About this file

This is a Contractor Certification Form (ST-220-TD) issued by the New York State Department of Taxation and Finance, applicable to contractors seeking state contracts valued over $100,000. The form is required under Tax Law Section 5-a, effective April 26, 2006, and pertains to the Region 8 Traffic Signs procurement contract for New York State. The certification requires contractors to verify their sales tax registration status and that of any affiliates and subcontractors. Contractors must complete all sections of the form, including contractor information, registration status declarations for the contractor and any affiliates or subcontractors, Schedule A listing entities exceeding the $300,000 cumulative sales threshold, and notarized acknowledgments. The form must be submitted to the NYS Tax Department Data Entry Section in Albany, New York, and contractors must also file Form ST-220-CA with the procuring state agency confirming submission of the ST-220-TD form.

The certification requirement applies to contractors who have made sales of tangible personal property or taxable services exceeding $300,000 cumulatively to New York State locations during the four sales tax quarters preceding the quarter in which certification is made. Contractors must declare their registration status with the Commissioner of Taxation and Finance under Tax Law sections 1134 and 1253, and similarly certify the status of any affiliates or subcontractors exceeding the $300,000 sales threshold. The form requires detailed information including federal employer identification numbers, sales tax ID numbers, and principal business addresses. All sections must be completed before a notary public, and incomplete forms will be returned for revision. This certification is a mandatory compliance requirement for contract award eligibility.
