About this file
The Special Provisions document details the Village of Schaumburg's 2022 Concrete Improvement Program, a comprehensive municipal infrastructure project encompassing multiple repair and replacement initiatives. The program includes four primary components: a Curb Replacement Program, Sidewalk Replacement Program, Public Works Utility Dig Up Repair Program, and Town Square Concrete Repairs. Work will involve concrete removal and replacement, utility dig up repairs, and reconstruction of various municipal infrastructure elements throughout the Village. The contract is scheduled to begin upon proper execution of contract documents, with substantial completion required by October 17, 2022, and final completion by November 4, 2022. The Village reserves the right to add or delete work locations, and liquidated damages of $1,275 per calendar day will be assessed for incomplete work beyond the specified deadlines.
The contract will be awarded to the lowest responsible bidder who meets specific contractor qualifications, including possessing an IDOT Certificate of Eligibility for Concrete Construction of $1,000,000, submitting five municipal concrete construction references, and demonstrating at least five years of municipal concrete construction experience. The contract term extends to April 30, 2023, with the Village retaining the right to cancel with 30 days' notice for poor performance or unacceptable work. The Village may also renew the contract for three additional one-year optional extensions, with a potential one-time economic adjustment based on the Consumer Price Index and relevant price indices. Pricing will be unit-based for various specific infrastructure elements, and the contractor must comply with numerous technical specifications, including those from the Illinois Department of Transportation and Village of Schaumburg standards.

The program consists of concrete replacement for Public Works utility dig ups at various locations throughout the Village. An initial list of locations involving concrete replacement for the repair of utility dig ups at various locations throughout the Village will be presented at the pre-construction meeting. All work associated with the initial list must be completed by June 13, 2022 or as directed by the Engineer or the representative of the Engineer. Additional locations shall be added during the year to this program.
Utility dig up repairs that are scheduled must be coordinated so that they do not affect the scheduled work with the other programs within this contract, therefore, possibly requiring separate crews to complete such work.
Town Square Concrete Repairs
The improvements at Town Square this year consist of concrete repairs within the VOS
Maintenance Area:
The improvements at Town Square will include concrete sidewalk removal and replacement, concrete step replacement, and any ancillary work necessary to complete such work at Town Square. The design for the concrete step replacement is illustrated with a detail and aerial sheet in Appendix A of this
Contract.
Town Square is a highly developed area at the southwest corner of Schaumburg Road and Roselle Road with many decorative structures, sidewalks, landscaping, planters, etc. Due to the highly visible nature of the work, detailed coordination with the Village and Engineer will be required prior to any work taking place. A construction schedule shall be provided by the Contractor and approved by the Village a minimum of 2 weeks prior to construction. No additional compensation will be rewarded for compliance with the approved schedule.
Extreme caution must be taken not to damage any decorative materials. Additionally, these improvements will require staging to coordinate with scheduled special events at Town Square.
Project Timing: Construction is scheduled to begin upon the proper execution of the contract documents, which includes the submission of insurance and bonds. The substantial completion for the
2022 Concrete Repair Program shall be completed on or before October 17, 2022. The substantial completion date includes the completion of sod restoration. The final completion date includes all necessary tasks to ready the 2022 Concrete Repair Program for final acceptance and payment on or before
November 4, 2022. Failure to comply with the deadlines for the substantial completion and final completion shall result in the enforcement of liquidated damages in the amount of $1,275.00 per day for each and every calendar day that these improvements remain incomplete, in accordance with the Special
Provision, “Liquidated Damages”, and Sections 108.05 and 108.09 of the “Standard Specifications.”
Construction Schedule: At the project pre-construction meeting, the Contractor shall submit for review and approval by the Engineer, a detailed construction schedule that shall clearly indicate the sequential procedure of work proposed to be followed to complete the work as required by the contract documents.
In preparing the construction schedule, the Contractor shall follow the required completion date, calendar days, or additional Special Provisions as specified relating to the construction schedule.
The construction schedule shall depict all work components and essential activities, the time required for the completion of each of the activities and the sequence and interdependence of each of the activities in a project timetable which will translate each project day into an ordinary calendar day. The Contractor shall maintain the construction schedule and shall submit an updated schedule to the Engineer on a weekly, biweekly, or monthly basis as determined by the Engineer. No separate payment will be made to the Contractor for the creation and maintenance of the construction schedule.
Due to Special Events throughout the Village of Schaumburg, holidays and the schedule of local school districts, the contractor will be restricted from working at or near specified locations as instructed by the engineer or a representative of the engineer. No separate payment or compensation will be made due to these restrictions.
The Village provides the public with construction schedules and project status through the Village’s web page. The Contractor shall provide construction related information in a format consisting of an E-mail, letter, or fax acceptable to the Engineer. The Contractor shall assume that this information shall be provided on a weekly basis during construction and may change to a shorter time frame based on construction activity changes or a longer time frame based on construction inactivity. It will be imperative that any scheduled construction activities by the Contractor or any of the subcontractors for the next day’s operations are provided to the Engineer by 12:00 pm every day, unless otherwise directed by the Engineer or representative of the Engineer. If these scheduled construction activities are not given to the Engineer by 12:00 pm every day that work is being scheduled, the work will not be allowed to commence, and no compensation will be allowed for cancelled activities. The Engineer shall determine the time frame and format to be provided by the Contractor.
Terms of Contract:
This contract will begin on award of contract and shall be in full force and effect to and including April
30, 2023 subject, however, to the right of the Village to cancel and terminate the same at any time by giving a thirty (30) day notice in writing to the contractor. The Village invokes the right to cancel the contract for poor performance, and/or for other issues that the Village deems unacceptable or below the standard specified in the contract. In the event of such cancellation, the Contractor shall be entitled to receive payment for services and work performed, and materials, supplies, and equipment furnished under the terms of the contract prior to the effective date of such cancellation, but will not be entitled to receive any damages on account of such or any further payment whatsoever. Upon normal expiration of the contract, the Contractor shall continue, at the sole option of the Village, to provide services on a month-by-month basis, under the same terms and conditions, for a period not to exceed four (4) months.
This contract may be renewed for three (3), one (1) year optional extensions. The optional years will automatically renew providing the Village of Schaumburg has not notified the vendor by written notice, not less than ninety (90) days prior to the contract expiration date, of the Village’s intent to re-solicit new bids.
A one-time economic adjustment for labor, material, and equipment costs may be negotiated for each one-year extension to the contract after the initial one-year contract period. This economic adjustment may not exceed the published local Consumer Price Index (CPI) and Illinois Department of
Transportation Price Indices for bituminous, steel, and fuel for the previous twelve-month period. The contracted vendor shall be responsible for notifying the Village (by written notice) of any requested increase not less than ninety (90) days prior to expiration of the contract year.
This contract places no obligation on the Village to appropriate funds for this service beyond the initial fiscal year term of the contract and is dependent upon sufficient funds being appropriated each fiscal year by the Village for this work.
The Village reserves the right to add or delete from any of the programs within these contract documents.
No extra compensation whatsoever will be allowed.
Liquidated Damages: Should the Contractor fail to complete the work, including cleaning up, to the point of final acceptance of the work by the Engineer within the time specified in the Contract Documents for the Date of Completion and/or Date(s) of Substantial Completion, and agreed upon by the Contractor by accepting the Contract, or within such extra time as may be allowed in accordance with the Contract
Documents, there shall be deducted from any monies due the Contractor, or that may become due the
Contractor, the sum(s) of $1275.00 per day for each and every calendar day, including Sundays and holidays, that the work remains uncompleted. This sum shall be considered and treated not as a penalty but as fixed, agreed, and liquidated damages due the Village from the Contractor by reason of inconvenience to the public, added cost of supervision, and other items which may have caused an expenditure of funds resulting from his failure to complete the work within the time specified.
The Village shall charge the Contractor, and may deduct from partial and final payments for the project, for all Engineering and Inspection expenses incurred by the Village in connection with any work accomplished after the Date of Completion specified in the Contract Documents.
Permitting the Contractor to continue and finish the work, or any part of it after the time fixed for its completion, or after the date to which the time of completion may have been extended, shall in no way operate as a waiver on the part of the Village of any of its rights under the Contract.
Utility Location: The Contractor must exercise extreme caution while working around existing utilities. The Contractor shall notify JULIE (1-800-892-0123), a minimum of 48 hours before commencing construction for utility locations within the scope of the project. It is recommended that the
Contractor conduct a joint utility meet. It is the responsibility of the Contractor to contact all agencies who may or may not be part of the JULIE system to verify the location of their facilities.
The Village does not guarantee the accuracy or completeness of this information. The Contractor shall make his own investigation to determine the existence, nature, and location of all utility lines and appurtenances within the limits of the improvement. The Contractor shall locate all utilities far enough in advance to avoid all conflicts in grade separation between existing utilities and the proposed improvements. If the Contractor encounters a conflict between the proposed improvements and existing utility that was not located in advance by the Contractor, then the Contractor shall, at no cost to the
Village, relocate the proposed improvements and/or the utility to avoid the conflict.
The Contractor will be required to cooperate with all utility companies involved in connection with the removal, temporary relocation, reconstruction, or abandonment by these companies of any and all services or facilities owned or operated by them within the limits of this improvement.
Before doing any work which will damage, disturb, or leave unsupported or unprotected any utility lines, or appurtenances encountered, the Contractor shall notify the respective Owner thereof, who will make all arrangements for relocating, adjusting, or otherwise maintaining or abandoning service on lines that fall within the limits of the proposed construction without cost to the Contractor, including the removal of all cables, manhole covers, and other appurtenances which the Owner desires to salvage. After such arrangements have been made, the Contractor will proceed with the work as directed by the Engineer. All utility lines and appurtenances which are abandoned by the Owner shall be removed and disposed of by the Contractor.
No extra compensation will be allowed to the Contractor for any expense incurred by complying with these requirements or because of delays, inconvenience, or interruptions in his work resulting from the failure of any utility company to adjust, remove, relocate, reconstruct, or abandon their services. The
Contractor shall be responsible for prompt and timely adjustment, removal, relocation, reconstruction, or abandonment of their facilities by all utility companies involved, and the coordination of his own work with that of these companies to the end that work on this improvement is not delayed because of necessary changes in the existing utilities, public or private.
Construction Operations: In order to minimize the effect of construction noise on the area surrounding the improvement, the Contractor and his subcontractors shall comply with the following requirements.
Any changes to this schedule will not be accepted unless approved by the Engineer.
All engines and engine driven equipment used for hauling or construction shall be equipped with an adequate muffler in constant operation and properly maintained to prevent excessive or unusual noises. Any machine or device or part thereof which is regulated by or becomes regulated by Federal or State of Illinois noise standards shall conform to those standards.
Construction operations and the starting or idling of any construction equipment and their back up warning devices shall be confined to the daylight hours between 7:00 AM and 6:00 PM Monday through Saturday. No work of any kind shall be done on Sundays in residential areas unless previously approved by the Engineer. These time restrictions shall not apply to maintenance or operation of safety and traffic control devices such as barricades, signs, and lighting, or to construction of an emergency nature. If the Contractor requires additional time to complete a portion of the work on any given day or if he foresees the need to work extended hours for a number of days to comply with the construction schedule, he must receive the approval of the
Engineer.
The Contractor shall take all precautions necessary to protect the general public and his employees from hazardous locations that might occur within the limits of the improvement. The
Village is not responsible for site safety. The Bidder is solely and exclusively responsible for construction means, methods, technologies, and site safety.
It shall be the Contractor’s responsibility to protect open cut trenches as may be required by
OSHA, Illinois Department of Labor, State, or Federal Law. Trenches in pavements or in close proximity to the improved streets or roadways shall be sheeted or braced in a substantial and effective manner. Sheeting may be removed after backfilling has been completed to such an elevation as to permit its safe removal. Sheeting and bracing left in place must be removed for a distance of 3 feet below the established street grade. The cost of furnishing, placing, and removing sheeting and/or bracing shall be incidental to construction and included in the contract unit price for the work being done.
The Contractor shall schedule and conduct his operations so that the closure time of existing driveways along the route of the improvement is kept to a minimum. All homeowners shall be given a minimum 24 hours written notice prior to initial removal of their driveway apron. The
Contractor shall make every effort to keep driveways open including temporary grading and placement of gravel.
Beginning on the date that the Contractor begins work on this project, he shall assume responsibility for normal maintenance of all existing roadways within the limits of the improvement. This normal maintenance shall include all repair work deemed necessary by the
Engineer. Traffic control and protection for this work will be provided by the Contractor as required by the Engineer. The work involved in maintaining the existing pavement and shoulders will not be paid for separately but will be considered included in the contract unit prices for the various items of work involved, unless otherwise specified elsewhere in these Special Provisions.
If items of work have not been provided for in the Contract, or are not otherwise specified for payment, such items will be paid for in accordance with Article 109.04 of the “Standard
Specifications.”
The Village reserves the right to add or delete quantities from any of the items within these contract documents. No extra compensation whatsoever will be allowed.
Easement and Access Agreements: The Village will obtain easements and access agreements for all work to be performed within private property (outside public right-of-way). Working easements shall be staked by the Village prior to commencement of construction. Extreme caution shall be exercised to protect the existing trees, signs, light posts, etc. within or near the limits of all work. This shall be considered incidental to the Contract.
Concrete Breakers: When removing pavement, curb and gutter, shoulder, and/or any other structures the use of any type of concrete breakers that may damage underground public and/or private utilities, will not be permitted. Under no circumstances will the use of a frost ball be permitted.
The contractor is prohibited from breaking up concrete by dropping it on pavement, or in any other manner that in the opinion of the Engineer or representative of the Engineer may damage existing or proposed pavements, or other roadway appurtenances.
Removal of Miscellaneous Items: Regarding the removal and disposal of any existing fences, gates, signs (except traffic signs), or other miscellaneous items which may interfere with the construction operations, the Contractor shall, with the approval of the Engineer or representative of the Engineer, remove and dispose of these items outside the limits of the right-of-way at locations provided by him, and, if a pay item is not included in the Contract, the work shall be considered as incidental to the
Contract.
Private Decorative Material: Unless indicated to be removed on the plans, extreme caution shall be exercised to protect existing private decorative material within or near the limits of all work. The
Contractor shall use extreme care when removing any item in conflict. The Contractor is responsible for the removal and replacement of said decorative material which includes any fences, gates, signs (except traffic signs), and landscape planters or other miscellaneous items to be removed and replaced as directed by the Engineer. Cost to be incidental to the Contract.
Mailboxes that interfere with construction operations shall also be removed and replaced as directed by the Engineer or representative of the Engineer. Any damage done to said mailboxes or posts shall be the responsibility of the Contractor to correct or replace. Replacement mailboxes shall match the existing as near as possible in type and size and shall be approved by the Engineer or representative of the Engineer prior to placement. This work shall be considered incidental to the Contract.
Town Square Access and Decorative Material: Most of the Town Square Concrete and Paver Repair locations are not accessible by roadway vehicles. It’s the Contractor’s responsibility to investigate the site and determine what construction methods will be used to complete the repairs. The construction methods must be approved by the Engineer prior to any construction. This work shall be considered incidental to the contract unit price of the items involved in the Town Square Concrete and Paver Repairs.
Should any decorative materials be damaged during any phase of construction at Town Square/Veteran’s
Gateway that is deemed outside of the improvement limits by the Engineer, the Contractor will be responsible for correcting the damage to the satisfaction of the Engineer. The necessary labor, equipment, and materials needed to correct the damage will be done with no compensation to the Contractor.
Sewer Connections: This work shall consist of the work necessary to rebuild the sewer connections at all locations where the existing structures have been reconstructed or removed and replaced with new structures as well as any coring needed to connect into existing structures as directed by the Engineer or representative of the Engineer. The connection shall be made with the same size and type of materials as the existing pipe, or as directed by the Engineer or representative of the Engineer. If a tight connection cannot be obtained with normal connection procedures, mission couplings or other means of mechanical couplings approved by the Engineer or representative of the Engineer will be used.
Excavation of trenches shall be performed according to the applicable requirements of Article 550.04.
Backfill of trenches shall be performed according to the applicable requirements of Article 550.07.
Storm sewers will be measured for payment in place in feet. When the storm sewer enters a manhole, inlet, or catch basin, the measurement will end at the inside wall of the manhole, inlet or catch basin.
Allowance will be made for the length of pipe necessary to permit the pipe to meet the sides of the manhole, inlet or catch basin. No payment for storm sewer will be made through a manhole, inlet or catch basin where the manhole, inlet or catch basin is paid for as a separate item. However, when the storm sewer is continuous and the manhole, inlet or catch basin is constructed on top of the storm sewer, the measurement will be from end to end of storm sewer with a deduction made for the tee section which is paid for separately.
Removal of the existing storm sewers will not be measured for payment but shall be considered incidental to the installation of the new storm sewer construction.
This work shall be incidental to the manhole, inlet, catch basin and pipe items and shall include all labor, materials, and equipment necessary to complete this work in accordance with the plans and specifications.
Cleaning Existing Drainage Structures: All existing drainage structures which are to be adjusted or reconstructed shall be cleaned in accordance with Article 602.15 of the “Standard Specifications.” The

Engineer or representative of the Engineer, which shall be pruned along the sidewalk frontage as a minimum. Pruning shall be accomplished at 6" to 12" behind the proposed work, to allow roots to grow back into undisturbed soils and prevent direct exposure to air and subsequent dieback. Actual locations of any equipment to be used for root pruning shall be as agreed upon by the Village’s Forestry
Representative and the Engineer.
Clear shrubs to a distance of 2' on either side of the proposed sidewalk or bike path, or to the property line whichever is nearer. Trim shrubs to maintain a minimum of 8' of overhead clearance from the proposed sidewalk or bike path.
Root pruning, shrub and tree trimming shall be coordinated with the Village’s Forestry Representative and the Engineer prior to completing such work. This work shall be performed by a qualified contractor and shall be considered incidental to the Contract.
Construction Staking: The Contractor is responsible for the setting of all necessary line and grade stakes needed for the project. The Contractor may ask the Engineer for assistance as needed in setting benchmarks, stakes, marks, and in setting stringline. The Contractor agrees that marks made or stakes set are indicative at the time of the line or elevation given, and the Contractor hereby agrees that the Village shall not be responsible for proper protection and continued accuracy of marks or stakes after being set, but said improvement shall in any event be constructed at the elevations given on the plans attached and specified thereon.
The Contractor shall be responsible for any mistakes or errors arising from the tampering with or removal of any stakes and shall take proper care in the preservation of such stakes and marks.
The Contractor shall provide all materials (paint, hubs, lathe, etc.) needed to set line and grade stakes.
The cost of the materials shall be incidental to the Contract.
Inspection: All phases of the improvements will be subject to inspection by representatives of the

The Contractor shall complete removal or cleanup of items requested by the Engineer within 24 hours unless otherwise specified.
Work shall progress in a timely fashion, and streets shall not remain in an uncompleted state for long periods of time. Required timelines for access restoration, progress of work, backfilling, and restoration are detailed throughout these specifications.
A housekeeping deduction in the amount of $750 per day may be assessed at the discretion of the
Engineer, if at any time the Engineer deems the Contractor is not meeting the required timelines for housekeeping requests, access restoration, progress of work, backfilling, restoration, and other items as detailed in these specifications. This deduction will be applied to the next pay estimate due the
Contractor.

Engineer, the proposed work shall meet the existing elevations of these structures. Should reconstruction or adjustment of a drainage structure be required, the necessary work shall be done in accordance with the
“Standard Specifications”.
The Contractor shall take the necessary precautions when working near or above existing sewers in order to protect these pipes during construction from any damage resulting from his operations. All work and material necessary to replace existing sewers damaged because of noncompliance with this provision shall be as directed by the Engineer, in accordance with the "Standard Specifications", at the Contractor's own expense. No extra compensation will be allowed.
Sawing Pavement, Driveway Pavement, Sidewalk, and Curb: This work shall be performed at locations shown on the plans or as directed by the Engineer or representative of the Engineer. The contractor shall cut the joint between the portion to be removed and that to be left in place with a sawing machine to prevent spalling when the item is broken out. This work shall be done in a manner that a straight and perpendicular joint will be secured. All saw cutting shall be to the full depth of the pavement, driveway, sidewalk, or curb to be removed.
After saw cutting, the Contractor shall immediately remove all concrete or asphalt slurry from the work area, specifically from the pavement, driveway, sidewalk and curb and gutter which is to remain in place.
When the concrete or asphalt slurry is wet, it creates a slippery and hazardous condition. In addition, if the concrete or asphalt slurry is allowed to dry, it creates an unsightly aesthetic appearance. In the event the concrete or asphalt slurry is not removed immediately and the concrete or asphalt slurry cures and adheres to the adjacent surface, the Contractor shall remove and replace the portion with concrete or asphalt to the satisfaction of the Engineer, or representative of the Engineer. No additional compensation will be allowed for removal of the slurry or removal and replacement of the adjacent area due to slurry which was not immediately removed from the adjacent area.
It is the contractor’s responsibility to determine the thickness of the existing item to be removed and whether it contains reinforcement.
Saw cutting of pavement, driveway pavement, sidewalk, and curb with or without reinforcement shall be considered incidental to the contract and the items to be removed. No additional compensation will be allowed for sawing reinforcement.
Material Inspection: The local agency shall be responsible for the quality assurance field inspection.
The Village and Engineer shall be notified at least twenty-four (24) hours in advance of the placement of any Hot-Mix Asphalt or Concrete Mix. The Contractor shall allow the inspector access to his plant area to observe the operations and take material samples as required.
The contractor shall be responsible for quality control inspection. Contractor’s attention is directed to

This work will take place at Town Square as directed by the Engineer. Town Square is a highly developed area with many decorative structures, sidewalks, landscaping, planters, etc. Most of the repairs are not accessible by roadway vehicles. Extreme caution must be taken not to damage any decorative materials. It’s the Contractors responsibility to investigate the site and determine what construction method will be used to complete the repairs. The construction method must be approved by the Engineer prior to any construction and will be considered incidental to the SIDEWALK REMOVAL (SPECIAL).
