JUSTIFICATION FOR LIMITED

COMPETITION/SIMPLIFIED ACQUISITION

FEDERAL BUREAU OF INVESTIGATION

JUSTIFICATION AND APPROVAL FOR

ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

In accordance with Federal Acquisition Regulation 13.106-1(b)(1), I hereby determine that the Full Spectrum Imaging System (FSIS) 2 listed on DJF-22-0700-PR-0003352 is available from only one source, and competition is precluded as there are no substitutes available.

1. This acquisition is restricted to the following sole source:

Company: Arrowhead Forensics Company Address: 11006 Strang Line Road, Lenexa, KS 66215 Company Point of Contact and Phone Number: Brad Brown, 913-894-8388

2. The Full Spectrum Imaging System (FSIS) 2 is estimated to cost $85813.99 and is required to be delivered by 9/30/2022.

The FSIS 2 is a forensic image capturing system. It consists of a 20MP digital camera capable of capturing images in full color.

The required technical specifications are:

• Apple iMac with 1TB of storage

• 20MP Digital FSC camera, resolution able to capture a 5" by 3" area with 1000 ppi resolution from 254nm to 1100nm. Able to capture full color 24 bit images (48MB file size). Camera is pre-threaded for optional tripod mounting. Maximum resolution of 3500 PPI.

• Patented "Integration" Curved Surface Software

• Fast Scan (or real-time) viewing ability for scanning evidence

• Integrated Foot Pedal (for hands-free image capture)

• Articulating Camera Arm

• 50mm UV Lens

• 2 Year Manufacturer Warranty

3. The Terrorist Explosive Device Analytical Center Scientific (TEDAC) Scientific and Biometrics Analysis Unit (SBAU) Latent Print Discipline requires the FSIS 2 in order to capture and detect latent prints on items of evidence submitted to the FBI Laboratory Huntsville Location. The FSIS 2 has been internally validated by the FBI Laboratory Latent Print Discipline and is currently in use at the Huntsville location. TEDAC SBAU must purchase additional FSIS 2 to replace older model FSIS cameras that are no longer functioning properly.

SBAU is seeking a one time firm-fixed price contract with Arrowhead Forensics to purchase one (1) FSIS II Color Lab System. Arrowhead Forensics is the exclusive distributor of this product.

Specific characteristics of the FSIS 2 that limit the availability to a sole source are described above under technical specifications, but include the patented 20MB camera, the patented "Integration" software that allows for the capture of latent prints on curved surfaces. Only this suggested source can furnish the requirements, to the exclusion of other sources, because Arrowhead Forensics is the sole distributor of this patented product.

4. Check and fill in all that are applicable for an Open Market Buy:

D The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The current equipment is <insert description of current equipment>, and the new item/service must coordinate, connect, or interface with the existing system by <insert description of how the new item/service must coordinate or interface>.

I::8J A patent, copyright, proprietary data, or licensing agreement limits competition. The proprietary data are described as follows:

The 20 MB digital camera as well as the "Integration" software are patented by manufacturer, General Atomics, and Arrowhead Forensics is the sole distributor of this product. The patented features are necessary components of the capture system because they allow latent print images to be captured on evidence with an extremely high degree of clarity (high resolution), allow for the capture of latent

DJF-22-0700-PR-00033S2 Version 1.0 Page 2 prints at a wide variety of light wavelengths including short wave UV and IR, and allow for the capture of latent prints on curved surfaces.

[S] These are "direct replacement" parts/components for existing equipment.

The FSIS 2 are also direct replacements for older model FSIS being used in SBAU that are no longer manufactured and beginning to fail.

5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).

The contracting officer will determine, after considering the level of effort and the mix of skills available for the tasks needed, that the proposed order or BPA represents a reasonable total price and will be the best value for the FBI.

6. A description of the market research conducted among schedule holders, and the results of the research. A statement must be made that the supplies and services are available from the FSS.

Scientific and Biometrics Analysis Unit Latent Print Discipline personnel regularly review scientific literature, attend product seminars, perform internet based research, and communicate with vendors to ensure it has the most appropriate equipment available to perform examinations pursuant to the TEDAC mission. This FSIS 2 is a requirement for conducting latent print examinations on submitted items of evidence, so SBAU personnel are intimately familiar with the vendor who offers it, or any equivalent product.

7. Any other facts supporting the limited source justification.

The FSIS 2 has been internally validated by the FBI Laboratory Latent Print Discipline, therefore, if another similar product was purchased it would have to undergo an arduous validation process which would use valuable time and resources. Further, the FSIS 2 contains two patented features that are required by SBAU and could not be provided by

DJF-22-0700-PR-00033S2 Version 1.0 Page 3 any other vendor. And finally, the FSIS 2 are direct replacements for older model FSIS being used in SBAU that are no longer manufactured and beginning to fail.

8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

The Government will continue to research the market to obtain as many available sources as required in accordance with the FAR to ensure that there are other vendors out there that can satisfy this requirement. In addition, the customer will do due diligence in ensuring that barriers to competition are avoided to ensure we obtain the best value for the government.
