Specified Federal procurement payment means any payment made pursuant to a contract with a foreign contracting party that is for goods, manufactured or produced, or services provided in a foreign country that is not a party to an international procurement agreement with the United States. Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the IRS.

(f) If the Offeror selects "is" in paragraph (d)(1) and "partial or no exemption" in paragraph (d)(2) of this provision, the Offeror will be subject to withholding in accordance with the clause at FAR 52.229-12, Tax on Certain Foreign Procurements, in any resulting contract.

(g) A taxpayer may, for a fee, seek advice from the IRS as to the proper tax treatment of a transaction. This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. For questions relating to the interpretation of the IRS regulations go to https:// www.irs.gov/help/tax-law-questions.

(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(4) Vendors may withdraw their offers by written notice to the Government received at any time before award.

Therefore, the Vendor's initial offer should contain the Vendor's best terms. However, the Government reserves the right to conduct discussions, if necessary. Past Performance is not an evaluation factor for this acquisition in accordance with (IAW) RFO 15.104(b)(3) (i).

The North American Industry Classification System (NAICS) code for this requirement is 334516 - Analytical Laboratory Instrument Manufacturing Industry. The Small Business Administration (SBA) size standard for this NAICS code is 1,000Employees.

Evaluation Factors for Award

EVALUATION FACTORS FOR AWARD:

52.212-2 Evaluation--Commercial Products and Commercial Services (FEB 2026) (DEVIATION 2026- O0038)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

1. TECHNICAL CAPABILITY

2. PRICE

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDENDUM TO FAR52.212-2:

This will be a LPTA procurement. The Government intends to evaluate quotations and award a contract without discussions with Vendors. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable quotation with the lowest evaluated price.

An overall Technical rating must be at least "ACCEPTABLE" in order to be eligible for award. An "UNACCEPTABLE" rating for any factor, results in the technical quotation being rated "UNACCEPTABLE" unless corrected through discussions. An overall technical rating of "UNACCEPTABLE" makes a quotation ineligible for award.

A Vendor is expected to submit sufficient information in response to the RFQ to allow for the evaluation of their quotation.

Each of the evaluation factors will be rated as follows:

Factor 1 - Technical Capability.

The Government will evaluate the Vendor's capabilities to provide the brand name only Hamilton NGS STAR Automated Liquid Handling Workstation as required per Attachment 1.

Table #1 - Technical Capability: Acceptable/Unacceptable Ratings

Rating

Description

Acceptable

Proposal clearly meets the requirements of the RFQ.

Unacceptable Proposal does not clearly meet the requirements of the RFQ.

Factor 2 - Price:

CLIN0001 shall be priced as per Attachment #1.

The Vendor's Price Quotation will be evaluated to determine whether the price is complete, fair and reasonable. The Government's determination that the proposed price is fair and reasonable will be based on price evaluation and analysis using the techniques in RFO 15.404-1, Price Analysis, which provides that comparison of the proposed prices will usually satisfy the requirement for price analysis.

The Vendor will be evaluated for fairness, reasonableness and completeness. The Government will not consider tradeoffs between cost or price and non-cost or non-price factors. The highest technically rated quotation will be selected for award if it offers a fair and reasonable price.

Certified cost or pricing data are not required in accordance with RFO 15.403-2(a).

Fair and Reasonableness - The offeror's Price will be evaluated to determine the degree to which the proposed prices compare to the prices a reasonable prudent person would expect to incur for the same or similar equipment.

Completeness- The offeror's Price Quotation will be examined to ensure that the requirements stated in the Instructions to Vendors for price quotations have been completed and that the equipment being proposed conforms to the Brand Name request.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the quotation's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are discussions after its receipt, unless a written notice of withdrawal is received before award.
