About this file

This is a Justification for Sole Source Procurement document submitted by the Centers for Disease Control and Prevention (CDC) for approval of a non-competitive contract award under $250,000.

The CDC's OID/NCHHSTP/DHP/Lab Branch seeks to procure an Agilent Tape Station Service Contract from Agilent Technologies (2850 Centerville Road, Wilmington, DE 19808) for an estimated cost of $8,953.52 per year, totaling $26,860.56 over the base year plus two option periods. The procurement request number is HCKBG-2026-97416, and the requirement is available on GSA Schedule GS-07F-0564X. The justification for sole source procurement is based on exclusive licensing agreements and proprietary data under FAR 13.106-1(b)(1). The TapeStation 4150 instruments are used to automate quality control processes for RNA, DNA, and protein samples critical to research workflows, and only Agilent, as the manufacturer, can provide genuine parts, proprietary software support, and technical expertise necessary for proper maintenance and operation. No alternative vendors were considered because competitors lack access to Agilent's proprietary technologies. The Program Office Certification was signed by Lee Lam-Pau on March 9, 2026, and the Contracting Officer Certification was signed by Debra A. Baker on July 23, 2026.

C. Justification:

1. The justification for this non-competitive action is: (NOTE: Must select only ONE of the listed justifications for other than full and open competition and fully support the justification in the following paragraphs. Please delete this note prior to submitting the justification.)

☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand-name.”

☐ Urgency ☒ Exclusive licensing agreements/Proprietary data ☐ Brand name required ☐ Industrial mobilization ☐ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)

☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”

☐ Urgency ☐ Only One Source ☐ Logical Follow Up ☐ Brand name required

2. Other facts supporting sole source procurement:

What can this product/service do that other products/services cannot do?

a. A service A service agreement with Agilent is needed to ensure the valid management and proper usage of the Agilent TapeStation 4150 instruments in our laboratories.

These TapeStations are used to automate the Quality Control (QC) processes for RNA, DNA, and protein samples, which are critical to our research workflows.

b. What other products/services were considered and why did they not meet the need?

No other services were considered because only Agilent, as the manufacturer, can provide the genuine parts, services, and proprietary software support necessary for the TapeStations 4150. Other providers lack access to Agilent’s proprietary technologies and technical expertise and therefore cannot meet the operational requirements.

3. Program Office efforts to seek potential offerors:

No other offeror was sought as Agilent is the only vendor who can provide genuine parts, services, and proprietary software tech support to properly maintain the TapeStations 4150.
