About this file

This document is a Small Business Set-Aside Program Waiver request from the State of Illinois Chief Procurement Officer (CPO) for a term contract to purchase road warning flares. The waiver is required because the procurement is designated for small businesses in Illinois, but the agency is unable to find an appropriate small business vendor. The contract is for B-21136 with an estimated value of $56,044.80. The contract term is 75 days and the procuring agency is the Department of Central Management Services.

The request indicates that the procurement is set-aside for small businesses by default, but the agency is unable to identify a small business vendor capable of fulfilling the requirement. As a result, the agency is requesting a waiver from the CPO to allow the procurement to be competed on the open market rather than being restricted to small businesses.

SMALL BUSINESS SET-ASIDE PROGRAM WAIVER

From CPO Notice # 2016.03 August 24, 2015:

The Chief Procurement Officer has established set-aside categories of construction, supplies and services that are set-aside for small businesses in Illinois. Procurements that are within the listed categories must be set-aside for small businesses, regardless of the dollar value of the contracts. Additionally, all purchases under the small purchase threshold are automatically set-aside for small businesses in Illinois.

Use of a Small Business Set-Aside Program Waiver requires agencies to have clear justification why a SBSP vendor was not appropriate for a set-aside award. The following are examples of guidelines that may be considered:
