the firm fixed hourly rate for the initial term of Blanket P.O. {Contract} and all extensions thereafter.
For price line items where the manufacturer is bidding directly, the manufacturer can provide with its Quote {Proposal} a list of Dealer(s)/Distributor(s) on company letterhead to service its Blanket P.O. {Contract}. Please refer to Bid Solicitation {RFP} Sections 1.1 (fourth paragraph, first bullet), 4.4.5.2 (first paragraph) and 4.4.3.4 for additions, deletions, clarifications and modifications.
6
43
5.2.1 Price Adjustment
It is impossible for pricing to be held for (4) years unchanged as per your terms for the initial contract period. We are requesting that a price increase/decrease be available at the end of each (1) year period of the initial contract and each of the possible extension years.
Please see revised Bid Solicitation {RFP} Section 5.2.1 for additions, deletions, clarifications and modifications.
7
5
1.1 Purpose and Intent
3 responsive quotes for an equal brand is needed for a line to be considered for an award. Most manufactures have a single designated distributor for certain products in certain states which would make it about impossible for this. Would a manufacture letter stating that the particular distributor is the sole source / authorized distributor for the product in the state of New Jersey be acceptable?
The State will waive the three (3) responsive Quote {Proposal} criteria only if the Vendor {Bidder} can supply a letter from the manufacturer which states that the Vendor {Bidder} is the sole source distributor of the brand. See Bid Solicitation {RFP} Section 4.4.5.2.3 and Section 6.6.1.
8
40
4.4.5.2.3 Price Sheet Attachment Instructions
Can you please provide a detailed step-by-step procedure on how a manufacturer would bid directly on an equivalent brand line item, that would then provide a list of the dealer/distributors to service the Blanket Purchase Order?
Please refer to Section 4.4.5.2 of the Bid Solicitation {RFP} for Price Sheet Instructions.
Yes, the manufacturer can provide with its Quote {Proposal} a list of Dealer(s)/Distributor(s) on company letterhead to service the Blanket P.O. {Contract}. The Vendor {Bidder} is required to submit the following forms for each Dealer/Distributor:
1. New Jersey Business Registration (N.J.S.A. 52:32-44);
2. Ownership Disclosure (N.J.S.A. 52:25-24.2);
3. Disclosure of Investment Activities in Iran (N.J.S.A. 52:32-55 et seq.);
4. Executed MacBride Principles (N.J.S.A. 52:34-12.2);
5. Completed Contractor Certification and Disclosure of Political Contributions (N.J.S.A. 19:44A-20:13 et. seq.);
6. Disclosure of Investigations and Actions Involving Bidder Form;
7. Vendor Certification (P.L. 2005, c.271);
8. Proof of insurance as specified herein;
9. Proof of compliance with New Jersey Affirmative Action requirements (N.J.A.C. 17:27-1.1 et. seq.):
a. New Jersey Form AA-302 Affirmative Action Employee Information Report; or
b. New Jersey Affirmative Action Certificate; or
c. Federal Affirmative Action Approval Letter.
If a Vendor {Bidder} does not provide the required Dealer/Distributor forms, the State reserves the right to request such information from the Vendor {Bidder}.
Please refer Bid Solicitation {RFP} Section 1.1 and 4.4.3.4 for additions, deletions, clarifications and modifications.

5
1.1 Purpose and Intent
The state intends to make one primary and one secondary award for categories 1 thru 11 and up to 5 awards for categories 12 thru 16. Please explain the reasoning behind this decision.
This format allows State agencies and cooperative purchasing participants a variety of procurement options that will allow Agencies to choose the most cost-efficient Vendor {Contractor} that best meets their needs and delivery requirements.

1.1 Purpose and Intent
Under the current contract we (the manufacturer) hold the contract with assigned authorized distributors who handle the orders, etc. We have found this method to be very beneficial to the State of New Jersey, as well as all of its departments, municipalities, etc. located within. We would like to bid the new contract in the same manner. Is this acceptable?
Yes, the manufacturer can provide with its Quote {Proposal} a list of Dealer(s)/Distributor(s) on company letterhead to service the Blanket P.O. {Contract}.
The Vendor {Bidder} is required to submit the following forms for each Dealer/Distributor:
1. New Jersey Business Registration (N.J.S.A. 52:32-44);

c. Federal Affirmative Action Approval Letter.
If a Vendor {Bidder} does not provide the required Dealer/Distributor forms, the State reserves the right to request such information from the Vendor {Bidder}.

1.4.8 Joint Venture, 4.4.1.3 Subcontractor Utilization Plan, 5.2.1 Price Adjustment, 5.2.2 Product Addition & 5.5 Vendor {Contractor} Responsibilities.
1. Does this allow a manufacturers distributor to participate in the Blanket Order PO, whereas the authorized distributor can accept, ship and collect payment for orders?
2. With this being a Joint Venture, would the Distributor not be considered a subcontractor?
3. Does this section also allow the bidding manufacturer to discuss the pricing with our distributors prior to the bid opening, without being subject to the Non-Collusion clause on page 21 section 4.4.1.1.3?
4. Page 36 Section 4.4.3.2 Manufacturers Catalog and Price List We are continuously adding new and innovative products to our offering. Can we submit new price lists twice a year?
1. Yes. If the manufacturer bids directly, all orders and payments can be made directly to the manufacturer and/or its Dealer(s)/Distributor(s). Please refer to Bid Solicitation {RFP} section 4.4.3.4 for Dealer(s)/Distributor(s) instructions.
2. In Joint Ventures all parties of the joint venture are considered Blanket P.O. {Contract} holders. Please review Section 5.5 Vendor {Contractor} responsibilities in conjunction with Section 4.4.1.3 Subcontractor Utilization Plan.
3. The manufacturer and Dealer/Distributor may discuss pricing only in instances where the manufacturer is bidding the brand price line directly or if the Dealer/Distributor is bidding the brand price line directly. If the Manufacturer and Dealer/Distributor are both bidding the same brand price line then the non-collusion clause will apply.

If the manufacturer bids directly on a specific brand price line (not the equivalent brand line), the State will make one (1) Statewide award for the brand offered for that category.
The manufacturer can provide with its Quote {Proposal} a list of Dealer(s)/Distributor(s) on company letterhead to service the Blanket P.O. {Contract}. Please check Bid Solicitation {RFP} Section 1.1 and 4.4.3.4 for additions, deletions, clarifications and modifications.

3.0 Commodity Description/Scope of Work
Numerous product lines utilized routinely on previous versions on this contract were omitted. What were the factors used to determine products "critical to their day-to-day operation" as stated in Section 1.1 Purpose and Intent.
The brands referenced in the Bid Solicitation {RFP} were identified and selected by State Agencies as brands that specifically meet their daily operational needs. A Vendor {Bidder} may offer brands not specifically referenced in the Bid Solicitation {RFP} on the equivalent brand line at the end of each category on the Price Sheet. Please refer to Section 4.4.5.2.3 of the Bid Solicitation {RFP}.
18
27
3.8.3 Substitution of Discontinued Products
The statement that "replacement product shall be offered to the State at the same price as the discontinued product" may need to be reviewed. Replacement items may not have the same costs as the discontinued item.
Please see revised Bid Solicitation {RFP} Section 3.8.3 for additions, deletions, clarifications and modifications.
19
17
3.0 Commodity Description/Scope of Work
Addendum to Question #17 - product lines omitted fall under the scope of this bid solicitation.
Brands not listed in Bid Solicitation {RFP} Section 3.0 can be bid on the equivalent brand price line.
20
43
5.2.1 Price Adjustment
Bid Solicitation states "the Blanket PO price shall remain firm for the initial term and any extensions of the Blanket PO. In an exception situation the state may consider a price adjustment." The initial term of the contract is a 4 year period. Manufacturer's pricing is routinely adjusted on a yearly basis which is not an "exceptional situation." With proper documentation and contractual procedures followed, the state needs to accept justified price increases on a yearly basis.
Please see revised Bid Solicitation {RFP} Section 5.2.1 for additions, deletions, clarifications and modifications.
21
43
5.2.1 Price Adjustment
Considering the possibility that a vendor may be awarded more than one brand, are requests for a pricing adjustment on all awarded brands to be submitted at the same time or will adjustments to pricing be accepted during a rolling twelve month period for each contracted brand?
Please see revised Bid Solicitation {RFP} Section 5.2.1 for additions, deletions, clarifications and modifications.

3.1.12 Vehicle Siren Systems & Vehicle Light Systems and Associated Accessories
SoundOff Signal was left out of 3.1.12 Category 12. Many NJ agencies currently utilize SoundOff products on the current NJ state contract. Could we have an addendum to the bid to add us to this category?
A Vendor {Bidder} may offer brands not specifically referenced in the Bid Solicitation {RFP} on the equivalent brand line at the end of each category on the Price Sheet. Please refer to Section 4.4.5.2.3 of the Bid Solicitation {RFP}.

SoundOff Signal was left out of 3.1.12 Category 12. Many NJ agencies currently utilize SoundOff products on the current NJ state contract. Could we have an addendum to the bid to add us to this category?
Please see the answer to question #22.
24
41
4.4.5.4 Delivery Time and Cost
The delivery section states that all deliveries have to be made 30 days ARO. Due to market trends and situations that are beyond the control of a distributor of a product, delivery times of ammunition can range from 1 day to 365 days, so we are requesting delivery time be changed from 30 days to within a reasonable time period based on current market conditions.
Please refer to Section 3.6, which states, in part, “Deliveries for all items shall be made within the delivery timeframe noted on the Price Sheet and in strict accordance with the instructions from the Using Agency.” This supersedes the language in Section 4.4.5.4, unless a Vendor {Bidder} leaves the delivery days ARO field blank on the Price Sheet, in which case, the delivery days will default to the delivery days in Section 4.4.5.4 - 30 days ARO. Please refer to Bid Solicitation {RFP} Section 4.4.5.2, Step 7.

57
NJ State Standard Terms and Conditions
We were unable to find the Force Majeure Clause in this contract. We are requesting this be added, as well as a clear definition of the State of NJ's designation of Force Majeure.
The State’s Standard Terms and Conditions will not be altered to include this requirement.
26
30
4.4 Quote {Proposal} Content
Do we just fill out that line & provide our price list in a PDF (excel) format as we are going to send in hard copies with disks & thumb drives? I was not understanding the wording, saying that we must use each line item. In the past, we submitted our price lists & did not have to enter each line item on the price list supplied by the state of NJ. Can we just fill out the price sheet NJ supplied in that one line that we have & name our price list?
The Vendor {Bidder} shall supply pricing information on the State supplied Excel price sheet for the brands bid. As stated in Section 4.4.5.3, “If the Vendor {Bidder} is not submitting a price for an item on a price line, the Vendor {Bidder} must indicate “No Bid” on the State-supplied price sheet/schedule(s) attachment accompanying this Bid Solicitation {RFP}. If the Vendor {Bidder} leaves a price line blank, this shall mean that it was the Vendor’s {Bidder’s} intent to not submit a price for that price line.”
As a separate function, in NJSTART under the “ITEMS” tab the Vendor {Bidder} must enter a Unit Cost of $1.00 so that NJSTART processes the Quote {Proposal}. Please refer to Bid Solicitation {RFP} Section 4.4.5.1.
27
5
Purpose and Intent
Manufacturers bidding directly are directed to supply a list of dealers/distributors that will service the Blanket PO as part of the Subcontractor Utilization Plan. Since the RFP has no set-aside requirements, what information is required for proposed dealers/distributors on Form PB-SA-3? Are certifications identified in 4.4.3.3 required for all proposed dealers at time of bid?
Yes, the manufacturer can provide with its Quote {Proposal} a list of Dealer(s)/Distributor(s) on company letterhead to service the Blanket P.O. {Contract}.
The Vendor {Bidder} is required to submit the following forms for each Dealer/Distributor:
1. New Jersey Business Registration (N.J.S.A. 52:32-44);
2. Ownership Disclosure (N.J.S.A. 52:25-24.2);
3. Disclosure of Investment Activities in Iran (N.J.S.A. 52:32-55 et seq.);
4. Executed MacBride Principles (N.J.S.A. 52:34-12.2);
5. Completed Contractor Certification and Disclosure of Political Contributions (N.J.S.A. 19:44A-20:13 et. seq.);
6. Disclosure of Investigations and Actions Involving Bidder Form;
7. Vendor Certification (P.L. 2005, c.271);
8. Proof of insurance as specified herein;

3.1.8 Category 8 – Chemical, Biological, Radiological, Nuclear and Explosives (CBRNE) Detection, Mitigation & Personal Protective Equipment, Parts & Accessories
Pg. 19-20 Is the PPE identified in the title of Category 8 limited to CBRNE respirators (APR escape respirators and SCBA escape respirators)? Is any other PPE required other than APR and SCBA escape respirators? If so, in what other category can this requirement be found?

29
20
3.1.8 Category 8 – Chemical, Biological, Radiological, Nuclear and Explosives (CBRNE) Detection, Mitigation & Personal Protective Equipment, Parts & Accessories
Pg. 19-20 Due to the breadth of the MSA product line, we have several discount structures representing substantially disparate product categories and need multiple line items on the pricing sheet. How should various discounts be offered on the pricing sheet for various product lines being offered?
As stated in Section 4.4.5.2, Step 2, “A series or a range of discounts or fixed prices (firm dollar amount) on any price line (other than for the specific installation lines under Category(ies) 12A, 13A, 14A, 15A and/or 16A) shall not be acceptable, and shall result in rejection of the Quote {Proposal} for that price line.”
30
20
3.1.9 Category 9 – Search & Rescue Equipment
Pg. 20-21 Are thermal imaging cameras to be included in Category 9? If a manufacturer bidding directly with dealers to service the blanket PO wishes to offer thermal imaging cameras, should this be included in line 118-Equivalent Brand Line on price sheet for Category 9? If not, how?
Category 9 includes all types of thermal imaging equipment, including cameras. Please review Section 4.4.5.2.3 for equivalent brand price line instructions.
31
29
4.3.2 Hard Copy Submission
Submittal instructions include one (1) complete Quote comprising all volumes? Where in the RFP is the content of all volumes identified? Is the second complete and exact ELECTRONIC copy to include everything included in the first complete paper copy quote EXCEPT the price sheet and manufacturers price list? Is the third complete and exact ELECTRONIC copy to be the price sheet and manufacturers price list only?
Please see revised Bid Solicitation {RFP} Section 4.3.2 for additions, deletions, clarifications and modifications.
32
30

4.4.5.2.3 Equivalent Brand Price Line
4.4.5.2.3 Equivalent Brands states that for an equivalent brand offering to be accepted three or more vendor bids have to be received. It is a common practice by many manufacturers to have only one vendor authorized to deal with government agencies in a given state. This has been many manufacturers? policy for previous contracts and the practice is known to the state. In cases of only one authorized vendor there is no way to meet the three quote requirement without violating other provisions of the bid terms. Recommended remedy ? modify the three quote requirement so that it requires EITHER three quotes OR proof by the single vendor making the Equivalent Brand offer that it is the only vendor authorized by the manufacturer to represent that brand to NJ governments.
Please see the answer to question #7.
73
41
4.4.5.4 Delivery Time and Cost
4.4.5.4 Delivery states that all deliveries shall be 30 days ARO unless stated otherwise on the pricing page but precedence of terms states that the T&C takes precedence over the pricing pages. With all extensions this contract could be in force for up to seven years. Over the prior seven years there have been two times when for periods of more than a year demand for some of the brands on this contract was so high and the supply of component materials so uncertain that delivery time could not be predicted. It is unreasonable to expect vendors to meet specific delivery commitments when availability is affected by circumstances beyond the vendor's control. Recommended remedy ? modify the wording of 4.4.5.4 to include wording that a vendor will not be considered in default if deliveries are delayed by conditions of Force Majeure or by other circumstances beyond the vendor's reasonable ability to control.
The Vendor {Bidder} has the opportunity to specify the delivery schedule for each brand on the price sheet. Please refer to Bid Solicitation {RFP} Section 4.4.5.2, Step 7.
74
43
5.2.1 Price Adjustment
5.2.1 Price adjustments will be considered by the state in certain exceptional circumstances. Over what may be as much as a seven year contract price increases a not an exceptional circumstance but a normal occurrence. Among other factors it is the stated goal of the Federal Reserve to achieve at least 2% annual inflation. Knowing that they can only expect price increases under exceptional circumstances manufacturers, in order to protect themselves, will be inclined to project what prices will be in seven years and may insist on getting those prices at the start of the contract. Recommended remedy ? rather than making price adjustments an exceptional circumstance allow routine consideration of provable price changes on every annual anniversary after adoption of this contract.
