Special Notice 3 W9124J-23-R-0003 Pre-Proposal Organizational Conflicts of Interest (OCI) The U.S. Government desires to procure Army Privatized and Government-Owned Military Housing Inspections Services. Prior to the release of the formal request for proposals (RFP), the Government is requesting all potential offerors on this effort to provide the names, duties and responsibilities of all personnel, contractors, and subcontractors who will be involved in the preparation or review of its proposal. The Government also requests potential offerors identify any actual or potential Organizational Conflicts of Interest (OCI) concerns and mitigation matters that the offeror intends to take. Pursuant to FAR 2.101, “Organizational conflict of interest means that because of other activities or relationships with other persons, a person is unable or potentially unable to render impartial assistance or advice to the Government, or the person’s objectivity in performing the contract work is or might be otherwise impaired, or a person has an unfair competitive advantage.” Refer to FAR Part 9.5 for additional details regarding OCIs.
The Government would request special emphasis on identifying individuals who in the last five (5) years were former government personnel, contractors, or subcontractors performing on any Army Housing Privatization Contract to include former (or current) roles and responsibilities.
The Government further notes that once proposals are received, and if the Government later determines that an organizational conflict exists, this may result in the proposal being determined unawardable and excluded from the competition. As such the Government would recommend that before any additional individuals are involved with an offeror’s proposal development after the proposal submission, that the offeror immediately contact the Contracting Officer.
1. Potential offerors response to this Special Notice shall include:

b. If any member of the proposal writing team is identified as having an OCI concern, the potential offeror SHALL provide a written explanation of the offeror’s plan to effectively mitigate or avoid the OCI concerns for the Government’s review. If the Government determines that the OCI cannot be effectively avoided or mitigated, the offeror may be excluded from the competition.
2. Potential offerors SHALL provide its response to this Special Notice as soon as possible, no later than 5 calendar days after release of the formal RFP. The email subject line should read, “W9124J-23-R-0003, OCI Response.” Responses shall be sent via email to Colleen Rye, Contract Specialist at colleen.m.rye.civ@army.mil and Stephen Noethen, Contracting Officer at stephen.d.noethen.civ@army.mil. An offeror who fails to comply with this requirement by the stated date/time may be removed from the competition without any further consideration of its proposal for award.
This notice does not commit the U.S. Government to contract for any supply or service. Furthermore, the U.S. Government is not seeking quotes, bids or proposals at this time and will not accept unsolicited proposals in response to W9124J-23-R-HOUS. The U.S. Government will not pay for any information or administrative costs incurred in response to this notice. If a solicitation is released, it will be synopsized on the Governmentwide Point of Entry. It is the responsibility of potential offerors to monitor the Governmentwide Point of Entry for additional information pertaining to this requirement.
