About this file

This is a Project Manual for glazing improvements to the St. Joseph County Building in South Bend, Indiana, prepared by the St. Joseph County Board of Commissioners as owner and DLZ Indiana, LLC as the architect/engineer. The project involves removal and disposal of existing single-pane storm glazing, tapes, and stops; replacement of damaged exterior curtainwall glazing with wet sealing; removal of interior rubber/vinyl perimeter gasketing and wet sealing of former gasket locations; repair or replacement of damaged jamb stops; and application of glazing film to interior curtainwall glazing panels. An alternative bid requests reinstallation of existing storm glazing panels with new double-sided glazing tape and replacement of damaged or incorrectly sized panels. The non-mandatory pre-bid conference is scheduled for September 3, 2026, at 10:00 AM at St. Joseph County Board of Commissioners offices. Sealed bids are due by September 15, 2026, at 11:00 AM, with public bid opening on September 8, 2026, at 11:00 AM during the St. Joseph County Board of Commissioners meeting. Contract award is anticipated for September 22, 2026. Construction is anticipated to begin October 15, 2026, with substantial completion by December 31, 2026, and project closeout by January 31, 2027. Work is limited to Monday through Friday, 7:00 AM to 5:00 PM, with optional after-hours work (5:00 PM to 12:00 AM) available with owner approval at no additional cost. Work shall proceed by floor level, beginning with the 12th, 13th, and 14th floors.

Bidders must submit proposals in triplicate on the provided bid form and include a bid bond or certified check equal to ten percent of the total bid amount, made payable to St. Joseph County, Indiana. The successful bidder must provide performance and payment bonds for 100 percent of the contract amount, maintained for at least 12 months after final completion. A general construction allowance of $25,000 is included in the contract sum. Liquidated damages are assessed at $500 per calendar day for work incomplete after the contract completion date; conversely, contract incentives are offered at $500 per calendar day for work completed in advance of the contract time. Progress payments are made monthly based on applications submitted by the contractor and certified by the architect, with six percent retainage withheld until substantial completion. Final payment is made within 30 days of the architect's final certificate for payment. The contractor is responsible for all permits, inspections, taxes, and compliance with federal and state labor requirements, including E-Verify enrollment for newly hired employees. The contract is governed by AIA Document A101-2017 and includes compliance requirements under Title VI, the Civil Rights Act of 1964, the St. Joseph County Human Rights Ordinance, and the Americans with Disabilities Act.

INSTRUCTIONS TO BIDDERS 00 21 13 - 7

1.10 MODIFICATION OF BIDS

A. Written modifications of Bids will be considered only if received prior to the time stated for receipt of Bids. Submit written modifications in a sealed envelope, identified as required for Bids except that the Phrase “Modification of Bid” shall be used. Modifications made orally by telephone or by email will not be considered.

B. Bidders are cautioned that, in case of modification involving an increase in the base bid sum, the bid deposit shall be ample or be increased to cover the new base bid sum or the entire Bid may be rejected.

1.11 WITHDRAWAL OF BIDS

A. A Bidder may withdraw their Bid by letter with a notarized signature(s) or, with proper identification, by personally securing their Bid at any time prior to the time stated herein for the opening of Bids. A telephone request to withdraw a Bid will not be considered. No Bidder may withdraw their Bid within ninety (90) days after the actual time and date opening thereof. Should there be any reason why the Contract cannot be awarded with the specified period, the time may be extended by mutual agreement between the Owner and the Bidder.

B. Bids may be withdrawn at any time prior to the scheduled time for receipt of bids.

1. Withdrawn bids may not be resubmitted.

2. Bids shall not be withdrawn for a period of sixty (60) days after bid opening without consent of the Owner.

1.12 RESPONSIVENESS AND RESPONSIBILITY

A. The general contract (and all independent subcontracts, i.e., subcontracts not included within a general contract and regardless of tier) will be awarded to the lowest responsible and responsive bidder complying with the conditions and requirements provided in these Instructions, the bid forms and other bid documents. A ‘responsible and responsive’ bidder is a bidder demonstrably possessing the skill, ability, and integrity necessary to faithfully perform the work called for by the contract, based upon a determination of competent workmanship and financial soundness in accordance with Indiana Code 36-1- 9-3 or any successor statute.

B. Any bid determined to be non-responsive, or any bid submitted by Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner will reject the Bid of any Bidder that Owner finds, after reasonable inquiry and evaluation, to not be responsible. If Bidder purports to add terms or conditions to its Bid, takes exception to any provision of the Bidding Documents, or attempts to alter the contents of the Contract Documents for purposes of the Bid, then the Owner will reject the Bid as nonresponsive; provided that Owner also reserves the right to waive all minor informalities not involving price, time, or changes in the Work.

INSTRUCTIONS TO BIDDERS 00 21 13 - 8

C. If Owner awards the contract for the Work, such award shall be to the qualified responsible Bidder submitting the lowest responsive Bid in the best interest of the Owner.

The Owner reserves the right to accept a full or partial award of the bid or bids.

D. A Bidder determined to be non-responsible will be rejected.

E. Any bid that fails to conform to the essential requirements of the invitation for bids, such as specifications, or delivery schedule will be rejected as non-responsive.

F. A bid may be rejected where the Bidder imposes conditions that would modify requirements of the invitation for bids or limit their liability to the Owner so as to give them an advantage over other Bidders. The following is a non-exhaustive list of examples of bids that may be rejected in which the Bidder:

1. Attempts to protect themself against future changes in conditions, such as increased costs, if total price to the Owner cannot be determined for bid evaluation.

2. Fails to state a price and, in lieu thereof, states that price shall be “price in effect at the time of delivery”.

3. States a price but qualifies such price as being subject to “price in effect at the time of delivery”.

4. Where not authorized by the invitation, conditions, or qualifies their bid by stipulating that the bid is to be considered only if, prior to date of award, Bidder receives (or does not receive) award under a separate procurement.

5. Limits rights of Owner under any clause of Project Documents. However, a low Bidder may be requested to delete objectionable conditions from their bid if these conditions do not go to the substance, as distinguished from the form of the bid. A condition goes to the substance of a bid where it affects price, quantity, quality, or delivery of the items offered.

G. Any bid may be rejected if the Owner determines that it is unreasonable as to price.

H. Bids received from any person or concern debarred or ineligible shall be rejected if the period of debarment or ineligibility has not expired.

I. Any bid may be rejected where bid security is required, and a bidder fails to furnish it in accordance with the requirements of the invitation for bids.

J. Any bid may be rejected if the Bidder is involved with past or pending legal action with the Owner.
