About this file
This document is a Special Procurement by Rule Request from the Oregon Department of Fish and Wildlife (ODFW) to purchase a used Caterpillar V40B forklift to replace an aging forklift at the Bonneville Hatchery. The forklift is essential for daily operations at the hatchery, including unloading and loading supplies, fry ponding, spawning, and marking operations. Due to the age and condition of the current forklift, it has become difficult and unsafe for the maintenance staff to operate. ODFW is requesting to use the special procurement rule under OAR 125-247-0288 to purchase a used forklift at an estimated cost of $32,500. This proposed special procurement will be unlikely to encourage favoritism or diminish competition, and will result in substantial cost savings compared to purchasing a new forklift.
The related state and local contract opportunity is for the purchase of the used forklift and other equipment for the Bonneville Hatchery, pursuant to OAR 125-247-0288. The equipment is being purchased from Toyota Lift Northwest of Clackamas, Oregon. This is not a solicitation, but rather a notice of the used equipment purchase for the Bonneville Hatchery staff to use during the field season.

RE: Request for Special Procurement by Rule—Purchase of Used Personal Property Per OAR 125-247-0288 or OAR 137-049-0150 and ORS 279B.085 Bonneville Forklift replacement
Fish Division requests a determination of use of Special Procurement by Rule under ORS 279B.080 for the Bonneville Forklift replacement project. This project requires a contracting procedure that differs from the procedures described in ORS 279B.055, 279B.060, 279B.065 and 279B.070 for the procurement of a forklift.
This request outlines the situation, the justification for the Special Procurement, and findings to satisfy the required standards. Approval of the request activates the proposed process to produce the needed Public Contract.
Special Procurement Under Rule as per OAR 125-247-0288 (10) Type: Purchase of Used Personal Property
Time Period Requested: From: ___9/15/23___ To: __10/31/23_______
Total Estimated Cost: $____$32,500______
Request, Background, Current Need, and Proposed Contracting Procedure:
a. Request:
Bonneville request approval to purchase a used forklift to replace forklift (Caterpillar V40B forklift;
PN# 061035).

d. Proposed Contracting Procedure: Use special procurement rule OAR 125-247-0288 (10) to purchase a used Caterpillar V40B forklift; PN# 061035.
Findings to Satisfy the Required Standards: This proposed special procurement:
___x__ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:
We contacted state surplus, searched Oregon Buys, contacted COBID Vendors, and multiple used forklift dealers were considered when looking for a forklift that would meet the hatchery needs.
and
___x__ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:
Purchasing a used forklift with low operation hours versus a new forklift will result in a savings of approximately $15,000.
or
______ (b)(ii) will otherwise substantially promote the public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:
[Provide specific information that demonstrates how the proposed Special Procurement meets this requirement. You can include savings along with public interest.]
