The Standards of Conduct Declaration requires contractors to certify under penalty of perjury that they are not legislators or employees, nor have controlling interests in businesses where legislators or employees hold controlling interests. Contractors must also declare that they have not been represented or assisted by current or former agency employees within specified timeframes in connection with this contract matter, and that no legislators or employees will be compensated for assistance in obtaining or performing the contract if they were involved in the contract's development or award. The contract is voidable by the State if entered into in violation of Hawaii Revised Statutes Chapter 84 (Code of Ethics), and any fees, compensation, gifts, or profits obtained through Code of Ethics violations are subject to recovery by the State. Contractors with a controlling interest must have contracts exceeding $10,000 awarded through competitive sealed bidding or proposal processes, or the agency must post a notice of intent to award and file notice with the State Ethics Commission.
