About this file

This document is a Justification and Approval for Other Than Full and Open Competition for the acquisition of proprietary Chicago Gooseneck Faucet assemblies adapted with Powers thermostatic cartridge assemblies. The VA Pittsburgh Healthcare System (VAPHS) requires these faucet assemblies for a renovation project on the East floor of the Pittsburgh University Drive medical center. The Chicago Gooseneck Faucet assembly is the only product that meets the VA's requirements for preventing the spread of germs, controlling water temperature to prevent scalding, and easy maintenance. No other manufacturer offers a comparable product. The contract will be awarded as a 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside under a larger construction project. The estimated value of the faucet assemblies is redacted. The related federal contract opportunity is for the renovation of the B1 2E Clinics at the Pittsburgh VAMC, with a period of performance of 730 calendar days and an estimated construction value of over $10 million.

Description of Supplies/Services Required to Meet the Agency’s Needs: The VAPHS uses Chicago Gooseneck faucet assembly adapted with a thermostatic cartridge assembly throughout all facilities on both the University Drive and Heinz Campuses. Powers Gooseneck Faucet has been found to give the most advantage to prevent Legionella, and use of an anti-scalding device – a perfin wax ring located inside the cartridge. This is in coherence with VA policy 1061. Anti-Scald Device. Anti-scald device is a temperature actuated appurtenance used in plumbing systems to reduce/stop water flow exceeding a defined temperature. Individual anti-scald devices must meet the American Society of Sanitary Engineers (ASSE) 1062 Standard. Anti-scald devices may be add-on or integrated into plumbing fixtures or integrated into water tempering valves. It is very easy to routinely clean and disinfect by the custodial staff using common products eliminating the need to stock numerous different cleaning products. Powers thermostatic cartridge assembly allows for temperature control providing safety to patients and staff from scolding water; while simutanlously allows the boilers to maintain 140 degrees to help kill potentially bacteria such as legionella in the water. The anti scaling device also allows the facility to rest assure the patient or staff member that may have hand sensory issues using the faucet never gets scalded incase of a plumbing failure with the faucet. Chicago Gooseneck Faucet assembly has qualities, as noted below, that are key factors in the standardization process. This allows for quick replacements to be completed by our M&R with no adverse side effects to our patients. Allows for stock replacement pieces to be avaible with quick turn around in repair and cost. VAPHS has been making a conscious effort to standardize the finishes throughout the restroom, laboratory and clinical areas to make them more resistant to infectious pathogens and easier for the limited custodial staff to maintain.

The Chicago Gooseneck Faucet assembly is used across the VAPHS campuses are designed with the following performance criteria:

4. Statutory Authority Permitting Restricted Competition:

( X ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements in accordance with FAR 6.302-1(b)(1)(i)

( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert

Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The acquistition is authorized pursuant to 10 U.S.C. 2304 (c)(1), and is implemented by FAR 6.302-1 (c), Only one responsible source and no other supplies or services will satisfy agency requirements. This product currently is only made by one manufactor, at current market research no other manufactors have been found that provide equal product qualities that the faucet and thermostatic cartridge assembly does to satifiy the plumbing requirements set by the VA plumbing design guidelines. Granite – a mixing valve under the sink could work as well. But time and time again in our facility plumbing experts have noticed that these 3/8’’ mixing valves fail causing cross contaimanation throughout an entire wing or floors. Simplification of this assembly helps avoid additional maintaince and taking up inventory space of many different faucet assemblies. The installation of material finishes other than noted faucet with assembly would require duplication of maintenance materials and could expose our veteran patient population to dangerous pathogens unnecessarily.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Current market shows no competion for the suppliers of the Chicago Gooseneck Faucet Assembly adapted with Power thermostatic cartridge assembly. Any other product without thermostatic cartridge would cause an undue hardship on the VA Pittsburgh Healthcare System due to the potential risk it poses staff and patients without the features this faucet offers. There are other manufactorers that provide a thermostatic cartridge to ensure adequate tempeartures and prevent burns, but no other manufactor offers the ability to disassemble and clean the faucet the way that Chicago Gooseneck faucets do. These features in combination with one another leave no other supply fully capable of supplying a facuet that can be safe and prevent the spread of germs or water borne patogenes.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: This item is being sole sourced under a larger construction project that will be competed as a 100% Service Disabled Veteran Owned Small Business (SDVOSB) set aside.

Therefore, competition will be provided on the base contract which will lead to a fair and reasonable price.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: These faucets have been used on a number of projects the prior faucets that were the VA’s standard equipment were discontinued which required a search by multiple plumbing sub contractors through various supply sources to find something that met the specifications required. This equipment was the only item that met all crietria others feature some of the same features as this manufator but none in the same combination. The prior knowledge from other contracts and speaking with our industry partners about these facuet fulfilled our requirement per FAR part 10. At this time we have exhausted standard means of market research for commercially available items any other item available would be a non-commerical or custom ordered product that would drastically increase cost. At this time this is the only manufacturer speaking with various supplies who relayed that manufactorers find it too expensive to include all of these features for a limited market ensure that we will likely need to rely on this item for the foreseeable future.
