RFO 52.212-1, Instructions to Offerors—Commercial Products and Commercial Services (JULY
2026)
As prescribed in 12.205(a)(1), insert a clause substantially as follows:
(a) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. As a minimum, offers shall include—
(1) The solicitation number;
(2) The name, address, telephone number of the Offeror;
(3) The Offeror’s Unique Entity Identifier (UEI) and, if applicable, Electronic Funds Transfer (EFT) indicator;
(4) Information necessary to evaluate the factors contained in the provision at 52.212-2 or as described in the solicitation;
(5) Responses to provisions that require Offeror completion of information, representations, and certifications (other than those collected via the System for Award Management (SAM)); and
(6) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and any solicitation amendments.
(b) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(c) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers and any modifications or revisions to the
Government office designated in the solicitation by the time specified in the solicitation.
(2) Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.
(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, and waive informalities and minor irregularities in offers received. The government may reject any offer which does not comply with the instructions of the solicitation.
(e) Debriefings. If a postaward debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:
(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.
(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed
Offeror and past performance information on the debriefed Offeror.
(3) The overall ranking of all Offerors when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award.
(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.
(6) Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.
(f)All questions shall be submitted to the Contracting Officer by 1 October, 15:00 CST.
(End of provision)
RFO 52.212-2, Evaluation-Commercial Products and Commercial Services (JULY 2026)
As prescribed in 12.205(a)(2), insert a provision substantially as follows:
1. Basis of Award. This will be a firm fixed price contract. The award will be made based on the
Lowest Price Technically Acceptable (LPTA) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the two (2) evaluation factors: Technical
Acceptability/Approach and Price. To receive consideration for award, a rating of no less than
“Acceptable” must be achieved for the Technical Acceptability/Approach factor. The Price factor will be evaluated to establish reasonableness of the otherwise successful offeror’s price, but will not receive an evaluation rating. Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation.
The following evaluation factors will be set forth in the solicitation:
Factor 1: Technical Acceptability/Approach
Factor 2: Price
All proposals shall be subject to evaluation by the Source Selection Team. The overarching evaluation approach for all factors is as follows:
a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFQ. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFQ.
b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques. The proposal will be evaluated to determine the extent to which the offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.
3. Factor 1: Technical Acceptability/Approach
1. The Technical Approach factor evaluates the offeror’s technical approach and schedule in terms of adequacy of response and feasibility of approach to meeting the PWS requirements and meeting the government’s required timeline. This factor is met when the offeror submits, as part of its technical proposal, specific narrative details and/or description of its Technical Approach & Schedule
(to include supplements) with actual methods, processes, and procedures that demonstrate the offeror’s compliance and understanding of the minimum solicitation requirements. See Instructions to
Offerors RFO 52.212-1 on page 3. Any proposed approach, method, or process determined unacceptable may render the entire technical proposal as unacceptable.
2. The offeror affirms submission of a current and fully approved Food & Water Risk
Assessment (FWRA) as required by the solicitation. The FWRA reflects the most up‑to‑date evaluation of all food and water sources, handling procedures, and associated risks relevant to the anticipated contract performance. The offeror acknowledges that FWRA validity is not limited to the time of proposal submission; the FWRA must remain current for the entire period of performance.
3. To ensure continued compliance, the offeror maintains an internal review and update process that regularly reassesses food and water risks, incorporates new regulatory guidance, and adjusts for changes in sourcing, distribution, environmental conditions, or mission requirements. This ongoing monitoring ensures the FWRA remains aligned with applicable DoD, federal, and local safety standards. Any significant change in operational conditions triggers an immediate update to keep the
FWRA current and fully compliant.
4. This factor will be evaluated on an Acceptable/Unacceptable basis for compliance with the
PWS and an existing valid FWRA.
4. Factor 2: Price
1. The vendor with a technically acceptable approach and the lowest price will be awarded the contract. The total evaluated price will be the sum of all Contract Line Item Numbers (CLINs). Offerors shall provide an additional pricing document (spreadsheet preferred) that includes detailed CLIN pricing, as well as pricing for any requirements such as mobilization or other CLINs not clearly delineated in the solicitation’s structure. The Government may determine that an offer is unacceptable if pricing is significantly unbalanced.
2. The Government intends to award this requirement without discussions; however, the
Government reserves the right to conduct discussions if the Contracting Officer later determines it is necessary.
3. DBA will not be assessed in Price evaluation

DBA is essentially a form of workman’s compensation to ensure all workers are covered in case of an accident during performance of a service contract and is mandatory for all service contracts. DBA Insurance is treated as a Not-to-Exceed Line Item (CLIN), not a Fixed Price CLIN, and the associated costs are fully reimbursable at contract payment.
