About this file
This is a Justification and Approval for Use of Other Than Full and Open Competition, issued by the Naval Criminal Investigative Service (NCIS) Headquarters on 04 February 2026. NCIS seeks to award a sole source contract to HGW and Associates, LLC for Enterprise Safety and Management System (ESAMS) user licenses supporting 2,500–4,999 users, including support, maintenance, and the SF91 (Motor Vehicle Accident Report) module. The contract period runs from 05 March 2026 through 04 March 2027, with funding from FY2026 OM&N appropriations. The acquisition is being conducted under FAR 13.106-1(b)(1)(i) procedures for single-source solicitation, justified under the statutory authority of 10 U.S.C. 3204(a)(1), establishing that only one responsible source exists and no other supplies or services will satisfy agency requirements.
HGW and Associates, LLC, located at 9729 Cogdill Road, Suite 200, Knoxville, Tennessee 37932 (CAGE: 1FZS7; UEI: DYN5HCFUVXC3), is identified as the sole manufacturer and provider of ESAMS with no authorized resellers. The justification emphasizes ESAMS is mission-critical during the Navy's transition to the Risk Management Information (RMI) system, providing irreplaceable web-based training modules, official training completion documentation required by OPNAV M-5100.23 CH-3, and the only approved system for SF91 electronic submission. Additionally, Commander, Navy Installations Command (CNIC) has mandated ESAMS as the exclusive approved safety training program for all Navy facilities, making continued NCIS compliance contingent upon the system's operation. Market research confirmed that UNICOR, AbilityOne, DoW ESI, and NASA SEWP do not provide ESAMS software. Fair and reasonable pricing will be determined using FAR 13.106-3(a) techniques, and future procurements will include market reviews to reassess competition opportunities.

6. Specific characteristics of the supplies or services that limit the availability to this/these source(s), i.e., unique features, form-fit-function, etc.). State why the requested material or service represents the minimum requirement(s) of the Government. Describe in detail why only this/these suggested source(s) can furnish the requirement(s) to the exclusion of other sources.
The agency's continued reliance on the Enterprise Safety Application Management System (ESAMS), and the services provided by HGW to support it, is a mission-critical necessity during the Department of the Navy's ongoing transition to the new Risk Management Information (RMI) system. While RMI is designated to become the single, consolidated Program of Record for safety, the phased migration of core ESAMS functionalities and historical data is not yet complete. A premature discontinuation of ESAMS would introduce significant operational gaps and unacceptable risks. Specifically, it would compromise the integrity and continuity of safety data, jeopardizing the agency's ability to adhere to congressionally mandated and Navy-wide safety and occupational health standards. Therefore, the continued operation of ESAMS serves as an essential bridge, ensuring seamless data migration and maintaining a stable, compliant safety management posture until RMI reaches full operational capability. This transitional period is vital to build upon the foundational data and processes established in ESAMS and prevent any degradation of the Navy’s and NCIS’s safety and readiness.
The primary justification for the continued use of ESAMS is its exclusive offering of specialized, web-based training modules critical to NCIS operations. No other system provides the required platform to develop, customize, and deliver safety courses tailored to the unique needs of our personnel. Furthermore, ESAMS is the sole system capable of officially recording training completion for all NCIS agents and staff, a fundamental requirement for demonstrating compliance with the OPNAV M-5100.23 CH-3, Navy Safety and Occupational Health Manual. The termination of ESAMS would immediately dismantle the agency’s ability to administer and document this mandatory training, leaving the agency in direct non-compliance with established Navy safety protocols. This would not only be detrimental to NCIS’ internal safety program, but would also expose the agency to unnecessary risk and liability. The system's role in ensuring every member of NCIS meets their required safety competencies cannot be overstated.
ESAMS currently serves as the established and functional system of record for the electronic submission of the Standard Form 91 (SF91), Motor Vehicle Accident Report, for all NCIS-related incidents. While the RMI system is slated to eventually assume this responsibility Navy-wide, this specific functionality remains in a protracted development phase with no definitive timeline for completion. As it stands, RMI is not a viable alternative for this critical reporting requirement. A premature transition away from ESAMS would leave NCIS without a reliable or approved method for documenting vehicle accidents, severely hampering our ability to manage risk, process claims, and maintain accurate records as required. The continuity of this function is paramount, and ESAMS is the only system currently capable of delivering it.
The use of ESAMS is not merely a matter of preference but a mandatory requirement for all entities operating within Navy installations. Commander, Navy Installations Command (CNIC) has designated ESAMS as the exclusive approved safety training program for all Navy Facilities. As NCIS relies on Base Operations Services (BOS) provided by CNIC, the agency’s adherence to this directive is non-negotiable. The operational synergy between NCIS and CNIC is dependent on shared systems and standards. ESAMS is the thread that connects NCIS safety protocols with the broader installation safety framework. No other program can satisfy the mandatory requirements

imposed by CNIC, and the agency’s continued access to essential base services is contingent upon NCIS’ use of this system. Therefore, the continuance of the ESAMS program is paramount to the uninterrupted operation of NCIS across all naval installations.
On 20 January 2026, Acquisitions confirmed with HGW and Associates that ESAMS is a proprietary application owned solely by HGW with system support and help provided by HGW staff only. HGW is the sole provider and support of the ESAMS application. No other vendors are authorized to provide software maintenance, programming, or technical support for ESAMS.
7. Determination of fair and reasonable pricing.
Basis of award will be determined based on fair and reasonable pricing using techniques at FAR 13.106-3(a), as applicable.
8. Brief description of Market Research conducted and results or why market research was not conducted.
Acquisitions market research is based on searching the open market for sources of supply. The required sources UNICOR, AbilityOne, and DoW ESI, as well as the preferred source NASA SEWP, do not have ESAMS Software. ESAMS is only available via one source, HGW and Associates, on a GSA Federal Supply Schedule and is the sole proprietor of the software. Data was analyzed by reviewing the customer’s procurement package, which included the Independent Government Estimate (IGE) based on a market research price estimate from HGW and Associates, and reviewing historical contract information. Only one source, HGW and Associates, can provide the required ESAMS software licenses. The vendor has a GSA schedule and is the sole source provider of this software.
