About this file
This Justification and Approval (J&A) document is for a sole source acquisition by the United States Air Force for KenCast FAZZT Digital Delivery System maintenance renewal. The contract will be a firm fixed price (FFP) arrangement for various KenCast Enterprise software and hardware components, including 50 FAZZT Enterprise FIPS Clients, maintenance services, enterprise servers (single, dual, and 4-node versions), and 7 FAZZT Power Publishers. The total estimated cost is redacted, with funding from 4930 funds, and a 15-day delivery after receipt of order.
The acquisition is justified because the KenCast software is integral to the Global Broadcast Service (GBS) network, used across multiple Department of Defense agencies. KenCast is the sole provider of the software maintenance and licenses, with unique security features that cannot be easily replaced without significant disruption. Market research was conducted through direct communication with KenCast, and no alternative sources were identified. The contract will be awarded by AFMC OL:H PZIEB at Hill Air Force Base, with the contracting officer determining the cost to be fair and reasonable through standard federal acquisition pricing procedures.

IV. Statutory authority permitting other than full and open competition.
AFFARS 5313.501 - 1 O U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C 1901)
AFFARS 5313.501 - 10 U.S.C. 2304 (c)(l) as implemented by FAR 6.302-1 (a), Only One Responsible Source. No other supplies or services will satisfy agency requirements.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The Global Broadcast Service (GBS) is a stand-alone network, managed by the GBS Program Office and Defense Information Systems Agency (DISA) and used across multiple agencies wirthin the Department of Defense (DoD). KenCast FAZZT software gives each laptop a KenCast ID which grants the end-user permission to view certain files while blocking others. This is a needed security feature for the Receive Broadcast Manager (RBM). The GBS is a fielded system and has been in active use for over 10 years for a sizeable number of units within t he DoD. KenCast software is ingrained in GBS and inoperable without it.
The GBS Program and DISA have no plans to cha11ge the KenCast software based on the disruption this would cause to the service DoD-wide. The 520 SWES cannot independently change the KenCast software since the entire GBS network depends on it. If GBS were to move away from KenCast, the entire baseline (millions of lines of code) would have to be reworked and cause GBS to have to replace other commercial-off-the-shelf (COTS) items that are not compatible with the new software. If GBS shuts down for a re-design, it would be unavailable to provide the multitude of data and software updates it provides to the warfighter. The 520 SWES cannot independently change the KenCast software since the entire GBS network is co-managed by DISA and used across the entire DoD. Because of these reasons no other software on the market can be utilized to meet the requirement at this time.
Additionally, KenCast Inc. is the only provider for the maintenance agreement of their systems and unique applicability to GBS software licenses. No other vendor or distributor can legally obtain access to the software, and no other vendor can make duplicate copies since it is protected by copyright and patent laws. KenCast Inc. is the sole proprietary supplier of the software licenses and t he maintenance and support of those licenses. KenCast Inc. has provided a letter stating that they will not resell their product through third party ve11dors. They have also indicated they are not willing to sell their proprietary data.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
A search of Enterprise software Initiative (ESI), Solutions for Enterprise-Wide Procurement (NASA-SEWP), and GSA websites did mot result in a viable product or source to support this requirement. Subsequent email traffic directly with KenCast Inc. (newman@kencast.com) identified the company has a direct sales model and does not resell through third party sources.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The following steps will be taken to ensure that the anticipated cost of this acquisition wil l be fair and reasonable. The Contracting Officer will comply with the procedures and criteria contained in Federal Acquisition Regulation (FAR) under Part 30 - Cost Accounting Standards, Part 3-1 - Contract Cost Principles and procedures, Subparts 15.4 - Contract Pricing; to include technical evaluations and audits, as appropriate. Additional steps to ensure price reasonableness will be under the guidance of the Contract Pricing Reference Guides, jointly developed by the Federal Acquisition Institute and the Air Force Institute ofTechnology. The CO will obtain other than certified cost or pricing data IAW FAR 15.403-3. The final step is to include the Price Negotiation Memorandum (PNM). This detailed documentat ion and

X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Other alternative software was considered during the initial engineering and design architecture. This software was selected as best value to meet the scope, complexity, and mission requirements at that time.
