About this file

This document is a Sole Source Justification Form submitted by the Illinois Department of Human Services, Division of Rehabilitation Services, to procure services from the Statewide Independent Living Council (SILC) to develop and implement the federally required and approved State Plan for Independent Living (SPIL). SILC is the sole organization in Illinois that is federally mandated to exist per the Rehabilitation Act of 1973 and designated to perform these duties. The initial term of the contract is from July 1, 2023 to June 30, 2024, with the potential for renewals. The total estimated value of the initial term is $251,394.

Funding for this contract comes from federal Title VII, Part B and Part C funds, as well as state general revenue funds provided through the Department of Human Services. SILC receives these funds to support the operations of the 22 Centers for Independent Living throughout Illinois and to implement the goals and objectives of the SPIL, which address areas such as employment, healthcare, housing, transportation, and capacity development for the Centers for Independent Living. Failure to support SILC would result in the relinquishment of approximately $700,000 in federal funds to the state.

Bulletin Reference Number 24-444DHS-CENOF-B-34569

Requesting Agency/University Illinois Department of Human Services

1. Provide a detailed explanation of the need for the supplies or services:

The Statewide Independent Living Council (SILC) is the sole organization in Illinois, federally mandated to exist per The Rehabilitation Act of 1973, designated to develop and implement the federally required and approved State Plan for Independent Living (SPIL). SILC receives federal funds pursuant to CFDA 93.3699.

SILC supports the operations of the 22 Centers for Independent Living (CIL) throughout the State of Illinois. CILs are organizations (also mandated by The Rehabilitation Act) that provide independent living services to individuals with disabilities.

Operation funds are allocated for extensive planning activities by the SILC to be done in conjunction with DRS, CILs, state agencies, state disability organizations, and organizations which provide services or influence service provisions affecting persons with disabilities. An important source of information is consumer input and involvement in the processes of assessing need and planning for future development of services by existing CILs, and establishment of new CILs. The operational management of these organizations will also ensure the implementation of the federally approved SPIL. The focus areas in the SPIL will address the quality of life improvement needed for people with disabilities in the areas of employment, healthcare, housing, transportation and CIL capacity development.

The implementation of the State Plan for Independent Living is required in order to receive federal formula funding through CFDA

93.369 from the Federal Department of Health and Human Services office of Administration for Community Living. Use of another procurement method will compromise receipt of federal funding.

2. Provide a list and describe in detail the specifications required to satisfy the need:

The Statewide Independent Living Council is federally mandated, through The Rehabilitation Act of 1973, to coordinate with state Centers for Independent Living and the Designated State Entity (IDHS DRS) the development and implementation of the State Plan for Independent Living. No other agency has the authority to meet this requirement.

The SILC is committed to the following Goals and Objectives which relate to the operations of its resource plan:

GOAL #1: Ensure that the SILC membership has a cross-disability, cultural and regional representation.

Objective (a): Recruitment of a qualified pool of candidates for potential appointment (ongoing).

Objective (b): Conduct new member orientation and periodic training for existing members (annually).

Objective (c): Conduct timely recommendations to the Office of the Governor, Boards and Commissions to replace members whose terms have expired, and recommend for re-appointment members who qualify for a second term and are active members of the SILC.

(annually).

GOAL #2: Support the work of SILC Committees to review and evaluate the implementation of the SPIL.

Objective (a): Provide accommodations to Committee members to ensure active participation on Committees. (ongoing) Objective (b): Staff will provide research and background information as needed to support the work of the SILC Committees.

(ongoing) Objective (c): SILC staff will network and collaborate with INCIL to monitor the implementation of the SPIL (ongoing)

GOAL #3: Review the allocation of Title VII, Parts B and C funds to the SILC and CILs in the State.

Objective (a): Continue to acquire information about the process for applying for Title VII, Part C funds by maintaining communication with ACL .(ongoing) Objective (b): Review the policy on allocating Title VII, Part C funds that maximizes opportunities for all CILs in the state to receive those funds .(annually)

GOAL #4: Increase service and program participation of unserved and underserved populations, including minority groups at CILs.

Objective (a): In cooperation with INCIL, identify needs of unserved and underserved groups, including minority groups with information contained in 704 Reports and the state Independent Living Annual Report.(annually)

GOAL #5: Continue to explore potential funding opportunities aimed at expanding the Independent Living Network in the Illinois.

Objective (a): Review request for proposals and other funding opportunities that may be appropriate for CILs and share this information with them (ongoing).

GOAL #6: Increase the ability of CILs to measure the impact of their annual consumer satisfaction surveys and thereby improve their services to persons with disabilities.

3. Provide detail explaining the justification selected in Section IV to explain why the requested supplies or services are the only ones available that can satisfy the agency or university requirements?

SILC is only the federally designated entity eligible to develop and submit the State Plan for Independent Living (SPIL or the plan) and authorized under Federal and State law to support the provision of Independent Living Services throughout the state by Centers for Independent Living (CIL).

4. What are the unique features of the supplies or services that are not available in any other product or by any other vendor? Provide specific quantifiable factors/qualifications:

The Statewide Independent Living Council (SILC) is the only agency that meets the requirements of section 705 of the Rehabilitation Act of 1973, and is authorized to perform the functions outlined in section 705(c) of the Act in the State of Illinois.

5. Has the Agency or University considered alternative supplies or services to satisfy their need? Yes No

5a. If no, why weren't alternatives evaluated?

The Statewide Independent Living Council (SILC) is the only agency within the state that meets the requirements of section 705 of the federal Rehabilitation Act and is authorized to perform the functions outlined in section 705(c) of the Act in the State of Illinois. No other vendors or agencies have the legal authority to fulfill these requirements.

6. Are there resellers or distributors?

Yes No N/A

7. What efforts were made to get the best possible price (i.e. did the agency/university negotiate) and how did you determine the price for this purchase is considered fair and reasonable?

Federal funding comes from Title VII, Part B, Part C and Social Security Reimbursements. State funding for CILs comes from state general revenue and is provided through the Department of Human Services. These funds are designated for CIL operation and delivery of independent living services. No specific amount is coordinated for a specific purpose. The Department of Human Services is responsible to acquire, process and distribute these federal funds. A representative of the Department of Human Services is an ex-officio member of the SILC. The Executive Director of the SILC meets periodically with DHS staff to discuss issues relevant to the SILC and the CILs, including coordination of activities with the SPIL.

The purpose of the HSTP grants to CILs is to assist the CIL with participation of staff and/or consumers at their regional Human Service Transportation Planning Committee meetings, RTA meetings and other local transportation meetings in order to advocate for improvements in the availability and accessibility of transportation for all citizens.

The purpose of the leadership grants to CILs is to assist the CIL in fostering the development of a consumer leadership training program that cultivates people with disabilities to advocate on issues and influence policy makers.

The IDHS Division of Rehabilitation Services serves as the Designated State Unit (DSU), that on behalf of the State, receives, accounts for and disburses via grants, federal funding received under Subpart B of the federal Rehabilitation Act of 1973 (https://www2.ed.gov/ policy/speced/leg/rehab/rehabilitation-act-of-1973-amended-by-wioa.pdf), in addition to state GRF funds. Funding is used to support the 22 existing Centers for Independent Living within Illinois. Centers for Independent Living (CILs) are non-residential, consumer controlled, community-based, not-for-profit organizations which provide services to individuals with disabilities as well as systems advocacy to create options and choices for independent living. More than 50 percent of each CIL’s administrative and program staff, and board of directors, must be comprised of persons with disabilities.

Additionally, this federal and state funding is used to support the federally mandated Statewide Independent Living Council (SILC).

There can exist only one SILC per state; and its members are appointed by the Governor of each state, per 29 USC 796d. IDHS DRS, as the DSE, has an ex-officio seat on the SILC Board of Directors. The SILC is federally mandated to develop a three-year State Plan for Independent Living (SPIL) which governs the provision of independent living services throughout the state, per 29 USC 796c. In order to receive federal Subpart B funding from the USDHHS Administration on Community Living (the grantor of funds designated for independent living services under the Rehabilitation Act), Illinois must have the SILC established and a current SPIL in place (29 USC 796c(a)(1)). There are no allowances for other vendors, or agencies, to competitively bid to become the SILC and develop the SPIL.

Funding for the SILC for SFY24 includes $175,698 of the total federal Subpart B funds provided to Illinois per above. Additionally, DHS provides the SILC with $60,830 in federal program income funds to support its efforts.

Note the following about the budget:

- The salaries and fringe benefits are commensurate based on similar positions in Central Illinois

- Travel is based on historical travel figures using the State's current mileage rate

- Furniture and equipment is based on actual replacement of repair costs

- Contractual Services are based on actual service contracts required

- Consultant fees are based on actual fees paid to an interpreter and CART reporter. Amounts are consistent with prior year use based on required meeting to meet the SPIL

- Rent and insurance cost are commensurate with accessible lease space in Central Illinois

- Training Education requirements support the training required outlined in the federally approved SPIL

- Misc Costs are consistent with day to day operational costs mandated by the Council and are consistent with historical use

- SPIL Activities are federally required activities outlined in the Plan approved for Illinois

Failure to support the SILC, as mandated in both State and Federal law, will result in the relinquishment of approximately $700,000 in federal funds to the State.

Q7Answer: Federal funding comes from Title VII, Part B, Part C and Social Security Reimbursements.

The IDHS Division of Rehabilitation Services serves as the Designated State Unit (DSU), that on behalf of the State, receives, accounts for and disburses via grants, federal funding received under Subpart B of the federal Rehabilitation Act of 1973 (https://www2.ed.gov/policy/speced/leg/rehab/rehabilitation-act-of-1973-amended-by-wioa.pdf), in addition to state GRF funds.
