About this file

This document is a Limited Source/Brand Name Justification for a simplified acquisition under FAR 13.106-1(b)(1). The United States Department of Agriculture (USDA) has a requirement for an estimated 1,600 quantitative Ochratoxin A tests. Ochratoxin A is a naturally occurring mycotoxin that can contaminate wheat and other grains. Based on market research, USDA determined that test kits meeting the required water-based and sensitivity specifications are only produced by one manufacturer, Romer Labs. The total estimated value of the five-year Indefinite Delivery Indefinite Quantity (IDIQ) contract is $75,000. USDA intends to award a single source contract to Romer Labs as they are the only manufacturer able to meet the technical requirements.

United States Department of Agriculture Limited Source/Brand Name Justification

FAR 13.106-1(b)(1) – Simplified Acquisitions Control No. (if applicable) ______________________

1. Identification of the agency and the contracting activity.

USDA/AMS/FGIS

USDA/APHIS/MRPBS/Contracting

2. Description of supply or service required to meet the agency’s needs.

The United States Departments of Agriculture (USDA), Agricultural Marketing Service (AMS), Federal Grain Inspection Service (FGIS), has a requirement for an estimated 1,600 quantitative Ochratoxin A tests. Ochratoxin A is a naturally occurring mycotoxin produced by several species of Aspergillus. Wet and cool weather conditions from flowering to maturity promotes the infection, which results in scab or head blight in wheat and other grains and commodities.

3. The rationale or circumstances for limiting competition.

Test kits that meet both the water based and sensitivity requirements for FGIS are only produced by one company.

4. A description of the market research conducted and the results or a statement of the reason market research was not conducted.

A sources sought noticed was published on sam.gov from 9/9/24-10/4/24. One response was received from a reseller, identifying two potential manufacturers. One manufacturer responded. USDA conducted conversations with these three manufacturers as well as one additional manufacturer of Myoctoxin test kits (the family of toxins that includes Ochratoxin-A). Only one manufacturer is able to meet the requirement.

5. Estimated price, including all options, if applicable.

IDIQ with five one-year ordering periods. Total purchases over five years will be $75,000. The precise number of test kits and specific delivery locations for these kits is not known and so an IDIQ contract will provide the best service to the government.

6. Recommended source(s).

Romer Labs.
