Section B: Description of the Supplies/Services Required
The 309 Aircraft Maintenance Group (AMXG) and 309 Maintenance Support Group (MXSG) have a requirement for a service contract to troubleshoot and repair Testek Avionics Cooling Systems located in buildings 225 and 233 on Hill Air Force Base (HAFB), Utah.
The Avionics systems consist of 14 each Operator Control Consoles (OCC’S) in facility 225 and 20 each OCC’s in facility 233, all system air handlers, pump stations, and chillers. Testek shall evaluate/repair all avionics systems, including hardware/software issues, and control strategies error codes throughout the entire system. After system repairs, Testek shall verify avionics system functionality and reliability in both facilities through comprehensive testing and shall also provide over the shoulder familiarization to up to two (2) MXSG technicians.
Section C: Justification for Soliciting from a Single Source or Brand Name
Testek, LLC is the original equipment manufacturer (OEM). Testek does not authorize outside vendors access to parts and proprietary information. Testek provided a letter, dated May 13, 2020, stating they do not provide permission to possess, use, copy, reproduce, modify, adapt or similar of Testek proprietary information.
There are no other vendors at this time that can complete the repairs besides Testek because proprietary information is contained within elements of software source code, parts, electrical circuit design and hydraulic design, etc. The intellectual property is protected, prohibiting any other person from producing or supplying parts developed by Testek. The designs are unique and exclusively owned by Testek Solutions.
Section D: Efforts to Obtain Competition
Market research was conducted via Internet searches and outreach to the OEM, Testek, LLC. An Internet search did not reveal additional businesses capable of providing these services. Testek provided a letter, dated May 13, 2020, stating they do not provide permission to possess, use, copy, reproduce, modify, adapt or similar of Testek proprietary information. There are no authorized vendors.
The product is not available through GSA Advantage or Ability One.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
In the future, the Government intends to evaluate any opportunities to remove barriers for future requirements. The Government will continue to perform market research to see if any new opportunities allow for competition. However, unless the Government replaces the existing equipment or the OEM allows outside distributors, the Government will be required to continue single source awards to Testek. Accordingly, the Testek is the only company capable of providing the services described above without the U.S. Air Force experiencing substantial duplication of cost that could not be expected to be recovered through competition.
