About this file
This document is an Exception to Fair Opportunity request for a sole-source task order award under the NAVSUP DoD Wireless Services (Spiral 4) Multiple Award Contract. The purpose is to provide continued wireless services, including cell phone, data, Wi-Fi, and international roaming, to deployed, OCONUS, and CONUS forces within NSWG2. The current task order expires on November 6, 2024. Award to another source would result in substantial duplication of costs that are not expected to be recovered through competition, as the services were recently transitioned to T-Mobile through a competed task order in FY24. The requiring activity has conducted market research and determined the requirement can be met by a commercial item. The Task Order will be awarded to T-Mobile (N00244-24-D-0009) on a sole-source basis, as a logical follow-on to the previously competed order, with a base year and option years.

SOURCE SELECTION INFORMATION – SEE FAR 2.101 and 3.104
(iii) The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order;
(1) The purpose of this request is to provide continued wireless services to deployed, OCONUS, and stateside CONUS forces within NSWG2. These wireless services include cell phone, data, Wi-Fi (hotspots), and international roaming for approximately 240 lines of service. The current Task Order period of performance expires 6 November 2024. The Spiral 3 MAC IDIQ contracts were extended to add CLIN 6001 to bridge the time between CLIN 5001 on the base contract expiring and the new follow-on IDIQ being awarded. Task orders under the current NAVSUP Spiral 3 IDIQ could only be executed for 12 months until the new IDIQ was awarded.
(2) Award to any other source would likely result in substantial duplication of cost to the Government that is not expected to be recovered through competition. The current task order H92240-24-F-0026 was competed under Spiral 3 IDIQ in October 2023 in which services were transitioned from Verizon to T-Mobile. The current task order was competed with only a 12-month period of performance due to uncertainty with the award of the new Spiral 4 IDIQ. Now that the Spiral 4 IDIQ contract is no longer protested and was awarded in May of 2024, NSW can now place orders with a base year and option years. Due to the Government going through competition in FY24 and already transitioning to a new provider recently through competition who was also the lowest price, it is in the best interest of the Government to not have duplication of costs associated with potential transition to a different provider and increased logistical burden. Therefore, recent competition and pricing does not support re-competing this requirement at this time.
(3) NSWG-2 personnel are deployed in remote locations around the world performing mission critical operations. Any interruptions to service could potentially impact these operations and endanger deployed personnel. Due to deployment there would be a loss of communications supporting operational requirements to replace services with another provider at this time and duplication of costs as noted above.
5. DETERMINATION OF THE BEST VALUE:
The contract did establish the prices for the service to be fair and reasonable. The NSW N01C Contracting Officer will determine, using the procedures in FAR 15.4, that the order represents the best value to meet the Government's needs.
6. DESCRIPTION OF MARKET RESEARCH: The requiring activity and contracting activity have conducted market research among the multiple award contractors. The requiring activity certifies that the requirement can be met by a commercial item and provides supporting documentation which is attached.
7. ANY OTHER SUPPORTING FACTS: This procurement uses a MAC and will be solicited and awarded in accordance with FAR Subpart 16.5.
