About this file
This document presents Special Terms and Conditions for a contract opportunity issued by the Virginia Department of Forestry for invasive treatment services at Crawfords State Forest. The solicitation seeks a contractor to perform foliar application treatments on invasive marsh dewflower (Murdannia keisak) using backpack sprayers. The required completion date for performance of services is October 15, 2026. Bidders must certify that they have inspected the job site and are aware of the conditions under which work must be accomplished. Any bid submitted remains valid for 30 days from submission, after which it may be withdrawn by written request; if not withdrawn, the bid remains in effect until award or solicitation cancellation.
Award will be made to the lowest responsive and responsible bidder based on net prices submitted as all-inclusive total costs. Pricing must be entered in the space provided, and cash discounts for prompt payment, if offered, will not be considered in making awards. The resulting contract will generate one purchase order with applicable eVA transaction fees assessed for each order. Upon delivery, services will be evaluated for compliance with contract specifications, with any deficiencies to be corrected by the contractor at the contractor's sole expense. The contractor must maintain herbicide labels and material safety data sheets on site at all times during treatment and keep complete herbicide application records for at least two years as specified by the Virginia Department of Agriculture and Consumer Services. No portion of work may be subcontracted without prior written consent from the purchasing agency, though the contractor remains fully liable for all subcontracted work. The contractor must indemnify the Commonwealth of Virginia for any losses, liabilities, or claims arising from materials, goods, equipment, or services furnished, provided such liability is not attributable to the using agency's sole negligence.
