Limiting Competition at or below the Simplified Acquisition Threshold
1. Contracting Activity: 411th Contracting Support Brigade proposes to award a purchase order while limiting sources pursuant to FAR 13.106-1 in support of 2nd Combat Aviation Brigade.
2. Description of Action: The government intends to limit sources solicited pursuant to FAR 13.106-1(b)(1), Items peculiar to one manufacturer. A brand name item via purchase order is an item peculiar to one manufacturer.
3. Description of Supplies/Services: The government requires equipment to upgrade existing Denray Machine downdraft tables with HEPA filtration and one additional downdraft table in order to be in accordance with OSHA regulation 29 CFR 1910.1200 and Army Regulation 385-10. Downdraft tables are a required equipment item used to capture and contain Hexavalent Chromium Cr+6 dust produces during the process of conducting repairs and maintenance on aircraft involving the sanding and painting of aircraft parts in order to prevent expose or personnel to the toxic chemical.
4. Authority Cited and Reason for Authority Cited: This acquisition shall be conducted under the authority of FAR 13.106-1(b)(1), Only one source is capable of providing the supplies or services at the required level of quality because Denray Machine is the only manufacturer able to provide the parts to upgrade these tables, as they were originally manufactured by Denray Machine. Additionally, the table required shall be consistent with owned equipment and therefore able to be maintained using the existing maintenance structure.
5. Market Research: The government contacted Denray Machine and found that the contractor was the only company able to provide parts for the tables they produced.
6. Other Facts Supporting the Justification: None.
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: This justification is based on the current technology in use and the significant investment made by the government to procure this technology. The government may revisit the investment decision at a point in time in the future to ensure it leverages industry leaders and cutting edge solutions to achieve best value.
