Questions with Responses #2

The following questions have been received by the Embassy’s contracting officer as of May 26, 2015.

The formal written responses are given below.

Question 1: Can the Embassy award the contract to a company that is based outside of Yemen and be paid from that country while working with a joint venture located within Yemen, or does the contract need to be issued with a local insurance company in Yemen?

Answer: Yes, the Embassy can award the contract to a company based outside of Yemen. The country of issuance of the contract and the country from which payments are made is considered, for this contract, to be the United States. Please refer to Section H.6, Miscellaneous Contractor Requirements, on page 27, and Section L.4.3.2.2, Licensing Information, on pages 62‐63. Also, please refer to section

H.9 which discusses the requirement for onsite provision of service, and Section H.9.1 which discusses the offsite provision of service during times of suspended operations.

Question 2: When does the current coverage end and the new coverage start?

Answer: The current coverage is scheduled to end on August 12, 2015; however the Government can extend this at its convenience to ensure continuity of coverage for its staff. The new contract is expected to start on August 13, 2015.

Question 3: Can we provide local Yemeni workers compensation insurance instead of DBA insurance coverage?

Answer: No, Federal law does not allow for substitution of DBA insurance for other types of coverage.
