JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPRBL1-18-R-0006
1. Contracting Activity: DLA Land at Aberdeen
DSCC-ZLAB
6565 Surveillance Loop, Building 6001, Room C1-301 Aberdeen Proving Ground, MD 21005-1846
2. Description of Action:
This Justification and Approval supports a solicitation using other than full and open competition procedures for a Firm-Fixed-Price, Indefinite-Delivery, Indefinite-Quantity (IDIQ) contract. The requirement is in support of the Advanced Medium Mobile Power Sources (AMMPS) Generator System. This acquisition is for non-commercial parts. FAR Part 15 procedures will be used in this procurement. The maximum value of this acquisition is $3,000,000. The Army manages these spares parts; therefore, Army Working Capital Funds (AWCF) will be used for this effort.
3. Description of Supplies/Services required to meet the Agency’s Need:
This acquisition is for a Digital Control Box Assembly, which is a vital component of the AMMPS Generator Set. This part is required to meet specific performance and interface requirements necessary for the operation of the AMMPS generator sets. The AMMPS is the next generation of mobile power sources boasting better transportability through weight reduction, fuel saving greater than 10% higher reliability and easier maintainability.

4. The statutory authority permitting other than full and open competition is:
The statutory authority permitting other than full and open competition is 10 U.S.C.
2304(c)(1), as implemented by FAR 6.302-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Requirements.”
5. The use of the authority cited in other than 10. U.S.C. 2304(c)(2) above is based on:
The only known manufacturer with the comprehensive knowledge and expertise necessary to produce the required items for this action is Cummins Power Generation (CAGE:
44940). The Government does not possess technical data (drawing of specification) completely

defining the form, fit and function of the items being procured. In addition, the form, fit and function is not defined by any nationally recognized industry standard specification. Any other source would need to undergo extensive review and testing, incurring cost and time. It is anticipated that this would result in duplication of costs and corresponding delays that are not anticipated to be recovered through competition. Without the items, the Government would not possess the resources to support maintenance on fielded AMMPS Generators which could adversely impact mission capabilities.
The Acquisition Method Code (AMC)/ Acquisition Method Suffix (AMSC) for the item in WebFLIS is currently “3B”. According to DFARS PGI 217.7506 an AMC of “3” represents that the items should be acquired for the second or subsequent time, directly from the actual manufacturer. An AMSC of “B” means that the acquisition of this part is limited to the source listed on the source control drawing. Therefore, part number A035E320 is a source controlled part, manufactured by Cummins Power Generation. Cummins is the only approved source listed on the drawing for this part.
6. Market Research/Efforts to Obtain Competition:
On 6 March 2018, technical experts supporting CECOM Integrated Logistics Support Center published a Sources Sought Announcement to find potential sources capable of producing the parts needed to support this requirement. Based upon previous award data and interest after solicitation posting, several Cummins authorized distributors could provide the Cummins parts. They are listed in the Interested Sources section. No source can provide a product that is not manufactured by Cummins. No sources can provide a product that is not manufactured by Cummins. This effort did not yield any additional potential manufacturing sources that can meet the Government’s requirements for the digital control box. Cummins is the only known authorized company to possess the technical data required to manufacture this item, therefore no manufacturing competition is anticipated for this acquisition.
The Contracting Officer synopsized the proposed contracting action on Federal Business Opportunities (FedBizOpps) website on July 10th, 2018. The synopsis was posted for 15 days in accordance with FAR 5.203(a). No responses were received after the synopsis was posted. In addition, the solicitation was posted to FedBizOpps on August 27th, 2018 with a closing date of September 27th, 2018. This J&A will be made available for public in section via FedBizOpps after award, in accordance with FAR 6.305.
7. Fair and Reasonable Cost:
As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on cost analysis in accordance to FAR 15.404-1.
In accordance to Class Deviation 2018-O0015, this acquisition is above the $2 million threshold for obtaining certified cost or pricing data for prime contracts entered into on or after July 1, 2018. The total estimated contract value is therefore certified cost or pricing data is needed for this acquisition in accordance with FAR 15.403-4.
