About this file
This is a Standards of Conduct Declaration form (Form AG-010) issued by the State of Hawaii for use in connection with a contract opportunity for the procurement of X-Ray Security Equipment and a Magnetometer for the Wahiawa District Court. The contractor must furnish, deliver, and install new Check Point X-Ray security equipment within ninety (90) calendar days from the notice to proceed. The procurement includes one conveyorized X-ray screening machine with monitor and controls, AI-Object Recognition Software, two passive roller conveyors for entrance and exit, four screening bins, two 8-inch screening bowls, one ADA-compliant walkthrough magnetometer (32.3 inches wide), and associated installation and operator training. The vendor must provide local service and maintenance throughout the contract duration, including a one-year service and maintenance agreement and one-year manufacturer warranty on parts, with additional training and warranty options available.
The declaration form requires the contractor to certify compliance with Hawaii's Code of Ethics (Chapter 84, HRS) regarding conflicts of interest, including representations that the contractor is not a legislator or employee with a controlling interest in the business, has not been personally represented or assisted by recently separated agency employees, and has not engaged legislators or employees for compensation related to contract development or award. The form notes that any contract awarded in violation of these provisions is voidable by the State, and any fees, compensation, gifts, or profits received as a result of a Code of Ethics violation may be recovered. For contracts exceeding $10,000 involving goods, services, or construction where the contractor is a legislator or employee, the contract must be awarded through competitive sealed bidding or competitive sealed proposal procedures under Hawaii Revised Statutes sections 103D-302 or 103D-303.
