About this file
Justification for Other Than Full & Open Competition
This document is a Justification and Approval (J&A) for procurement using other than full and open competition authority. DLA Maritime is acquiring 24 shaft angle encoders (nomenclature: ENCODER, SHAFT ANGLE; NSN 5990 017271903; P/N EB4143-H-02) through negotiated contract award. The procurement is classified as commercial items and identified as a reprocurement from the actual manufacturer. The statutory authority cited is 41 U.S.C. 1901, with A/RMC 3 (acquire for the second or subsequent time directly from the actual manufacturer) and A/RMSC R (government lacks data or rights to purchase from additional sources; reverse engineering determined uneconomical).
BEI Precision Systems & Space (CAGE 12050) is identified as the sole source for this requirement, as they own the design rights and have demonstrated production capabilities since the initial purchase. The justification notes that Navy ISEA confirms BEI as the manufacturer for WSHS athwartship and hoist encoders, with all award history to CAGE 12050. One known authorized small business distributor is Integrated Procurement Technologies (CAGE 05ZJ1). A sources sought notice generated one response from CribProcure Inc. (CAGE 9T0S3), a dealer/reseller determined incapable of manufacturing the item. Fair and reasonable pricing will be established using historical pricing, Producer Price Index analysis, and learning curve analysis. The government will include a clause permitting alternate offers with source approval request packages for future consideration. The item was reviewed under NAVSUPWSS limited screen process and determined incapable of breakout. Final approval was granted on October 20, 2026, by the Contract Specialist.

List of Items/Item Description
This justification is based upon the statutory authority of 41 U.S.C. 1901.
A/RMC 3
Acquire, for the second or subsequent time, directly from the actual manufacturer.
A/RMSC R
The Government does not own the data or the rights to the data needed to purchase / contract repair of this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture/repair this item, A/RMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture/repair this item, A/RMCs 1 or 2 are valid.
This acquisition will be negotiated with
BEI PRECISION SYSTEMS & SPACE (12050) is the sole source for this requirement. BEI Precision Systems & Space owns the rights to the design of this part.
They have proven their production capabilities supporting this item since the first purchase of this unit. A less restrictive specification does not currently exist and development of such an item at this time would not meet the immediate needs of the fleet. WebFLIS lists the source as General Dynamics Electric Boat (CAGE 96169), but BEI is a division of General Dynamics since 2017. Navy ISEA confirms the manufacturer for the WSHS athwartship and hoist encoders is BEI Precision System & Space CAGE 12050. They are the sole source for purchase and repair. All award history is to CAGE 12050. There is one known authorized small business distributor at this time, Integrated Procurement Technologies. 05ZJ1.
The proposed contract action will be synopsized in the government-wide point of entry
The following sources have expressed an interest, in writing, in this acquisition
One response was received from the sources sought notice. It was from CribProcure Inc, CAGE 9T0S3. They are a dealer/reseller and did not have any clear answers to any of the questions on the market survey. This is 3R to BEI Precision Systems and the response received was not from a company capable of manufacturing the item. CribProcure is not an authorized distributor for BEI. BEI noted on an RFI completed on 07 AUG 26 that the only authorized distributor of their products is Integrated Procurement Technologies, CAGE 05ZJ1.
The price analysis will be conducted utilizing historical pricing, the Producer Price Index (PPI), and learning curve analysis. To support this evaluation, the Government may request that the offeror(s) submit data other than certified cost or pricing data. The Contracting Officer will thoroughly review the acquisition history for the National Stock Number (NSN), comparing it to similar items as required. Based on these analytical techniques, the Contracting Officer anticipates establishing that the final cost to the Government is fair and reasonable. Ultimately, no award will be executed for this NSN unless a formal determination of price reasonableness is successfully documented.
The Government will include a clause in this solicitation which provides that the Government will consider alternate offers, and that alternate offerors should submit a source approval request (SAR) package that will be referred to the cognizant engineering activity. The current procurement cannot be delayed in order to allow sufficient time for the engineering activity to determine whether to approve any alternate offer. The SAR package will be considered for future awards. This item has been reviewed under the NAVSUPWSS limited screen process and determined that the item cannot be broken out. The Government continues to perform market research.
