About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the Naval Surface Warfare Center, Carderock Division (NSWCCD). The document details the procurement of ServiceNow software licenses to support an existing Service Portal, with the strategic goal of developing a unified Command Business Platform. The acquisition includes multiple software modules and licenses such as Employee Document Management, Agile Team Module, ITOM Operator Professional, Software Asset Management Professional, HR Service Delivery Enterprise, and various other ServiceNow products.

The procurement will be executed through an existing Carahsoft Technology Enterprise Software Initiative (ESI) Blanket Purchase Agreement (BPA) No. N66001-19-A-0120, which is the sole source for ServiceNow products within the Department of Defense. The licenses will support a one-year term from 05/07/2025 to 05/06/2026, covering multiple user types and functionalities across IT, security, HR, and other operational support functions. The document emphasizes that changing software platforms would cause significant work disruption, retraining costs, and potentially halt modernization efforts, thereby justifying the sole-source procurement.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Carderock Division (NSWCCD), Contracting & Acquisitions Department (Code 02).

2. Description of the Action Being Approved

NSWCCD intends to purchase licenses necessary to support our existing ServiceNow Service Portal. The long-term strategy associated with the purchase is to continue developing a single, unified Command Business Platform that will improve the workforce’s experience, unify local Command data management, improve our Business Intelligence, and provide a means of automating repetitive tasking to maximize limited resourcing.

Many of the organization's core operational support functions (IT, Security, HR, etc.) are moving to this web-based platform, enabling better customer service, greater efficiency, and increased business intelligence, saving costs and delivering greater service levels to the employees of NSWC Carderock. ServiceNow was selected at the Warfare Center Headquarters as a unified platform for all Warfare Centers (WFCs) to ensure uniformity and efficiencies are gained across all commands.

If the organization is unable to purchase the software, it will delay and inhibit the ability to automate several critical HR services such as Addendum, Onboarding & Offboarding. This employee data is critical to other functions and will set the foundation for efforts across other Process Areas. This software platform is already in use with trained staff of both the Contractor and Government resources.

To meet this requirement, the Government will issue a Blanket Purchase Agreement (BPA) Call to purchase several IT licenses and programs. A BPA Call is an order against an existing BPA to request a service or product provided under the established agreement. The Government will use the existing Carahsoft Technology Enterprise Software Initiative (ESI) BPA No. N66001-19-A- 0120 as it is the sole source of ServiceNow products through the Department of Defense Enterprise Software Initiative (DoD ESI).

4. Statutory Authority Permitting Other Than Full and Open Competition

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(5), Authorized or required by statute. The regulatory authority permitting limited sources is DFARS PGI 208.7403(1) – “After requirements are determined, the requiring official shall review the information at the ESI website to determine if the required commercial software or related services are available from DoD inventory (e.g., Golden Disks and DoD-wide software maintenance agreements). If the software or services are available, the requiring official shall fulfill the requirement from the DoD inventory.”

5. Rationale Justifying Use of Cited Statutory Authority

ServiceNow has been in use with WFCs since 2021 automating various workflows for the Enterprise. Our civilian and contractor staff have been trained on the software from both a development perspective and end user standpoint.

It would cause dire strain on all WFCs to replace ServiceNow with comparable software and cost the government countless hours in retraining, retooling, and processing new engineering solutions. Core services already fulfilled through the software would slow down as the command would need to pivot to manual processes. Additionally, all modernization efforts would halt and exiting legacy contracts that are intended to be sun-set due to the growth of ServiceNow, would have to be continued causing the government to spend over one million extra dollars. Purchasing these licenses and continuing with the enterprise modernization efforts, not only supports Command initiatives but helps enable a more efficient workforce.

Additionally, the WFCs made the executive decision to uniform the approach by which they conduct operational workflows. Changing from ServiceNow to another program would cause significant work stoppage and take several years to reinvest in a new program and software to execute the work currently taking place under ServiceNow.

NSWC Carderock and Newport are purchasing a base year and one option year to allow for the WFC HQ to establish a 5 year solution for all WFCs. By establishing a potentially two year action, NSWC Carderock and Newport will be immune to contractual shortfalls of the effort.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

In accordance with FAR Part 10, we conducted Market research and found that Carahsoft Technology CORP has an existing ESI Enterprise Agreement to provide Service Now products and services. In accordance with DFARS 208.74, we are required to review the DoD ESI website for DoD inventory or availability of an existing DoD ESI agreement before pursuing another acquisition method.

Carahsoft Technology CORP offers the required products and services under BPA N6601- 19-A-0120. DoD ESI and Enterprise Software Agreements have proven that managing the acquisition of commercially available software at the enterprise level reduces costs. DoD ESI enables aggregation of software requirements and promotes the use of Enterprise Software Agreements that leverage the DoD’s buying power.

Pursuant to FAR 8.405-6(a)(2) - the Government will publish a notice and post this Justification at the Government point of entry (SAM.gov). The Government will ensure that the contract file will be documented as to any responses received from making the Justification available.

7. Determination of Fair and Reasonable Costs

In accordance with DFARS 208.404 and Class Deviation 2014-O0011, the Procuring Contracting Officer (PCO) will determine whether the call represents the best value using the proposal analysis techniques found at FAR 15.404-1, to establish a fair and reasonable price. In accordance with DFARS PGI 208.7403, DoD ESI pricing was reviewed by the PCO and determined to be the best value to the Government. Additionally, the ordering activity will seek a price reduction from the DoD ESI BPA pricing IAW FAR 8.405-4.

8. Actions to Remove Barriers to Competition

NSWCCD plans to utilize the existing BPA available through DoD ESI annually until DoD ESI is no longer an efficient and feasible source for procuring ServiceNow products and services.

For the reasons set forth in Paragraph 5, NSWCCD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCCD will assess whether competition for future requirements is feasible..
