Amendment 0001 is hereby issued for the following reasons:
A. The following are responses to questions submitted on or before April 21, 2022:
Q1. Is the schedule available in an excel spreadsheet?
A1. The schedule is currently not available in an excel spreadsheet. We will look into providing an excel version that will be included in an amendment to the solicitation.
Q2. Paragraph 1 of the solicitation states, "In order to meet these minimum requirements, an offeror must submit transportation agreements demonstrating that the offeror has secured arrangements that will enable it to support orders for the product(s) specified, in accordance with the requirements schedule, and consistent with the delivery requirements and all other terms and conditions in the Solicitation"; however, further down in the same section under Responsibility it states, "The Government may also request copies of the transportation agreements with the offeror’s transportation subcontractors."
Please clarify whether transportation agreements are required as part of the initial submission.
A2. The RESPONSIBILITY paragraph is in addition to the evaluation criteria explaining how the government would determine offeror’s responsibility…In making this responsibility determination, the Government may conduct pre-award surveys to assure awardees meet the FAR 9.104-1 standards for present responsibility. In addition, the Government may request that offerors provide commitment letters from its suppliers. The Government may also request copies of the transportation agreements with the offeror’s transportation subcontractors.
The RESPONSIBILITY paragraph list out want the Government may request or do to determine offerors responsibility to meet the requirements to include conducting a pre-award survey, requesting commitment letters and transportation agreements, which we do request (transportation agreements) in Factor 2.

Q19. Having the solicitation list the minimum gallons for transport trucks gave suppliers a benchmark on how much freight needed to be added to their margins. As you are probably aware, a transport can hold a large swing in gallons, 2,000 to 7,500 diesel or 8,500 gas. Not giving a specific minimum gallon count could create complications between customers wanting to use their low awarded transport margin for small, most likely tank wagon gallons and suppliers not wanting to lose money on deliveries they could not anticipate for larger gallon tanks. Can you please give a firm minimum gallon count for transport deliveries or correct the solicitation wording to make the gallon sizes clearer between the different types of truck deliveries?
A19. In place of the previous language which provides for 5,200 USG as the minimum, the new version of contract text F1.01-1 states: (1) Where the Schedule provides for multiple drop deliveries, the Contractor may be required to deliver into more than one storage tank. Where truck and trailer is the method of delivery specified, the Contractor may, at its option, make delivery by transport truck… The contract text now provides the Contractor the option of delivery method based on the minimum gallon concern. We will forward your request to include the previous language not found in the updated contract text F1.01-1 DELIVERY
CONDITIONS FOR TRANSPORT TRUCKS, TRUCKS AND TRAILERS, AND TANK
WAGONS (DLA ENERGY March 2022) to our policy office for review. However, any updates to the contract text will not be a part of the solicitation until they are approved by our policy and legal offices.
UPDATE: The current language found in F1.01-1 was approved by Deputy Director of DLA Energy FEP to provide greater flexibility. Business rules are in place to help manage how much customers order. There will be no update to the current contract text at this time.
