Interested firms must submit capability statements by April 6, 2026, limited to two pages and including: business name, address, and UEI; business size and socioeconomic status; bonding capacity (single and aggregate); relevant experience within the last five years; and point of contact information. Submissions should be emailed to Cathy Boulware, the Contracting Officer, at cathy_boulware@ios.doi.gov. The tentative acquisition schedule includes solicitation issuance on or before April 6, 2026; a pre-proposal site visit on April 9, 2026; questions due April 17, 2026; and proposal/bid due date of April 27, 2026. The Government is actively conducting market research to assess small business capability and potential for set-asides under 8(a), HUBZone, WOSB, SDVOSB, or total small business programs, with small businesses strongly encouraged to respond. Plans and specifications will be provided electronically with the formal solicitation.

I. DISCLAIMER

This is a combined Pre-Solicitation/Sources Sought Notification (SSN) notice issued in accordance with FAR 10 & FAR 36 to conduct market research. This Notice is issued solely for information and planning purposes – it does not constitute an Invitation for Bid (IFB) or Request for Proposal (RFP) or a promise to issue an RFB/RFP in the future.

The Government will not pay any costs incurred in the preparation of information for responding to this market survey or the Government’s use of the information. Any information submitted by respondents to this Notice is strictly voluntary. All submissions become Government property and will not be returned. This request for information does not commit the Government to contract for any supply or service whatsoever.

The Office of Surface Mining Reclamation and Enforcement (OSMRE) is not, at the time, seeking proposals or quotes and will not accept unsolicited proposals or quotes. No drawings, specifications, or solicitation documents are available at this time. Not responding to this Notice does not preclude participation in any future procurements.

II. PURPOSE

The OSMRE is seeking a construction vendor to complete the Synar AML Reclamation. The purpose of this Notice is to identify potential vendors capable of providing AML Reclamation construction services that can accomplish the full reclamation of an emergency AML site in Rogers County, OK.

This action is critical for the protection of public health, safety, and property from extreme danger of adverse effects of coal mining practices, including when an emergency exists constituting a danger to the public health, safety, or general welfare. If not awarded, the residents of Oklahoma are at risk of imminent harm. Pursuant to the Supreme Court decision in McGirt v. Oklahoma, OSMRE is charged with enforcing SMCRA on Tribal lands within Oklahoma.

In support of this effort, OSMRE is conducting market research to further refine requirements and establish the best acquisition approach. Please note that requirements defined to date may change before issuance of a final IFB/RFP.

III. REQUIREMENTS

The site is approximately 89 acres of spoils on site to grade and shape the site to conform to the adjac topography maintaining the current overall flow of stormwater. The project will include eliminating th dangerous highwall and the hazardous water body.

IV. TENTATIVE SCHEDULE

V. SMALL BUSINESS PARTICIPATION

Market research is being conducted to determine the following:

• Capability of small business concerns in accordance with FAR 19

• Potential for set-aside (8(a), HUBZone, WOSB, SDVOSB, or total small business)

Interested small businesses are strongly encouraged to respond.

VI. REQUIRED RESPONSES
