This document is a Justification for Other Than Full and Open Competition (Sole or Single Source) for the procurement of two Automated Dispensing Modules (ADMs) used in Brown Tree Snake baiting operations in Guam.
The ADMs are a proprietary system developed by Applied Design Corporation (ADC) that are the only such devices in existence. USDA-APHIS Western Pacific Theater requires continued use of these ADMs to meet the requirements of their cooperative agreement for aerial toxicant treatments in Guam. The anticipated cost of the one-time purchase order is not to exceed $350,000. APHIS intends to award a firm fixed-price contract to ADC on a sole source basis, as no other company can currently provide these specialized devices without significant research and development. This notice serves to inform interested parties of the agency's intent to award sole-source, and allows for responses from responsible sources to be considered before a final decision is made.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
(SOLE OR SINGLE SOURCE)
In accordance with FAR Parts 6.1 and 13.104, this request for a noncompetitive acquisition is hereby submitted for consideration for acquisition approval.
1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING
APPROVED:
The Aerial Delivery System (ADS) is a proprietary, Brown Treesnake (BTS) bait dispensing system developed by Applied Design Corporation (ADC) for BTS control in Guam. The two (2) Automated Dispensing Modules (ADM) are the only such devices in existence. The ADM are owned by ADC, but have been used by USDA-WS for eight years. This procurement allows for continued use of these devices and furthers the goal of USDA-WS owning all components required for the production and application of aerial BTS toxicant cartridges.
3. A DESCRIPTION OF THE SUPPLIES, EQUIPMENT, OR SERVICES
REQUIRED TO MEET AGENCY NEEDS (INCLUDING THE ESTIMATED
VALUE OF THE ACQUISITION INCLUSIVE OF OPTIONS):
Currently USDA-WS has a cooperative agreement to perform aerial toxicant treatments on a quarterly basis as part of the Guam Marianas Kingfisher- Memorandum of Agreement (GMK-MOA). Without the ADM units, USDA-WS would not be able to meet the agreement requirements. ADC still retains ownership of the ADM devices. The next BTS aerial treatment regimen is planned for November 2024.

ADM Performance Specifications:
Bait Capacity: 900 cartridges per magazine, 3,600 cartridges total Nominal Max Firing Rate: 4 cartridges/sec Nominal Min Firing Duration to Empty: 15 minutes, continuous operation
Cartridge Broadcast Rate: Configurable, ground speed independent Airspeed Operating Range: 50-70 knots Battery Capacity: 6-8 flight hours, Self-contained battery system, no connectivity to aircraft onboard power or avionics required.
Aircraft Configuration Requirements (Current): Flat deck, (MD 500, Airbus 135, etc.).
Maximum Award = $350,000

5. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES
USE OF THE AUTHORITY CITED:
The ADM is a proprietary system developed by ADC. It was specifically made for aerial broadcast of toxicants for BTS control, and no other system like it currently exists. USDA has used the ADM for treatments in Guam since 2018. No other
Page 4 8/29/2024 company would be able to furnish these devices without extensive research and development costs and would likely result in a higher cost than this proposed acquisition.
6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS
PRACTICABLE, INCLUDING WHETHER A NOTICE WAS, OR WILL BE,
PUBLICIZED AS REQUIRED BY FEDERAL ACQUISITION REGULATION

ADC has provided detailed technical overview and cost breakdown for four previous bait cartridge acquisitions and four ADS bait manufacture component procurement contracts for APHIS by ADC. During the eight-year relationship with ADC, costs have been found to be fair in all previous cases of ADS equipment design and manufacture, as well as all bait cartridge acquisition..
