About this file

This is a Justification for Sole Source Procurement document submitted by the Centers for Disease Control and Prevention (CDC) for a contract under $250,000. The CDC's National Center for HIV, Hepatitis, STD, and TB Prevention (NCHHSTP) seeks to procure maintenance services for its Sexually Transmitted Infections (STI) Treatment Guidelines mobile application and administrative backend panel from Mobomo, LLC, the sole proposed vendor. The estimated procurement amount is $101,180.10, with Procurement Request Number HCKCH-2026-97035. The requirement is not on the GSA Schedule. The justification is based on FAR 13.106-1(b)(1) ("only one source reasonably available"), with selections for brand name required and other factors such as compatibility and continuity.

The justification emphasizes that Mobomo, LLC is the only vendor with expertise in the existing application and backend system. The program office had initially planned to in-source maintenance to CDC's Office of Communications; however, the relevant branch was eliminated in April 2025, eliminating this alternative. Transferring the application to another vendor would disrupt service availability and potentially harm patients seeking STI treatment information. This is characterized as a one-year emergency extension of funding, with market research deferred to a future recompete. No other products or services were formally evaluated beyond the eliminated in-sourcing option. The justification was certified by Jessica Mesnick, Deputy Branch Chief, on February 27, 2026, and approved by Contracting Officer Debra A. Baker on July 23, 2026.

D. Justification:

1. The justification for this non-competitive action is:

☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

☐ Urgency ☐ Exclusive licensing agreements/Proprietary data ☒ Brand name required ☐ Industrial mobilization ☒ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)

☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”

☐ Urgency ☐ Only One Source ☐ Logical Follow Up ☐ Brand name required

2. Other facts supporting sole source procurement:

a. What can this product/service do that other products/services cannot do?

The mobile application for CDC’s STI Treatment Guidelines (“app”) was built and is maintained by Mobomo, LLC. They are currently the only vendor who has worked on this app and it’s backend panel. After exhausting all option years the program office had planned to in-source to CDC’s Office of Communications. However in April of 2025 the relevant CDC branch was eliminated, leaving the program without this option for keeping the app live. The program is therefore seeking an urgent extension of Mobomo’s app maintainance work to ensure the app remains live with uninterrupted access to healthcare providers while the government seeks to clear the contents of the new guidelines and define the requirements for a recompete.

Transferring management of the app to CDC is no longer an option, and transferring to another vendor would create a disruption in app availability, which would potentially negatively affect patients seeking treatment for STIs.

b. What other products/services were considered and why did they not meet the need?

Rev. 5/14/19

Transferring the app to CDC’s Office of Communications (OC) was considered, but after the relevant branch was elimited in 2025, this option was no longer viable.

3. Program Office efforts to seek potential offerors:

Market research was not conducted for this contract. This is considered a one year emergency extension of funding. Market research will be conducted for a future recompete.
