D. Justification:

1. The justification for this non-competitive action is:

In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

Urgency Exclusive licensing agreements/Proprietary data Brand name required Industrial mobilization Other (e.g., compatibility, space issues, continuity, compatibility, etc.)

In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”

Urgency Only One Source Logical Follow Up Brand name required

2. Other facts supporting sole source procurement:

a. What can this product/service do that other products/services cannot do?

The CDC, NCEH Noise-Induced Hearing Loss Workgroup is procuring for a Public Service Advertisement campaign focused on attendees of year 2021 major league and National Championship sporting events, including Super Bowl LV, the College Football National Championship, 26 major league soccer games and the Daytona 500 NASCAR motor race.

Beasley Media Group is the only vendor who is licensed to offer digital radio ads that can create an estimated 12,000,000 impressions with the target population of pre-hearing loss, high-risk big-game attendees. They are the only vendor authorized to offer the “Big Game Package” that allows CDC to run both digital radio and website PSA ads on stations airing Super Bowl LV, Daytona 500, MLS Soccer Championship, and National Football Championship games in 2021 (1/11/2021-4/30/2021).

b. What other products/services were considered and why did they not meet the need?

Beasley Media Group is the only known vendor with a network of 64 radio stations

Rev. 5/14/19 and their websites that can provide 508 compliant multi-digital messaging format for CDC’s PSA Ads and provide daily and monthly campaign impressions data analytics and analysis reports. Beasley Media Group is the only known vendor who can deliver electronic messages and data capture utilizes GeoFencing (GPS) technology; permitting attendees of the game entering a virtual boundary around the event location to receive PSAs on their cell phone or internet browsing device for 30 days. The campaign includes targeting a national audience through CDC cleared content posted on a network of over 2 million media websites nationwide. Additionally, electronic formatting provides a format for previously developed hearing loss prevention content, such as our animated graphics, quiz and 30 second videos. These capabilities are essential as they align with CDC’s Public Health Data Modernization Initiative and the objectives of this public awareness campaign.

3. Program Office efforts to seek potential offerors:

The CDC, NCEH Noise-Induced Hearing Loss Workgroup reached out to CDC’s office of Communications to confirm there is no other known vendor authorized to air all of these sporting events in the geographic region where the events will take place. Beasley Media Group is the only gateway to radio stations and websites airing these sporting events, and to radio advertising in the Tampa Bay area; no other offerors were sought.
